This is to inform you that the City has approved a ------- permit at the address listed above. Per California state law and San Clemente Municipal Code (SCMC) Section 15.04.030 (exception), the City shall not condition approval of a permit application on the approval of an association (as defined in Section 4080 of the California Civil Code) for any of the following types of permits: (1) solar energy system (as defined in Section 801.5(a) of the California Civil Code): (2) accessory dwelling units (ADUs) (as defined in Government Code Section 65852.2, subdivision (i)); (3) telecommunications facilities (as defined in 47 C.F.R. Section 1.6100 (b) (7), implementing 47 U.S.C. Section 1455); or (4) electric vehicle charging stations (as defined in Government Code Section 65850.7, subdivision (i)). When any of these exceptions apply, the City provides notice to the applicable association advising that the City has approved the permit.
While SCMC 15.04.030 requires the City to verify HOA approval of certain residential construction plans, state law prohibits and the City does not require verification of HOA approval for this project. This notice is being provided as a courtesy.
