Agenda Item Staff Report
To: Honorable Mayor and Members of City Council
For the Meeting of December 20, 2023
From: Chris Constantin City Manager
Jeff Malawy, City Attorney
Subject: Resolution 2023-73 to Appoint Emmett G. Badar to the Office of Mayor and Cancel the March 5, 2024 Election for the Office of Mayor, Due to Only One Person Being Nominated for that Office
____________________________________________________________________________

SUMMARY
At the close of the candidate filing period, only one person has been nominated for the March 5, 2024 election to the office of Mayor. State law allows the City Council to appoint the person nominated. Making the appointment in lieu of holding the mayoral election will result in a cost savings to the City of approximately $100,000.

RECOMMENDATION
City staff recommends that the City Council:
• Adopt Resolution 2023-73 appointing Emmett G. Badar to the office of Mayor for a full term of two years in lieu of an election, and cancelling the March 5, 2024 election for the office of Mayor, pursuant to California Elections Code Section 10229.

FISCAL IMPACT
Savings of $100,000. If the election were cancelled for the office of Mayor, the City would save approximately $100,000 in election costs incurred from services rendered by the Los Angeles County Elections Division.

BACKGROUND
On October 10, 2023, the City Council adopted Resolution No. 2023-61, calling and giving notice of the holding of a general municipal election for the purpose of electing a Mayor for the full term of two years, one member of the City Council from District 1 for the full term of four years, and one member of the City Council from District 3 for the full term of four years.

As of the close of the nomination period for the office of Mayor on Friday, December 8, 2023, only

one person, Emmett G. Badar, had been nominated and filed nomination papers to run for the office of Mayor.

DISCUSSION/ANALYSIS
Elections Code Section 10229 provides that if by the statutory nomination filing deadline, no one or only one person has been nominated for any office, and there is no citywide contested race, then the City Clerk shall certify those facts to the City Council and publish a notice of the same.

More than five days after publication, the City Council may take one of three courses of action:

1. Appoint to the office the person who has been nominated; or

2. Appoint to the office an eligible voter if no one has been nominated; or

3. Hold the election.

Pursuant to Elections Code Section 10229, the City Clerk provided the required certification to the City Council that only one person has been nominated for the office of Mayor and published a notice of the same on December 14, 2023 in the San Gabriel Valley Daily Bulletin. The required five-day notice period is now complete.

Adoption of Resolution 2023-73 would appoint Emmett G. Badar to the office of Mayor for a full term of two years, and would cancel the March 5, 2024 mayoral election. The elections for City Councilmember in Districts 1 and 3 would still be held.

If no one is appointed by the 75th day before the election (December 21, 2023), then the Elections Code requires that the election for Mayor be held. Therefore, the only possible date to adopt the attached resolution is December 20, 2023.

If appointed, Emmett G. Badar would take office and serve exactly as if elected at the March 5, 2024 election. He would be sworn in and take office with the other newly-elected city councilmembers after the election.

ALTERNATIVES
The City Council may take no action, and the election for the office of Mayor would be held.

ENVIRONMENTAL REVIEW
This item is exempt from the California Environmental Quality Act (CEQA) under CEQA Guidelines 15061(b)(3) because it can be seen with certainty that there is no possibility that this item will have a significant effect on the environment.

Respectfully submitted,
Jeff Malawy, City Attorney
