This 2018 case arises from the United States International Boundary and Water Commission’s (USIBWC) alleged violations of the Clean Water Act and its National Pollutant Discharge Elimination System (NPDES) permit. The lawsuit asserts USIBWC mismanaged its water treatment facilities in San Diego and discharged raw sewage, industrial waste, and agriculture runoff into the Tijuana River, the Tijuana River Estuary and ultimately the Pacific Ocean. The City Attorney’s Office will update the Mayor and City Council on the status of the litigation and seek direction.
