CONSIDERATION OF A RESOLUTION AWARDING A CONSTRUCTION CONTRACT TO ALL

AMERICAN ASPHALT FOR ARTERIAL PAVEMENT PRESERVATION PROGRAM FOR SOUTH EL CAMINO REAL (W. AVE. GAVIOTA TO W. AVE. SAN ANTONIO), CIP PROJECT NO. 12303, IN AN AMOUNT NOT TO EXCEED $332,218, AUTHORIZING THE CITY MANAGER

TO EXECUTE THE CONSTRUCTION CONTRACT AND FINDING THE PROJECT CATEGORICALLY ..body EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT Summary:

The City Council is being asked to consider adoption of a resolution (Attachment 1) to award and authorize the execution of a construction contract with All American Asphalt, in an amount not to exceed $332,218, for the Arterial Pavement Preservation Program for South El Camino Real (W.

Ave. Gaviota to W. Ave. San Antonio) (Attachment 2).

Background:

As part of the Arterial Pavement Preservation Program, the South El Camino Real (W. Ave.

Gaviota to W. Ave. San Antonio) project includes grinding and repaving 0.20’ depth of deteriorated asphalt pavement areas, crack filling all cracks on asphalt pavement, sealing with micro-surface full width of asphalt pavement. The project also includes concrete repair work consisting of the removal and replacement of curb and gutter, sidewalk, and curb ramps maintaining safe pedestrian routes.

City staff completed plans and specifications for the project. On February 5, 2026, staff contacted local contractors, published a notice inviting bids for this project in the San Clemente Times, and published a bid solicitation on PlanetBids. Bids were opened on February 19, 2026, and the 1 Attachment 3

results are presented in the table below. Bids ranged from $332,218 to $398,973. There were no bids from businesses based in San Clemente.

The apparent lowest bidder, All American Asphalt, had a minor irregularity in their bid: the total bid price written on the hard-copy bid form and uploaded to PlanetBids was $322,218, whereas the total bid price entered and calculated electronically via PlanetBids was $332,218. All American Asphalt acknowledged an error in the bid, City staff determined there was a typographical error in entering the total bid amount on the hard-copy bid form, and the correct low bid amount is $332,218.

The City Council reserves the right to waive any irregularities or informalities in the bids or bidding process per the City’s Procurement Policy and Procedure Section VII.D.7.

Based on the above findings, the staff recommends that the City Council consider All American Asphalt of Corona, California, with a total bid amount of $332,218, to be the lowest responsive and responsible bidder, and waive the minor irregularity. This error did not result in any competitive advantage because All American Asphalt is still the low bidder.

CITY OF SAN CLEMENTE
Considerations Identified by Staff:

This project, as part of the Arterial Pavement Preservation Program, will repair deteriorated pavement areas, fill cracks, and seal the full width of the pavement to extend pavement life by maintaining and utilizing cost-effective measures.

If the City chooses not move forward and maintain deteriorated pavement areas within streets, pavement deterioration will progress to pavement failures, and the streets will require full street pavement reconstruction, which is significantly more costly and more disruptive to City residents.

Council Options:
 Adopt Resolution No. 26-52 (Attachment 1), awarding the Arterial Pavement Preservation Program for South El Camino Real (W. Ave. Gaviota to W. Ave. San Antonio) contract to All American Asphalt, authorizing the City Manager to execute a construction contract an amount not to exceed $332,218, and finding the project categorically exempt from CEQA under Class 1 (Existing Facilities, 14 CCR section 15301) of the State CEQA Guidelines.  Modify and adopt Resolution No. 26-52.
 Continue the item and direct staff to provide additional information.  Do not award the contract or construct the street improvements.

Environmental Review/Analysis:

This project is exempt from the California Environmental Quality Act (CEQA) under Class 1 (Existing Facilities, 14 CCR section 15301) of the State CEQA Guidelines because it consists of repairs to existing City facilities, involves negligible or no expansion of existing or former use, and has no possibility of a direct or reasonably foreseeable indirect effect on the environment.

Fiscal Impact:

The estimated total construction cost of $399,218 is comprised of construction ($332,218) and construction management/inspection ($67,000), and is within the approved budget of $470,000 from the Gas Tax Fund, Account No. 012-861-45300-000-12303 Arterial Pavement Preservation Program.
