Prepared by: Michael O'Brien, Director of Administrative Services Subject: Approve Resolution 2025-51 Authorizing the Closure of City Hall, Recreation and Senior Centers and Field Operations aside from Emergency Work on December 26, 29, 30, 2025 as well as January 2, 2026.
____________________________________________________________________________
SUMMARY
Request for approval of Resolution 2025-51 to authorize the closure of City Hall, Recreation and Senior Centers and field operations on December 26,29,30, 2025 as well as January 2, 2026. Emergency services will remain available.
RECOMMENDATION
Staff recommends the following:
• Approve Resolution 2025-51 to authorize the closure of City Hall, Recreation and Senior Centers and field operations aside from emergency work on December 26,29,30, 2025 as well as January 2, 2026.
GOVERNMENT CODE §84308 APPLIES:
https://leginfo.legislature.ca.gov
No
FISCAL IMPACT
The requested closure dates of December 26,29,30, 2025 and January 2,2026 will require the use of accumulated employee personal leave. The use of leave time assists the City by reducing the compensated absences liability balance that the City records on its books each fiscal year.
BACKGROUND
The City observes thirteen holidays each year, including Christmas Eve, Christmas Day, New Year's Eve and New Year's Day. Because of how these holidays fall on the calendar this year,
Approve Resolution 2025-51 Authorizing the closure of City Hall, Recreation and Senior Centers and Field Operations Aside from Emergency Work Page 2
For the Meeting of October 14, 2025
City facilities would be open for four days during the time period from December 24 - January 5, 2025. In the last five years, the City Council closed City Facilities for the non-City observed Holidays between Christmas and New Years. In years prior, the days between December 24 and January 2 saw little to no activity from the public as many operations get put on hold until the holiday season is complete and ramp back up starting after the observance of New Year's Day each year. Staff has requested the closures of City facilities and field operations, aside from emergency work, on December 26, 29, 30, 2025 and January 2, 2026. Because January 2 falls on a Friday, which are half-staff days in alignment with employees 9/80 work schedule, and since Fridays have little public activity, it appears reasonable to remain closed through January 2nd and reopen on Monday January 5th, 2026.
DISCUSSION/ANALYSIS
Along with the benefit of the compensated absences liability reduction, it is believed that the extended time off would be very beneficial and appreciated by the employees. This concept of closing during the dates between Christmas and New Year's is not unique as many cities in Southern California take this opportunity to provide an extended break for their employees due to the close proximity of the multiple holiday dates.
To accomplish this, Council must adopt a Resolution to close City facilities when necessary or appropriate on non-holiday dates.
ALTERNATIVES
The City Council may elect not to approve Resolution 2025-51, thereby keeping City Hall open during the regular operating hours established for December 26, 29, and 30, 2025 and January 2, 2026. In this event, employees who have not had requested time off approved would be available for City operations.
ENVIRONMENTAL REVIEW
Pursuant to CEQA guidelines Section 15061 (b)(3), CEQA does not apply to this item because there is no potential for causing a significant effect on the environment. Therefore, no additional environmental review is needed at this time.
Respectfully submitted,
Michael O'Brien
Director of Administrative Services

Subject: Award Construction Contract 2025-03 Catch Basin Full Trash Capture Insert Installation Project to Oppenheimer National in the Amount of $298,028.70; Approve Project Budget of $342,733.01; Declare the Bid From United Storm Water, Inc., to be Non-responsive.
____________________________________________________________________________
SUMMARY
Construction Contract 2025-03 installs 60 curb inlet filter full trash capture (FTC) devices at catch basins throughout the City. The waste discharge requirements for Municipal Separate Storm Water System (MS4) permits mandate the City to comply with the Trash Total Maximum Daily Load (TMDL) by retrofitting certain existing City catch basins within the City limits to capture trash prior to entering the storm drain. FTC devices will be utilized to satisfy the California State Water Resources Control Board requirement for certified full capture devices. Any proposed substitution must be certified by the California State Water Resources Control Board for a full capture device as well as approved by the City.
RECOMMENDATION
City Staff recommends that the City Council:
1. Adopt the plans and specifications included as part of the bid package for Contract 2025-03 Catch Basin Full Trash Capture Insert Installation Project attached hereto and on file with Public Works.
2. Award Construction Contract 2025-03 to Oppenheimer National as the lowest responsive bidder for the bid amount of $298,028.70.
3. Authorize and appropriate a total project budget of $342,733.01 from the City’s Safe Clean Water funding account.
4. Authorize the City Manager to execute the Construction Contract with Oppenheimer National in a form approved by the City Attorney.
5. Declare the bid from United Storm Water, Inc., to be non-responsive and reject the bid on the basis that it failed to conform to the specifications.

FISCAL IMPACT
Funding for this project was allocated in Fiscal Year 2024-2025 and Fiscal Year 2025-2026 from Measure W Funds (Fund 78). Measure W funds are restricted for use on stormwater quality projects. If awarded, the project budget would be as follows:
Construction Bid $298,028.70
Project Contingency (15%) $44,704.31
Construction Project Budget: $342,733.01
BACKGROUND
The City of San Dimas maintains over 900 catch basins located throughout the City. In addition, there are LA County Flood Control District and Caltrans catch basins in the City that San Dimas is not responsible for maintaining. All catch basins are part of the storm drain system which is designed to prevent flooding by carrying excess rainwater to the San Gabriel River and ultimately the ocean. During storms in urban areas, rainwater runoff carries pollutants generated from commercial businesses, residential areas, streets, and sidewalks directly to the ocean creating stormwater pollution. Materials such as sediment, plaster, yard waste, animal waste, and trash, contain toxins that are harmful to aquatic life and humans.
The State Water Resources Control Board adopted Water Code Section 13383 requiring MS4 permittees to install full-trash capture (FTC) devices inside catch basins. As an MS4 permittee, the City is required to comply with this order and has installed 44 full-trash capture devices to date. Eventually, the City will need to install approximately 300 full trash capture devices to comply with the Water Board requirements. Due to the efforts associated with this mandate, permittees can install full capture devices in a phased approach.
The Water Board Order specifies FTC devices to be installed in priority land use areas (PLU).
PLUs are industrial areas, commercial sites, high-density residential and near public transportation stations where volumes of waste are more concentrated. The 60 FTC devices will be installed in/around these PLU areas.
The City utilizes the Revel Environmental Manufacturing (REM) Triton Perf-FTC Inlet as its fulltrash capture device. It is a Water Board-approved FTC device and 44 have been installed to date. The inlet is a fabricated stainless-steel basket installed inside a catch basin. The 44 devices have performed well, and the Streets Division is able to service the inlets for cleaning/clearing.
The typical debris found in the devices are leaves and landscaping material.
This Construction Contract will allow the awardee to install 60 FTC devices throughout the City as part of a phased approach. The reason for the phased approach is to allow the Streets Division to acclimate to the maintenance and cleaning. Another reason is to allow Safe Clean Water funds to become available to use for the costs of compliance.

5 Kal Best Contractor, Inc. $399,999.00
The sealed bid submitted by United Storm Water was initially considered to be the lowest bid.
Upon review, United Storm Water submitted a bid for an alternate device other than the one listed in the bid specifications. Oppenheimer National submitted a bid protest for the project. Staff consulted the City Attorney’s office regarding the protest. The specifications and addendum require alternates to be considered after the time of award. In their bid, United Storm Water submitted a letter that if the alternate device was not accepted, they would withdraw their bid. The City Attorney’s office determined United Storm Water’s bid should be considered non-responsive on the basis that California courts have recognized that allowing a bidder to bid an alternate product without following the process provided in the specifications provides an unfair advantage, and thus Oppenheimer National would be the apparent lowest bidder.
Staff reviewed the bid proposal provided by Oppenheimer National and verified the contractor’s bid bond is issued by an admitted surety, as required by Public Contract Code 20170. It was confirmed through the State Contractor’s License Board that the contractor’s license #1095956, Class A & B, is current and active with an expiration date of August 31, 2026. The contractor is registered through the Department of Industrial Relations as required by law (Registration No. 1095956). Staff checked references provided and Oppenheimer National has successfully completed several projects for other agencies.

A. SUBSTITUTION OF SECURITIES FOR MONIES WITHHELD TO ASSURE PERFORMANCE AND PAY
EARNED RETENTIONS DIRECTLY TO AN ESCROW AGENT
Department of Public Works City of San Dimas, California CC2025-03 FTC Installation Project
8 In accordance with California Public Contract Code, Section 22300, the Contractor may request permission to substitute securities in lieu of having retention withheld by the City from progress payments when such payments become due or, in the alternative, the Contractor may request that the City make payments of earned retentions directly to an agreed upon designated escrow agent at the Contractor’s expense. The following shall control if either option is requested by the Contractor:
1. Substitution of Securities for Performance Retention At some reasonable time before any progress payments would otherwise be due and payable to the Contractor in the performance of the Work under the Contract, the Contractor may submit a request in writing to the City requesting permission to substitute retentions with securities equivalent to the estimated amount of retention (“Estimated Retention”) to be withheld by the City. The Contractor shall deposit such securities with the City or may, in the alternative, deposit such securities in escrow with a state or federally chartered bank in California, as the escrow agent, and at the Contractor’s expense. Such securities will be equivalent or greater than the Estimated Retention. If on or after the date the securities are to be deposited: (a) the Contract is modified, by written modification, change order or otherwise, resulting in the Contractor being entitled to receive an amount more than the estimated Contract amount; and/or (b) the City, by a reservation of rights and at its sole discretion and upon advise of the City Attorney, determine that the amount of the securities on deposit, are not equal to or greater than the Estimated Retention, the Contractor shall within a reasonable time, upon the request of the City, deposit additional securities, so that the amount of securities on deposit with the City or escrow agent is equivalent or greater in value than the amount of Estimated Retention. Upon satisfactory completion of the Contract, which shall mean, among other things, that the City is not otherwise entitled to retain proceeds from progress payments as elsewhere provided in the Contract or under applicable law, the securities shall be returned to the Contractor.
2. Deposit of Retention Proceeds with an Escrow Agent As an alternative to the substitution of securities, as provided in (A)(1) above, or the City otherwise retaining and holding retention proceeds from progress payments, the Contractor may request the City to make payments of retentions earned directly to an escrow agent with the same qualifications as required in paragraph (A)(1) above and at the expense of the Contractor. At its sole expense, the Contractor may direct the investment of such retention payments into only such securities as mentioned in paragraph (A)(3) below and shall be entitled to interest earned on such investments on the same terms provided for securities deposited by the Contractor. Upon satisfactory completion of the Contract, which shall mean when the City would not otherwise be entitled to withhold retention proceeds from progress payments had the Contractor not elected to have such proceeds deposited into escrow, the Contractor shall be allowed to receive from the escrow agent all securities, interest, and payments deposited into escrow pursuant to the terms of this section.
The Contractor shall pay to each subcontractor, not later than twenty (20) days of receipt of the payment, the respective amount of interest earned, net of costs attributed to retention withheld from each subcontractor, on the amount withheld to insure performance of the Contractor.
3. Securities eligible for investment Securities eligible for investment shall include those listed in California Government Code Section 16430, bank or savings and loan certificates of deposit, interest bearing demand deposit accounts, standby letters of credit, or any other security mutually agreed upon between the Contractor and the City. The Contractor shall be the beneficial owner of any securities substituted for any monies withheld and shall receive any interest thereon.
4. Escrow Agreement for security deposits in lieu of retention The Escrow Agreement that shall be used for the deposit of securities in lieu of retention shall substantially conform to the form prescribed in California Public Contract Code Section 22300(e).
Department of Public Works City of San Dimas, California CC2025-03 FTC Installation Project
9 5. Inconsistencies with prevailing statutory requirements If there is any inconsistency between or differences in Public Contract Code Section 22300 and the terms of this provision, or any future amendments thereto, Section 22300 shall control.
B. RELEASE OF RETENTION PROCEEDS:
Retention proceeds withheld by the City, or by the Contractor from any subcontractor shall be governed by California Public Contract Code, Section 7107. Within sixty (60) days after the date of completion of the Work covered by the Contract, the retention withheld from the Contractor shall be released, unless the City decides to continue to withhold such proceeds, as provided for within the Contract. In the event of a dispute between the Contractor and the City involving the Work, the City may withhold an amount from the retention payment that shall not exceed 150 percent (150%) of the estimated value of the disputed amount from final payment to the Contractor. The date of completion of the Work shall mean any of the following:
1. The occupation, beneficial use, and enjoyment of the Work by the City, excluding any operation only for testing, startup, or commissioning, by the City, or its agent, accompanied by cessation of labor on the Work;
2. The acceptance by the City, or its agent, of the Work;
3. After the commencement of the Work, a cessation of labor on the Work for a continuous period of one-hundred (100) days or more, due to factors beyond the control of the Contractor; or
4. After the commencement of the Work, a cessation of labor on the Work for a continuous period of thirty (30) days or more, if the City files and records a "Notice of Cessation" or "Notice of Completion" with the Los Angeles County Recorder’s Office.
The Contractor may withhold from a subcontractor its portion of the retention proceeds if a bona fide dispute exists between the Contractor and the subcontractor. Otherwise, payment must be made within ten (10) days from the time that any retention proceeds are received by the Contractor. The amount withheld from the retention payment shall not exceed 150 percent (150%) of the estimated value of the disputed amount. In the event retention payments are not made within the required time periods, the City or the Contractor withholding the unpaid amounts shall be subject to a charge of two percent (2%) per month on any improperly withheld amounts in lieu of interest otherwise due. In any action for the collection of funds improperly withheld, the prevailing party shall be entitled to attorney’s fees and costs.
SP-8 LIQUIDATED DAMAGES
Liquidated damages will be assessed in accordance with Section 6-9 of the Standard Specifications ($250 per day). Progress payments made by the City after the scheduled completion date does not constitute a waiver of liquidated damages. Failure of the Contractor to complete FTC Device installation by the required date will result in damages due to the City. For each consecutive calendar day the Contractor shall pay to the City a fine of $50.00.
SP-9 DISPUTE RESOLUTION
Section 20104 et seq. of the California Public Contract Code prescribes a process for utilizing informal conferences, nonbinding judicially supervised mediation, and judicial arbitration to resolve disputes on construction claims of $375,000 or less. In the case of a dispute between the Contractor and the City in regards to this Contract, the requirements of Section 20104 et seq. of the California Public Contract Code shall apply.
Department of Public Works City of San Dimas, California CC2025-03 FTC Installation Project
10 SP-10 PROTECTION OF WORK AND MATERIALS
In addition to the requirements of Section 4-2 of the Standard Specifications, the Contractor shall be responsible for the protection of the Work until it has been inspected and accepted by the City Engineer. Any Work damaged or destroyed prior to acceptance of the Work shall be replaced at the Contractor’s expense and to the satisfaction of the City Engineer. This requirement pertains to all sections of the Contract.
The Contractor’s attention is directed to Section 7105 of the Public Contract Code of the State of California prohibiting assignment of responsibility to the Contractor for repairing work damaged by an act of God, in excess of 5% of the contracted amount, provided that the Work damaged is built in accordance with accepted and applicable building standards, and the plans and specifications of the City.
SP-11 SOUND CONTROL REQUIREMENTS
The Contractor shall comply with all local sound control and noise level rules, regulations and ordinances which apply to any work performed by the Contractor. The noise level from the Contractor’s operation, between the hours of 8:00 p.m. to 6:00 a.m., shall not exceed 86 dBA at a distance of 50 feet. This requirement in no way relieves the Contractor from responsibility for complying with local ordinances regulating noise level. Said noise level requirement shall apply to all equipment for the Work or related to the Work, including but not limited to trucks, transit mixers or transient equipment that may or may not be owned by the Contractor. No internal combustion engine shall be operated on the project without a muffler. The use of loud sound signals shall be avoided in favor of light warnings except those required by safety laws for the protection of personnel.
SP-12 TRAFFIC CONTROL
The Contractor shall comply with all the requirements of Section 5-7, 600 and 601 of the Standard Specifications, Subsection 56-2 of the Caltrans Standard Specifications, and the current requirements set forth in the “Manual of Traffic Controls for Construction and Maintenance Work Zones” published by the Department of Transportation, State of California, and to provide all barricades, pedestals and other means necessary to provide the safety of the public and the control of traffic. Flasher units on barricades shall have a twelve (12) volt system. In addition, the Contractor must be prepared to provide additional traffic control measures when necessary for any condition that may arise during the construction period. Failure to provide adequate safety devices, as directed by the City Engineer, will cause the City to install safety devices as needed at the cost of $50 per location per day, and said cost will be assessed to the Contractor.
A. Protection of Work and Public
The Contractor shall take all necessary measures to protect the Work and prevent accidents during any and all phases of the Work. The Contractor shall repair all damage to the Work as a result of vandalism (i.e. vehicle tracks, footprints, writing, spilt asphalt etc.) If deemed necessary by the City, the Contractor shall repair the damaged area in accordance with these special provisions.
Should the Contractor appear to be neglectful or negligent in furnishing warning and protective devices, the City Engineer may direct attention to the existence of a hazard and the necessary warning and protective measures shall be furnished and installed immediately by the Contractor at their expense. Should the City point out the inadequacy of warning and protective measures, such action on the part of the City Engineer shall not relieve the Contractor from responsibility for public safety or abrogate their obligation to furnish and pay for these devices. If the Contractor fails to provide such devices, the City Engineer will place the devices or cause the devices to be placed. The cost of placing such devices shall be the sole responsibility of the Contractor and shall be paid for at the rate of $45/hour for labor and vehicle use, $15/day per barricade and

The traffic control plans shall show:
1. Existing and temporary lane lines;
2. Dimensions of the Work zone and street improvements;
3. Advance warning signs on all streets under construction and all side streets that intersect with these streets; and
4. Delineators.

The traffic control plans shall:
1. State that the traffic control plan conforms to the "California Manual of Uniform Traffic Control Devices (CA MUTCD);
2. Identify the emergency contact person and their phone number.
3. Provide the minimum required lane widths and clearances to obstructions.
The Contractor shall cooperate with the City Engineer in handling traffic through the Work area and the Contractor shall make arrangements to assure the Work area is clear of parked vehicles and maintain clear access to driveways.

CATCH BASIN FULL TRASH CAPTURE INSERT INSTALLATION PROJECT ADDENDUM NO. 1
September 17, 2025
NOTICE IS HEREBY GIVEN that Addendum No. 1 is being issued to clarify, modify, replace or add the following;
I. The City has received questions and provided the responses:
1. Question: Are there any particular reasons that the City is requesting installation of curb inlet filter baskets for this project instead of Connector Pipe Screen (CPS) devices?
Answer: Yes. For ease of access and maintenance, this is the device required by the City.
2. Question: Special Provisions, page 4, first paragraph states that the project is for installation of REM Triton Curb Inlet inserts, and that “Any deviation or substitute device must be an approved California Water Board certified trash full capture system in the most current edition and be approved by the City.”:
a. Does the City prefer curb inlet type filter inserts only for this project? b. Would the City accept installation of Connector Pipe Screen (CPS) devices in lieu of curb inlet filter inserts if CPS devices are a good match for the catch basins to be retrofitted?
c. Should the Bidder wish to propose alternate devices (device type and or device manufacturer), what is the City approval process to be followed? Answer: a. Yes
b. No
c. The Bidder may submit the proposed alternative as part of the submittal process after award. The City will evaluate the proposed alternate device to determine equivalency.
3. Question: Traffic Control—Must the prime contractor or its subcontractor hold a C31 specialty license for conducting the required traffic control procedures to ensure the safety of laborers and the public?
Answer: No.

____________________________________________________________________________
SUMMARY
Construction Contract CC2025-04 was approved at the September 9, 2025 Council Meeting.
Due to the competitive base bid pricing, staff is recommending that Iglesia Street, from Fifth Street to Bonita Avenue, be added to this project, with Vance Corporation honoring the original bid pricing. The additional scope will include asphalt removal and replacement, reestablishing centerline ties, adjusting valves and manholes, and approximately 70,000 square feet of new asphalt pavement.
RECOMMENDATION
City Staff recommends that the City Council:
1. Appropriate and allocate $264,600.00 from Measure M (Fund 76) and allocate monies to the CC2025-04 project.
2. Approve Change Order No. 1 for pavement rehabilitation on Iglesias Street from Bonita Avenue to Fifth Street in the amount of $264,600.00

$1,120,000.00
Proposed Change Order No. 1 Budget
Change Order No.1 $210,500.00
Additional Engineering Services and Inspections $12,000.00 Change Order No.1 Contingency (20%) $42,100.00
$264,600.00
In order to fund Change Order 1 Budget, staff recommends that Council appropriate and allocate $264,600 from Measure M (Fund 76).
The anticipated Construction Project Budget expenditures for CC2025-04 Fifth Street Et Al – Street Improvement Project including Change Order 1 is $1,384,600.00
BACKGROUND
Construction Contract 2025-04 Fifth Street Et Al - Street Improvement Project includes the removal and replacement of asphalt concrete on East Fifth Street, North Belleview Avenue, North Hallock Avenue, East Payson Street, North Smead Way, and Gladstone Street.
Due to the project’s competitive base bid pricing and the close proximity of Iglesia Street, staff recommends including Iglesia Street, from Fifth Street to Bonita Avenue, in this project, with Vance Corporation honoring the original bid pricing. The additional scope of work will include asphalt removal and replacement, re-establishing centerline ties, adjusting valves and manholes, and approximately 70,000 square feet of new asphalt pavement. These roadways exhibit significant wear and degradation, and without reconstruction, will continue to require substantial maintenance. Repairing these streets will reduce future maintenance costs, improve safety, and provide residents with a smoother and more aesthetically pleasing roadway surface.
DISCUSSION/ANALYSIS
Change Order No. 1 proposes the addition of approximately 70,000 square feet of asphalt grinding and paving, which equates to roughly 910 tons of new asphalt material. The additional scope will also include the adjustment of 18 valves, three manholes, and the re-establishment of seven survey monuments.
Due to the close proximity of Iglesia Street to the existing Fifth Street project limits, Vance Corporation has agreed to honor its original base bid pricing to include the reconstruction of Iglesia

Street from Fifth Street to Bonita Avenue under this contract. This roadway has experienced significant wear and degradation over time, resulting in frequent maintenance efforts by City crews to address recurring potholes and surface failures. Incorporating this segment into the current project will provide a long-term solution, reduce ongoing maintenance demands, and improve overall pavement quality and safety in the area.
Iglesia Street fronts Civic Center Park and the San Dimas Senior Center, serving as an important corridor that experiences increased pedestrian activity, notably during community events. The street also forms part of the route for the City’s annual 5K and one-mile run.
ALTERNATIVES
The City Council may choose not to authorize the proposed construction budget for Construction Contract 2025-04 or approved change order 1. The funding allocated for construction could be used to complete other future road repairs or pavement preservation project. Delaying Iglesia Street would result in increased maintenance costs and may require more extensive and costly treatments to complete the future pavement repairs at this location.
ENVIRONMENTAL REVIEW
The proposed project is Categorically Exempt under CEQA guidelines, Title 14, Article 19 Categorical Exemptions, Section 15302. Replacement or Reconstruction Class 2.
Respectfully submitted,
Peter Jacoy

DISCUSSION/ANALYSIS
On May 29, 2025, the City Clerk publicly opened twelve formal bids for Construction Contract 2025-04, Fifth Street Et Al - Street Improvement Project. The preliminary bid results are as follows:
Contractor Base Bid
1 Vance Corporation $696,934.38
2 Onyx Paving Co, Inc. $748,000.00
3 Gentry Brothers, Inc. $784,000.00
4 All American Asphalt $827,227.00
5 Hardy & Harper, Inc. $830,000.00
6 Sequel Contractors, Inc. $832,180.00
7 Dash Construction $858,190.00
8 Vido Samarzich, Inc. $858,210.00
9 Hillcrest Contracting, Inc. $954,725.00
10 We R Builders, Inc. $1,029,395.00
11 Van Engineering $1,255,900.00
- Estate Design and Construction – Non-Responsive $679,900.00 The award will be made to the lowest, responsive bidder based on the Base Bid Items. The Additive Alternative Bid is considered in addition to the Base Bid. The Base Bid includes improvements on East Fifth Street (San Dimas Avenue to Walnut Avenue), Bellevue Avenue, Hallock Avenue, and Gladstone Street (from Monte Vista Street to Amelia Avenue). The Additive Alternative Bid covers Payson Street and Smead Avenue.
The sealed bid submitted by Estate Design and Construction, Inc. was initially considered to be the lowest bid based on the Base Bid Items. However, after the time of bid opening, the City received a bid protest submitted in accordance with the San Dimas Municipal Code from Vance Corporation raising concerns regarding the experience of Estate Design and Construction, Inc., and questioning whether Estate Design and Construction, Inc., met the requirement in the bid documents (by incorporation of the Standard Specifications for Public Works Construction (the “Greenbook”) that the prime contractor self-perform at least 50% of the contract value.
After reviewing the bid protest, and in consultation with the City Attorney’s Office, City staff requested supplemental information from Estate Design and Construction, Inc., in support of its bid to confirm whether Estate Design and Construction’s bid met the requirements of the bid specifications. After reviewing the supplemental information submitted by Estate Design and Construction, City staff determined that Vance Corporation’s protest should be granted and that Estate Design and Construction’s bid should be deemed non-responsive and rejected due to the following deficiencies:
Award of Construction Contract 2025-04 Fifth Et Al - Street Improvement Project Page 4 For the Meeting of September 9, 2025
1. Failure to meet self-performance requirements: The bid did not satisfy the minimum selfperformance threshold required under the Greenbook, Section 3-2 (Self-Performance), as incorporated into Section SP-1 of the Notice Inviting Sealed Bids. Section 3-2 of the Greenbook requires the prime contractor “to perform, with its own organization, Contract work amounting to at least 50 percent of the Contract Price … .” As part of the requests for supplemental information, City staff asked Estate Design and Construction to provide a breakdown of all costs included in its bid between materials and labor and showing which portions of the work would be self-performed and which portions would be subcontracted. In support of the breakdown, Estate Design and Construction was asked to provide estimates from the subcontractors and suppliers identified in its bid. Upon review of this information, City staff determined that Estate Design and Construction would only be self-performing 44.17% of its total bid price.
2. Omission of subcontractor listing: During the course of the City’s discussions with Estate and Design related to the City’s evaluation of the bid protest, City staff learned that Estate Design and Construction would be subcontracting out land surveying services.
Estate Design and Constructions bid did not include the required subcontractor listing for land survey services, and this omission was not corrected within the timeframe permitted under California Public Contract Code (PCC) §§ 4104 and 4107.5, which govern inadvertent clerical errors in subcontractor listings. The deadline to remedy this omission has expired.
3. Incorrect Department of Industrial Relations (DIR) number for subcontractor: The subcontractor’s DIR registration number was incorrectly provided, and the correction procedures outlined in PCC §§ 4104 and 4107.5 were not followed.
4. Inconsistent subcontractor identification: The bid identified one subcontractor that would be performing paving activities. During the course of the City’s review of the supplemental information as part of the bid protest evaluation, the City determined that the subcontractor estimate for paving services was from a different subcontractor than the subcontractor identified in the original bid, which is not considered a correctable clerical error under PCC § 4104.
Following conclusion of the bid protest evaluation, Staff reviewed the bid proposal provided by the next lowest bidder, Vance Corporation, to confirm that it meets the requirements of the bid package and also verified that the contractor’s bid bond is issued by an admitted surety, as required by PCC §§ 20170. It was confirmed through the State Contractor’s License State Board that the contractor’s license 414567, Class A, C-31, is current and active with an expiration date of November 30, 2025. The contractor is registered through the Department of Industrial Relations as required by law (Registration No. 1000008103). Vance Corporation has successfully completed the Construction Contract 2024-02 Lone Hill Avenue Street Improvement Project for the City.
ALTERNATIVES
• The City Council may choose to not adopt the plans and specifications, not reject the bid from Estate Design and Construction, Inc., and not award or authorize the construction budget for Construction Contract 2025-04, Fifth Street Et Al - Street Improvement Project. The funding allocated for the construction could be used to complete other future road repairs or pavement preservation projects. Delaying the 2025-04, Fifth Street
Award of Construction Contract 2025-04 Fifth Et Al - Street Improvement Project Page 5 For the Meeting of September 9, 2025
Et Al - Street Improvement Project would result in increased maintenance costs and may require more extensive and costly treatments to complete the future pavement repairs at this location.
• The City Council may choose to award the construction budget for only the Base Bid of Construction Contract 2025-04, Fifth Street Et Al – Street Improvement Project. This option would exclude the Additive Alternative Bid, thereby omitting rehabilitation work on Payson Street and Smead Avenue. As a result, these streets would continue to deteriorate, leading to higher maintenance costs and costly pavement repairs in the future.
ENVIRONMENTAL REVIEW
Staff evaluated and determined that CC2025-04 Fifth Street Et Al - Street Improvement Project is categorically exempt per CEQA under the “Class 1” (14 CCR §15301) exemption. This is considered maintenance of an existing infrastructure; no modifications to traffic flow and no additional vehicle travel lanes will be created.

Peter Jacoy

Subject: Introduce Ordinance 1331 A City-Initiated Municipal Code Text Amendment to Amend Specified Chapters of Title 15 of the San Dimas Municipal Code (Buildings and Construction) to Adopt By Reference the 2025 Editions of: the California Building Code Volumes 1 & 2, the California Residential Code, the California Plumbing Code, the California Electrical Code, the California Mechanical Code, the California Fire Code, the California Wildland-Urban Interface Code, the California Green Building Standards Code, the 2024 International Property Maintenance Code, Together with Certain Amendments, Additions, Deletions, and Exceptions, Including Fees and Penalties. ____________________________________________________________________________
SUMMARY
The California Health and Safety Code establishes a Building Standards Commission, whose duties include the approval, codification, and publication of building standards in a triennial edition of the California Building Standards Code, commonly called Title 24, and also establishes a date that these codes become effective throughout the State. The effective date for this triennial edition is January 1, 2026.
The adoption of these codes would regulate the fabrication, construction, enlargement, alteration, repair or other improvements to real property; the maintenance of all buildings or structures in the City of San Dimas; and the provision for the issuance of permits and the collection of fees therefor.
RECOMMENDATION
Staff recommends that the City Council:
1. Read by title and introduce Ordinance 1331 (Attachment 1), an amendment of specified Chapters of Title 15 of the San Dimas Municipal Code and adopting by reference the 2025 Edition of the California Building Code Volumes 1 & 2, the 2025 Edition of the California

No
FISCAL IMPACT
The Ordinance, as proposed, adopts a variety of regulatory codes by reference, and updates the San Dimas Municipal Code with the latest California Building & Safety codes, as well as the California Fire Code. As the Ordinance addresses only regulations and policies and not fee schedules, the proposed action entails no fiscal impact. No fees are changed as a result of this Ordinance.
BACKGROUND
The California Health and Safety Code Section mandates that the California Building Standards Commission adopt and publish the California Building Standards Code (Title 24, Parts 1 through 12 of the California Code of Regulations) every three (3) years. The 2025 Edition of the California Building Standards Code was published on July 1, 2025, and becomes effective statewide on January 1, 2026. Local agencies may amend the Codes comprising the California Building Standards Code, provided any amendments of building standards are supported by express findings.
DISCUSSION/ANALYSIS
The California Health and Safety Code and Building Standards Commission allows a municipality to amend the administrative sections of the model codes in conjunction with their regular public hearing adoption process. State law allows a municipality to amend the model codes upon making a finding of unique topographic, climactic or geologic features that necessitate such a change.
The administrative amendments proposed this adoption cycle are nearly identical to the last three (3) code adoptions and seeks to adopt the technical aspects of the California codes, as written, with no proposed technical amendments.
ALTERNATIVES
There are no alternatives proposed for this request.
ENVIRONMENTAL REVIEW
The adoption of these codes can be seen with certainty that there is no possibility that this action may have a significant adverse effect on the environment. Thus, the adoption of this Ordinance

Item 2 (fences) under "Building" is hereby amended to read "Fences not over 6 feet high".
Item 9 (window awnings) under "Building" is hereby deleted in its entirety.
Section RI09 "Inspection" is hereby adopted and amended by adding the following section:
R109.0.1 Workmanship.
It is the intention of the City that all construction carried on under the review of the Building Division is of good quality. The Building Official shall be empowered to enforce the installation of work that is straight, level, plumb, square, etc., as the situation requires. All work shall be well fit and of a durable nature. Paint in all cases shall not be below normal standard for the use applied. The proper grading

of walks, drives, and yards shall be required when being installed with the work requiring a building permit. A minimum thickness of 3 ½ inches for flat concrete work and 2 inches for asphalt paving shall be required. All exterior flat concrete work shall include such breaks for expansion as deemed necessary by the Building Official.
Section R109.1.5 "Other inspections" is hereby amended by adding the following language:
A reinspection fee may be assessed for each inspection or reinspection when such portion of work for which inspection is called is not complete or when corrections called for are not made. This section is not to be interpreted as requiring reinspection fees the first time a job is rejected for failure to comply with the requirements of the technical codes but as controlling the practice of calling for inspections before the job is ready for such inspection or reinspection. To obtain a reinspection, the applicant shall file an application therefore in writing upon a form furnished for that purpose and pay the reinspection fee in accordance with a fee schedule adopted by this jurisdiction. In instances where reinspection fees have been assessed, additional inspection of the work will not be performed until the required fees have been paid.
Appendix AX ("Swimming Pool Safety Act") of the California Residential Code, 2025 Edition, is hereby amended to read as follows:
115922 Construction permit; safety features required.
(a) Except as provided in section 115925, when a building permit is issued for the construction of a new swimming pool or spa or the remodeling of an existing swimming pool or spa at a private single-family home, the respective swimming pool or spa shall be equipped with item 1 below and at least one additional of the following seven drowning prevention safety features:
1. An enclosure that meets the requirements of section 115923 and isolates the swimming pool or spa from the private single-family home.
Any walls of the residential structure or accessory structures used to complete the isolation enclosure must have its door openings equipped with protection as required in item 4 or 5 of section 115922(a). Any such door protection device provided for this purpose may not be used to comply with the second drowning prevention feature requirement.
2. Removable mesh fencing that meets American Society for Testing and Materials (ASTM) Specifications F2286 standards in conjunction with a gate that is self-closing and self-latching and can accommodate a key lockable device.
3. An approved safety pool cover, as defined in subdivision (d) of Section 115921.
4. Exit alarms on the private single-family home's doors that provide direct access to the swimming pool or spa. The exit alarm may cause either an alarm noise or a verbal warning, such as a repeating notification that "the door to the pool is open."
Ordinance 1331 Page 15
Adopt 2025 Building Codes
5. A self-closing, self-latching device with a release mechanism placed no lower than 54 inches (1372 mm) above the floor on the private singlefamily home's doors providing direct access to the swimming pool or spa.
6. An alarm that, when placed in a swimming pool or spa will sound upon detection of accidental or unauthorized entrance into the water. The alarm shall meet and be independently certified to the ASTM Standard F2208 "Standard Safety Specification for Residential Pool Alarms," which includes surface motion, pressure, sonar, laser and infrared type alarms. A swimming protection alarm feature designed for individual use, including an alarm attached to a child that sounds when the child exceeds a certain distance or becomes submerged in water, is not a qualifying drowning prevention safety feature.
7. Other means of protection, if the degree of protection afforded is equal to or greater than that afforded by any of the features set forth above and has been independently verified by an approved testing laboratory as meeting standards for those features established by the ASTM or the American Society of Mechanical Engineers (ASME).
(b) Before issuance of a final approval for the completion of permitted construction or remodeling work, the local building official shall inspect the drowning safety prevention features required by this section and, if no violations are found, shall give final approval.
The above amendments and referenced appendices are necessary due to the unique geology and topography and climate of San Dimas that can produce, significant lateral movement due to earthquakes as well as the climate that can produce high wind loads.

Subject: Introduce Ordinance 1332 a City-Initiated Municipal Code Text Amendment 25- 05, Amending Title 18 Zoning, to Eliminate Chapter 18.188 Explosives from the Code.
____________________________________________________________________________
SUMMARY
For the past several years, Staff has been auditing the San Dimas Municipal Code (SDMC) to identify ways to make the Code more functional, as well as more user-friendly for residents, contractors, and Staff to understand and navigate. Staff identified several Chapters of SDMC Title 18 Zoning, that should be amended, updated, deleted and/or modified. Staff compiled these proposed changes and presented them to City Council, who consequently granted an initiation on April 27, 2021.
This staff report addresses the elimination of Chapter 18.188 Explosives in its entirety.
Chapter 18.188 Explosives addresses the storage and permitting of explosives. However, in the time since Chapter 18.188 was codified in 1961, Federal and State agencies have been responsible for the oversight of handling, storage and use of explosives, which surpassed the processes and procedures outlined in the SDMC. Therefore, the Chapter is no longer pertinent or applicable. Staff recommends eliminating the Chapter from the Code for consistency with governing regulations.
On September 18, 2025, the Planning Commission considered MCTA 25-05 to amend the City of San Dimas Municipal Code, Title 18, to eliminate Chapter 18.188 Explosives. The Commission unanimously voted 5-0 to recommend approval to the City Council.
RECOMMENDATION
Staff and the Planning Commission recommend that the City Council read by title and introduce Ordinance 1332 (Attachment 1), approving MCTA 25-05, amending the Code to eliminate Chapter
18.188 Explosives.

BACKGROUND
For the past several years, Staff has been auditing the SDMC to identify ways to make the Code more functional, as well as more user-friendly for residents, contractors, and Staff to understand and navigate. To this end, Staff identified several Chapters of SDMC Title 18 Zoning, that should be amended, updated, deleted and/or modified. On April 27, 2021, the City Council unanimously initiated several MCTAs, which identified several future changes to Title 18 Zoning (Attachment 3). The MCTA initiation was broken up into three (3) separate MCTA actions. MCTA Action No. 1 consists of amending Title 18 Zoning Chapter 18.20 Residential Zones Generally, Chapter 18.24 S-F Single-Family Residential Zone, and Chapter 18.35 SF-DR Single-Family Downtown Residential Zone. MCTA Action No. 2 consists of amending SDMC Section 17.12 Preliminary and Tentative Maps – Filing Procedures, Chapter 18.12 Development Plan Review Board, Chapter
18.196 Temporary Uses, Chapter 18.200 Conditional Use Permits, Chapter 18.204 Variances, Chapter 18.208 Zone Changes and Amendments, and Chapter 18.212 Appeal Procedures.
MCTA Action No. 3 consists of amending Chapter 18.08 Definitions and Chapter 18.188 Explosives. In addition, the initiation included the amendment of other applicable chapters as required. Since the initial initiation, Staff has processed several MCTA with the intent of the abovementioned actions; however, a number of these actions have been broken up into sub-actions based on their complexity and Council’s direction to no longer combine MCTA items together.
This staff report item discussion addresses the second item of MCTA Initiation Action No. 3, which consists of eliminating Chapter 18.188 Explosives in its entirety. The remaining unaddressed items from the comprehensive initiation will be brought forth for consideration at later dates.
Staff would like to note that this project has an associated case number (MCTA 20-04) that will be closed out as a part of this approval. The previous file was inactive and, therefore, reassigned a current case number (MCTA 25-05) to avoid confusion.
On September 18, 2025, the Planning Commission considered MCTA 25-05 to amend the City of San Dimas Municipal Code, Title 18, to eliminate Chapter 18.188 Explosives. After discussing the proposed amendment, the Commission recommended approval to the City Council with a 5-0 vote (Attachment 2). There were no comments from the public attending the meeting.
DISCUSSION/ANALYSIS
The City of San Dimas was incorporated on August 4, 1960. Prior to the City’s incorporation, explosives were regulated by the Los Angeles County Code. On June 22, 1961, the City established its first Zoning Ordinance (Ordinance No. 37), which provided standards and procedures for explosives within the City’s jurisdiction. Since the original adoption of the Zoning Ordinance in 1961, Chapter 18.188 Explosives has not been updated. However, in the time since Chapter 18.188 was codified, Federal and State laws have been adopted for the handling, storage and use of explosives, which surpass the processes and procedures outlined in the SDMC.
MCTA 25-05 Elimination of Explosives Ordinance Page 3
For the Meeting of October 14, 2025
Chapter 18.188 Explosives addresses the storage and permitting of explosives, however, Federal regulations pertaining to explosives are generally enforced by the U.S. Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF), while the U.S. Department of Transportation (DOT) regulates certain explosives transportation methods. Specifically, ATF regulations prohibit, among other things, certain activities without a license, including manufacturing, selling, distributing, receiving, or transporting explosives. DOT regulations prohibit transporting any unapproved explosives. State explosive laws are enforced by Division of Occupational Safety and Health (Cal/OSHA), although local Fire Marshals may issue certain permits. Cal/OSHA requires both a license and permit before transporting, using, procuring, manufacturing, selling, and storing explosives. Under both Federal and State mandates, licensees and permittees must store explosives in a safe manner, which outline specific container requirements with minimum distances from certain structures. This procedure includes ongoing maintenance of records, including tracking transactions and granting certain government officials inspection protocols.
In conclusion, both Federal and State regulations are more stringent than that provided in City’s Code, rendering SDMC Chapter 18.188 no longer pertinent or applicable. Therefore, Chapter
18.188 Explosives, is recommended to be eliminated for consistency with governing agencies.
ALTERNATIVES
There are no alternatives proposed for this request.
ENVIRONMENTAL REVIEW
Pursuant to CEQA guidelines Section 15061 (b)(3), CEQA does not apply to this item because there is no potential for causing a significant effect on the environment. Therefore, no additional environmental review is needed at this time.

ORDINANCE 1332
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN DIMAS, COUNTY OF LOS ANGELES, CALIFORNIA, APPROVING MUNICIPAL CODE TEXT AMENDMENT 25-05, A CITY-INITIATED MUNICIPAL CODE TEXT AMENDMENT TO AMEND TITLE 18 ZONING, TO ELIMINATE CHAPTER 18.188 EXPLOSIVES FROM THE CODE IN ITS ENTIRETY.
WHEREAS, an Amendment to the San Dimas Municipal Code has been duly initiated by the City Council on April 27, 2021; and
WHEREAS, the Amendment is described as Municipal Code Text Amendment 25-05, a City-initiated Municipal Code Text Amendment to Amend Title 18 Zoning, to eliminate Chapter
18.188 Explosives from the Code in its entirety; and
WHEREAS, the Amendment would affect the area City wide; and WHEREAS, on September 18, 2025 the Planning Commission heard evidence and unanimously voted 5-0 to recommend approval of Municipal Code Text Amendment 25-05, as provided in Resolution PC-1699, to the City Council; and WHEREAS, notice was duly given of the public hearing on the matter and that public hearing was held on October 14, 2025, at the hour of 7:00 p.m., with all testimony received being made a part of the public record; and
WHEREAS, all requirements of the California Environmental Quality Act have been met for the consideration of whether the project will have a significant effect on the environment. It has been determined that this action is not a project under CEQA, as there will be no direct physical or reasonably foreseeable indirect physical change to the environment.
NOW, THEREFORE, in consideration of the evidence received at the hearing, and for the reasons discussed by the members of the City Council at the hearing, the City Council now finds as follows:
A. The proposed Municipal Code Text Amendment will not adversely affect adjoining property as to value, precedent or be detrimental to the area.
The proposed Municipal Code Text Amendment is intended to eliminate outdated processes, reduce procedural ambiguity, and improve consistency with current federal and state legislation regarding explosives. The proposed amendment will not adversely affect jurisdictional property values, establish negative precedents, or result in detrimental impacts to the San Dimas community. Instead, the proposed amendment seeks to promote clarity for residents and City compliance with active laws put into effect and monitored by superseding national and regional governing agencies.
B. The proposed Municipal Code Text Amendment will further the public health, safety and general welfare.
The proposed Municipal Code Text Amendment advances the general welfare of San Dimas residents by following more stringent federal and state regulations regarding the handling, storage and use of explosives. The elimination of Chapter 18.188 intends
Ordinance 1332
Municipal Code Text Amendment 25-05 Page 2
to provide clarity and consistency with active laws that supersede the City’s current code. This ensures that federal and state laws are abided by regarding standards and operational requirements when it comes to explosive material. The proposed amendment aims to further overall protection of the public health, safety and general welfare of the San Dimas community.
C. The proposed Municipal Code Text Amendment is consistent with the General Plan and applicable Zoning.
The proposed Municipal Code Text Amendment will be consistent with the General Plan and applicable Zoning by further enhancing safety precautions and regulatory processes regarding explosives. The proposed amendment complies with the objectives of the General Plan Safety Element by providing for the safe use and transportation of hazardous materials and waste. The elimination of the Chapter reduces confusion and inconsistencies with federal and state mandates.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN DIMAS DOES ORDAIN AS FOLLOWS:
SECTION 1. ADOPTION. Municipal Code Text Amendment 25-05 amending Title 18 of the San Dimas Municipal Code to eliminate Chapter 18.188 Explosives from the Code in its entirety as set forth in Exhibit A, attached hereto and incorporated herein, is hereby adopted.
SECTION 2. SEVERABILITY. If any section, subsection, subdivision, sentence, clause, phrase, or portion of this Ordinance is, for any reason, held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council hereby declares that it would have adopted this Ordinance and each section, subsection, subdivision, sentence, clause, phrase, or portion thereof, irrespective of the fact that any one or more section, subsection, subdivision, sentence, clause, phrase, or portion thereof be declared invalid or unconstitutional.
SECTION 3. CEQA DETERMINATION. The City Council hereby finds and determines that it can be seen with certainty that there is no possibility that this ordinance may have a significant adverse effect on the environment. Thus, the adoption of this ordinance is exempt from the requirements of the California Environmental Quality Act (CEQA) pursuant to Section 1506 (b)(3) of the CEQA Guidelines.
SECTION 4. EFFECTIVE DATE AND PUBLICATION. This Ordinance shall take effect 30 days after its final passage. The City Clerk shall certify to the adoption of this Ordinance and cause the same to be posted at the duly designated posting places within the City and published once within 15 days after passage and adoption as may be required by law in a newspaper of general circulation in the City of San Dimas hereby designated for that purpose; or, in the alternative, the City Clerk may cause to be published a summary of this Ordinance and certified copy of the text of this Ordinance shall be posted in the Office of the City Clerk five days prior to the date of adoption of this Ordinance; and, within 15 days after adoption, the City Clerk shall cause to be published, the aforementioned summary and shall post a certified copy of this Ordinance, together with the vote for and against the same, in the Office of the City Clerk.

However, in the time since Chapter 18.188 was codified, Federal and State laws have been adopted for the handling, storage and use of explosives, which surpass the processes and procedures outlined in the SDMC.
Cal/OSHA requires both a license and permit before transporting, using, procuring, manufacturing, selling, and storing

explosives.

PH 1 Case No’s. Vesting Tentative Tract Map 24-04 (84663), General Plan Amendment 24-04, Development Plan Review 24-13, & Tree Removal Permit 24-04 PROJ-24-48 & PROJ-24- 59 A request to approve a vesting tract map for condominium purposes for the development of 164 units (attached two- and three- story), 17 of which will be affordable units (moderateincome); amend the Housing Element to reallocate 89 units across affordability levels from the subject site to seven (7) other existing housing sites (No’s 4, 5, 7, 9, 10b, 11, 12), reduce the density of the subject site from 45-55 DUA to 16-25 DUA, and create two sites from Site 13 (13a & 13b); Development Plan Review for the architectural and site layout review, and

the associated removal of a total of 116 trees (80 mature and 36 non-mature trees). The project site is located just east of 444 E. Bonita Ave. (APN’s: 839-016-008 & 8390-014-025) Director of Community Development Torrico stated the project presented tonight consists of various applications which will allow construction of 164 townhomes on a site that’s a Housing Element inventory site. This is a large development, the largest the city has had in over ten years.
Given this project is a large multi-family development and that it is being built on a Housing Element site, there are some protections afforded to these developments under the housing crisis act, therefore, Assistant City Attorney Huston is here to answer any questions that may come up regarding the authority of the commission in regards to what recommendations can be made for the project in regards to changes.
Staff report presented by Planning Manager Espinoza recommending Planning Commission adopt Resolution PC-1701, recommending approval of Vesting Tentative Tract Map 24-04 (84663), General Plan Amendment 24-04, Development Plan Review 24-13, & Tree Removal Permit 24-04 to the City Council.
Commissioner Barnes asked if in terms of street parking, will the residents be able to obtain City permits for street parking.
Planning Manager Espinoza stated residents can get a parking permit, but street parking is limited and it will also depend if residents are willing to walk the long distance, the entrance gate alone is three hundred feet from the street.
Commissioner Barnes asked if there is a purpose to the community being gated.
Planning Manager Espinoza stated it’s the applicant’s preference.
Vice-Chairman Davis asked if Site 13b is landlocked.
Planning Manager Espinoza stated yes.
Vice-Chairman Davis asked if there is an easement for access to Site 13b.
Planning Manager Espinoza stated that this was taken into consideration in the design and Site 13b will likely be able to use the proposed entrance of the development.
Vice-Chairman Davis asked if Site 13b would have to make an agreement with the homeowner’s association of Site 13a to use the entrance.
Director of Community Development Torrico stated in the current situation the property is already landlocked which is a discussion they had with Golden State Water, who owns the property. Early in the application process, Staff had conversations with Golden State Water regarding working with the
Planning Commission Minutes Page 3
September 18, 2025
applicant to potentially sell their property to them; however, Golden State Water wants to hold on to the site which is not currently being used.
Planning Manager Espinoza stated Golden State Water came to the City and asked what they could use the land for and Staff doesn’t know how long it will take Golden State Water to decide on what they will do with the property. He added that the original submittal from the applicant was just the site plan (outlined in red) but after further review with staff, the applicant purchased the adjacent lot (highlighted in yellow), which is currently an office complex. This will allow for the project to have a larger driveway and additional park area.
Vice-Chairman Davis asked for details on the retaining walls.
Planning Manager Espinoza stated the retaining walls at the highest point is twelve feet high and is split into two walls.
Vice-Chairman Davis asked what is going on the wall.
Planning Manager Espinoza stated the wall will be decorative and plant material will be added.
The site will be graded and will be lower than the existing uses to the east and north, the re-grading of the site is also to meet the drainage requirements.
Vice-Chairman Davis asked if the retaining wall on the east side, where the homes are, is subtly decreasing.
Planning Manager Espinoza stated yes, you won’t notice the retaining wall if you live on the east side of the retaining walls, the existing residents will only see a six-foot wall from their property.
Vice-Chairman Davis asked if the walls by the three-story homes are taller than the ones by the one and two-story homes at the north/east corner of the project.
Planning Manager Espinoza stated yes, there is a twelve-foot difference so someone may think it’s a two-story building when it’s really a three-story building.
Vice-Chairman Davis asked if the publicly available green space along Bonita Ave. will be managed by HOA.
Planning Manager Espinoza stated yes it will.
Vice-Chairman Davis asked if there is any liability for the City regarding the public spaces and provided an example of a dog attack in the dog park.
Planning Commission Minutes Page 4
September 18, 2025
Assistant City Attorney Huston stated if a dog attacks someone in this dog park the City would not be responsible. He would expect it will be Homeowners Association’s (HOA) responsibility but he can’t speak to specific requirements the HOA would typically have in terms of liability insurance.
Vice-Chairman Davis stated most of the buildings are nice and the variations are good, but then you get to the three-story townhouses and they look plain in comparison. He mentioned there isn’t much to the architecture aside from the windows and stucco.
Planning Manager Espinoza stated the second-story windows do have a shelf that’s not flush which will give architectural details, similar to a pot shelf. On the third floor, the building has canvas awnings on two windows and most others have shutters. Its finished with a decorative Spanish fence. Since this is the first time the Planning Commission under its new duties is reviewing the architecture of the building and site layout it would be appropriate for the Commission to recommend design changes and or add design features to applicant.
Vice-Chairman Davis asked what the setback is on the west side below the amenity park, between the building and Site 13b. He asked if that space is intended to be a walkway to get to the amenity or is it just a landscape setback.
Director of Community Development Torrico stated that access to the amenity park is through the main street because the setback is approximately seven feet and the air conditioning units are within that area. He confirmed this is not a walkway.
Planning Manager Espinoza stated the applicant designed the interior walkway and along the edge of the east side, closest to the complex and away from the ten-foot setback. The first ten feet of the twenty-foot setback is to be fully landscaped.
Vice-Chairman Davis asked if the streets are private HOA streets.
Planning Manager Espinoza stated yes.
Vice-Chairman Davis stated the alternative plan has 269 units and mentioned it’s below the minimum density of 45-55 units per acre. He then asked if it still complies with the current zoning and density.
Director of Community Development Torrico stated yes, it complies. The development application was submitted prior to the adoption of the Downtown Specific Plan under Senate Bill 35 and Senate Bill 330. When an application is submitted through Senate Bill 330, it locks the project into the development standards in place at that time. The site was zoned Public/Semi-Public. The law reads that you have to apply the development standards of an existing zoning that would allow certain developments. In this case, it would be the multi-family ordinance.
Commissioner Shirley asked if the residents can park in their driveway without blocking the sidewalk.
Planning Commission Minutes Page 5
September 18, 2025
Planning Manager Espinoza stated no, they can only park in their garage or other designated parking spaces outside, the driveways are too short to accommodate vehicles.
Commissioner Green asked if the developer were to take the Golden State Water property and build there, is there any way to run streets from sites 13a through 13b. She’s concerned about it being landlocked. She also stated that at one point, the staff report says that trees will be removed from the both sites, and asked if that was meant to say only Site 13a.
Planning Manager Espinoza stated that the tree removal only applies to site 13a and staff will revise the staff report for the City Council meeting.
Commissioner Green stated she only sees five trash areas and she’s concerned it’s not enough.
There is also only one dog station at the publicly accessed open space, she would like to see another one at the community open space. She doesn’t see where the mailboxes are and she would like to make sure they are well lit. She also stated there are only forty-one parking spaces for three hundred people and doesn’t thinks it’s enough.
Planning Manager Espinoza stated the applicant has been in discussions with Staff regarding the trash cans. The application was going to have individual trash bins but pickup day becomes a big issue with this many bin units. The communal bins were an alternative and Waste Management has reviewed the project and felt this would be sufficient. Waste Management also confirmed they will pick up trash multiple times a week if needed.
Commissioner Green asked how many units are there in the Grove complex. She stated she saw six trash units in comparison to this project.
Planning Manager Espinoza stated there are eighty to ninety units and he believes those units were built before the change in the law for public waste requirements. The size of the trash bins may also be larger than the multiple bins being proposed. Also, during plan check, Staff will coordinate with the postmaster for the ideal location of the mailboxes.
Director of Community Development Torrico clarified there are eight trash enclosures in the development.
Chairman Bratt asked what the width of the streets are and if the Fire Department has approved this.
Planning Manager Espinoza stated the streets are thirty feet wide that include a three-foot-wide wedge curb.
Chairman Bratt stated he doesn’t see a turnaround and asked if this is a Fire Department requirement for the south end of the main street.
Planning Commission Minutes Page 6
September 18, 2025
Planning Manager Espinoza stated the turnaround is at the end of the alley.
Chairman Bratt asked if the forty-one guest parking stalls are all located in the southeast area.
Planning Manager Espinoza stated there is parking located throughout the development and pointed out the different locations on the plan.
Chairman Bratt asked if the street parking reduces the width of the street.
Planning Manager Espinoza stated the thirty feet does not includes the street parking.
Chairman Bratt asked if there will be sidewalks in the development.
Planning Manager Espinoza stated yes, and pointed out the locations of the sidewalks on the plan.
Chairman Bratt asked what the setback is on the east side of the single-family units.
Planning Manager Espinoza stated the setback is twenty feet to the two-story homes.
Chairman Bratt asked if there will be landscaping and trees on the east side and what type of trees.
Planning Manager Espinoza stated yes, there will be landscaping and trees, and they will verify the types of trees proposed. He explained that the replacement trees will be canopy trees, and the applicant will be proposing an additional eighty trees for a total of three hundred sixty-five. The plan includes thirty-five cypress trees and seventeen palm trees, which are not considered shade trees.
Chairman Bratt asked if this is the first development being built on a Housing Element site. We aren’t changing the number of units proposed to meet the Housing Element requirements, we are just reallocating the number of units to other Housing Element Sites.
Planning Manager Espinoza stated they are proposing to reallocate the units to different sites to stay within the density levels within each specific site. By doing this, the City is still in compliance and not making significant changes to the Housing Element. The California State Department of Housing and Community Development (HCD) agreed that this modification will comply with the approved Housing Element and will be considered a minor amendment.
Chairman Bratt opened the public hearing.
Speaker 1 - Applicant Matt Waken gave his presentation.
Speaker 2 - Cal Poly Pomona Student asked if there will there be a pedestrian or vehicle gate on the south side of the complex.
Planning Commission Minutes Page 7
September 18, 2025
Director of Community Development Torrico stated no, that gate on the south side is only for emergency vehicle access.
Speaker 3 - Resident on Gaffney Avenue asked if they are trying to get rid of the forestry building.
She stated that behind the property there are railroad tracks and she is concerned with the entrance plan from Gaffney Avenue to Bonita Avenue.
Vice-Chairman Davis stated yes, the forestry site sold a portion of their property which was vacant, the project site will be built on the portion that is vacant. The access gate to E. Hera Street from the project will only be used by emergency vehicles when needed and as an emergency exit point if the main gate is not accessible due to an emergency event. The access with the gate will only be used by emergency vehicles.
Speaker 4 - Resident on Bonita Avenue stated that they have a trash issue with the residents from the apartment complex and he wants to make sure there are enough trash bins in the new complex to ensure this won’t become a future problem. He also asked if the emergency entrance is for police, fire and ambulance.
Planning Manager Espinoza stated the emergency access point strictly for the Fire Department and in the case of a fire, it can be used as a secondary exit for residents to evacuate.
Speaker 4 asked if all the homes on Bonita Avenue will be two-story.
Vice-Chairman Davis stated they are proposed to be two-story and transition into three-story.
Planning Manager Espinoza stated that on the Gaffney Avenue side, there is a twenty-foot setback and there will be no windows on the third-story of the proposed buildings Speaker 5 - Cal Poly Pomona Student asked why there weren’t more walkable entrances.
Planning Manager Espinoza stated that there are no sidewalks on Gaffney Avenue, so there is not a walkable space to connect to. If the streets were public it would be more of a consideration to put walkable paths but because the streets are private they want to limit entrances.
Chairman Bratt closed the public hearing.
Vice-Chairman Davis stated his issue is the articulation of the second floor, but otherwise he is happy with the project and the design.
Commissioner Green stated the colors of the buildings look very similar, the whites all look the same. She agrees the driveways look plain and states that varying the colors of the garage door could make it look better.
Planning Commission Minutes Page 8
September 18, 2025
Speaker 6 - Applicant’s Architect, Alan Scales stated there are six different color schemes giving the development a village concept authentic to Spanish style. The variations will be picked up in person and you can see the depth and character. If you look at the garages you can see the awnings that create shadow and add color. The windows are all different configurations so they are scaled to the room they are in. You also see recesses which is authentic to the Spanish architecture.
Vice-Chairman Davis stated the three windows above the garage look the same and I can’t tell if there are any other architectural elements on that wall.
Speaker 6 stated the walls do look different in person and there will be recesses that follow the shape of the window. There are six color schemes used interchangeably, while they are subtle, there will be variation on-site. It’s difficult to see the difference in the printed renderings.
Commissioner Barnes asked how they plan to keep the planters on the second stories maintained.
Speaker 6 stated it’s up to the homeowner, and the Homeowners Association will be the one to enforce their standards. Even with just the pot shelf, it will give the building additional dimension.
Commissioner Barnes stated he attended the community meeting and reviewed the concept plans.
He expressed concern that the front gate hinders walkability and the human element. He noted this will be the only place in the community with a gate and stated he is not a fan of the message it sends.
Vice-Chairman Davis stated that the Avalon apartments are a gated community.
Speaker 1 stated from a safety perspective they felt it is appropriate to put a gate, however, they are not married to that concept and they are open to discussing options with the Planning Commission.
Vice-Chairman Davis stated the gates add value to the community.
Speaker 3 stated that since she’s lived on Gaffney Avenue the apartments have left no privacy in her backyard. She thinks the new development should only be two-story.
Vice-Chairman Davis stated all the buildings are two-story near Gaffney and the third-story doesn’t have windows to look that direction. He stated he is fine with the design as proposed.
Commissioner Barnes stated he’s happy with the project overall, and he’s hopeful families can afford the price point. His personal preference is no gate, and prefers this development to be part of the San Dimas community as opposed to being an internal community within the gates.
Commissioner Green stated she likes the gates but doesn’t like that the residents have to punch in and out.
Planning Commission Minutes Page 9
September 18, 2025
Commissioner Barnes asked if they can compromise and leave the gates open during certain hours.
Commissioner Shirley stated he doesn’t have an issue with the gate.
Chairman Bratt stated he can go either way, gate or no gate.
Planning Manager Espinoza reiterated that Commissioner Green mentioned additional dog stations, and additional trashcans with lighting which can be added as conditions. If Planning Commission approves this item tonight, it will be moving forward to City Council in October.

SUMMARY
The Applicant, Mathew Waken representing San Dimas Bonita LLC, is requesting approval to construct 164 condominiums within 32 building clusters consisting of two- and three-stories located at 444 E. Bonita Ave. zoned Downtown Specific Plan, Gateway Village East with a Housing Element Site Overlay. All the units will be market rate with the exception of 17 of the proposed units, which will be sold as affordable units to moderate-income households. In order to accommodate the 17.8 units per acre proposed density, an amendment to the Housing Element is required. The subject site currently is designated to accommodate 45-55 units to the acre. As part of the amendment to the Housing Element some of the affordable units of Site #13 will need to be redistributed among seven (7) other existing housing sites (No’s 4, 5, 7, 9, 10b, 11, 12). As only a portion of Site #13 is proposed for development, the site will be split into two sites 13a and 13b; Site #13a will be developed with the reduced density of 16-25 units to the acre and Site #13b will remain at 45-55 units to the acre. The Applicant has also submitted a Tree Removal Permit to removal a total of 116 trees from the site; 80 mature and 36 nonmature trees.

For the Meeting of October 14, 2025
The subject site is one of the City’s Housing Sites (Site #13) included in the City’s 6th Cycle Housing Element. Site #13 is comprised of two parcels with a total lot size of 12.5 acres. One parcel is owned by Golden State Water Company (GSWC) with a lot size of 3.31 acres. The second parcel was part of a larger property owned by the USDA Forest Service with a lot size of
9.19 acres. The Site has been rezoned to Downtown Specific Plan (DTSP) – Gateway Village East to accommodate the residential density identified in the Housing Element. In addition, since adoption of the Housing Element, the USDA Forest Service sold the portion of their property, portion of Site #13, to the Applicant. Furthermore, during the application review process, the Applicant was able to secure the adjacent site fronting on Bonita Avenue (464 E. Bonita Avenue), which was incorporated into the development site (Figure 1).
Figure 1- Vicinity Map, Subject Site Outlined in Red
The subject site will be accessed off the south side of E. Bonita Avenue with the majority of the site being behind other existing developments on Bonita Avenue. The subject site is surrounded by a variety of existing uses. To the north there are several commercial buildings, including a daycare center. To the east there are single-family detached residences, which are zoned SingleFamily 7,500 zone. These homes are accessed off of S. Gaffney Avenue. The Metro A Line and Pacific Railroad travel along the south property line and to the west is the Golden State Water Company lot and the remaining portion of the USDA Foresty site (Figure 1). The subject site is predominantly undeveloped except for a small parking lot that was previously used by the forestry service.
On July 8, 2025, the Applicant held an informational community meeting at the San Dimas Senior Center to inform the surrounding community of the proposed project. The Applicant conducted a

500-foot notification radius from the subject site. The Applicant provided an overview of the proposed project followed by individual group Q&A sessions, with each group discussing the different aspects of the project. The Applicant had their architect, landscape architect, and civil engineer on hand to help answer the public’s questions. Approximately 20-30 community members attended the meeting. Many of the community members expressed their satisfaction in learning that the project was going to be a for sale project and not a for-rent project. No concerns from the public were brought to Staff’s attention at the meeting or since the community meeting.
On September 18, 2025, the Planning Commission held a public hearing to consider the proposed development (Attachment 8). During the public hearing, two (2) people, from the same household, expressed concerns regarding noise, trash and circulation relating to the proposed project. In addition, the meeting was attended by students from Cal Poly Pomona, two (2) of which spoke in support of the project. Staff also received a letter of opposition (Attachment 9) to the project, which was provided to the Commission the day of the public hearing. After hearing Staff’s and the Applicant’s presentations, and public comments, the Commission voted 5-0 to recommend approval of the proposed development to the City Council. As part of the Commission’s recommendation, two (2) additional conditions were added to the project; (1) add two (2) additional dog bag/waste stations in the community common open space and (2) that a trash receptacle and lighting be installed next to the community mailboxes. The Commission’s requests have been incorporated in the conditions of approval as conditions No’s. 33 and 34 (Attachment 1).
Since the submittal of the project applications, the Development Plan Review Board (DPRB) has been eliminated. The DPRB was the body that was responsible for the review of the projects architectural, site layout, landscape and hardscape. This review has now been reassigned to the Planning Commission; this is the first project under this new process.
It’s important to note that the Applicant has also submitted an alternative development project application for this site under Senate Bill 35 (SB 35) and Senate Bill 330 (SB 330) Streamlined Ministerial Approval Process, which does not require discretionary review by the Planning Commission or City Council. Per State law, this alternate development project would only be subject to a building permit as long as it complies with the existing zoning and development standards, which it does. This alternative project consists of 129 townhome units and 140 apartment units for a total unit count of 269 units, with a density of 30 units per acre. This alternate development includes 3-story townhomes with a total height of 36 feet, and a 5-story building with a total height of 60 feet for the 140 apartment units. However, at this time, the Applicant would prefer to move forward the 164-condominium project discussed in this staff report. Should their current request not be approved, the Applicant would move forward with the alternative project of 269 units which would be a combination of for-sale and rental units.
DISCUSSION/ANALYSIS
As previously mentioned, the proposed development will provide 164 townhome units, 17 of which will be affordable to Moderate income households. Various applications, discussed further in this report, are required to be approved in order for the development to move forward. In addition, an Affordable Housing Agreement, entered into by the City and the Applicant, will be required to be approved to restrict the affordable units.

For the Meeting of October 14, 2025
The 164-unit condominium project will be accessed off the south side of E. Bonita Avenue via a two-way private driveway that will lead to a six-foot high wrought iron main entry gate for the proposed development and will also provide access to the USDA Forest Service site, which is adjacent to the proposed development (Figure 2). An access gate providing access to the USDA Forest Site will be installed under a separate permit and is not part of this request. The vehicular access gate for the proposed development has been designed to allow for residents and visitor traffic flow with a turn-around for exiting, the gate will also have a pedestrian access gate. The gate is set back on the property over 300 feet, which will allow for plenty of queueing of vehicles (Figures 2 & 3). The Applicant has already obtained approval from the Los Angeles County Fire Department for the proposed site access and will be required to install several private fire hydrants within the project site. Other than curb, gutter and sidewalk no other public improvements will be required. Residents will be able to make a left or right hand turn on to Bonita Avenue when leaving the site. On the southeast end of the project will be a fenced off, emergency only exist to E. Hera Street. Vehicles and pedestrians will not be able to access this gate other than for emergency purposes, as mentioned.

Beyond the entry gate, access to the units will be provided via a 30-foot-wide primary private road that will run the entire length of the development. Each of the unit’s garages will be accessed via 30-foot-wide alleys accessed from the primary road (Figure 4). On average there are 10 to 12 units off each alley way, double loaded. Each unit will have a two-car garage, and there are 41 visitor parking spaces located throughout the site along the primary road.
