Item 600: Senate Bill 79 Phased Implementation and Exempting Non-Transit Oriented Development Areas.

Proposed Actions:
Adopt the following Ordinance which was amended by council action by interlineation at the time of introduction on 5/7/2026, Item 600, (Council voted 6-0, Councilmember Foster-not present, Council President Pro Tem Lee-not present, Councilmember EloRivera-not present):
The City Planning Department proposes an Ordinance to use the provisions in Senate Bill (S.B.) 79 to phase its implementation in a manner that allows the City to more comprehensively address fire safety, fair housing, historic resources, climate resiliency, neighborhood scale, and related considerations prior to broader implementation. The ordinance also proposes the exemption of areas outside of a one mile walk from TOD Stops (as defined by S.B. 79) from S.B. 79 application. (O-2026-124 REV.) ADOPTED AS ORDINANCE O-22099 (New Series) Ordinance Phasing the Implementation of S.B. 79 Including Exemptions.

Item 601: TransNet Local Street and Roads Program - 2027 Regional Transportation Improvement Program (RTIP) Development and Fiscal Years 2027 – 2031 Program of Projects.
Total Estimated Cost of Proposed Action and Funding Source:
Based on SANDAG’s TransNet Revenue Forecast revised on January 21, 2026, the City’s total TransNet Program for the next five years is $49,095,000 for Fiscal Year 2027, $50,450,000 for Fiscal Year 2028, $51,773,000 for Fiscal Year 2029, $53,110,000 for Fiscal Year 2030 and $54,473,000 for Fiscal Year 2031.
