Planning Commission Minutes Page 7
August 20, 2026
Planning Manager Espinoza stated the City does allow second story ADU’s. The City wouldn’t be able to prohibit them even if there was a district disallowing second-story structures. He also stated the City can only require four-foot setbacks. The City can create all these standards but people can develop projects under State laws that the City cannot do anything about.

Director of Community Development Torrico stated there was a consideration in adopting design guidelines like setbacks. The City was able to address certain design items through the Development Plan Review Board (DPRB) and, although the City no longer has DPRB, they still have a process for design review. However, without having something in the code, it makes it more difficult to impose such standards. Staff has been looking at implementing some of these into the code development standards.

Director of Community Development Torrico stated Staff was looking for different ways to create incentives to provide parking for ADU’s but the state recently made changes to the law so there are different categories. The state allows ADU’s up to two stories but if it is a detached ADU on a singlefamily property, the max height they can build is sixteen feet which limits them to a one story.

Agenda Item Staff Report
To: Honorable Mayor and Members of City Council
For the Meeting of September 8, 2026
From: Brad McKinney, City Manager
Prepared by: Debra Black, City Clerk
Subject: Appointment of City Commissioners
____________________________________________________________________________

SUMMARY
The terms of several City Commissioners representing Districts 1 and 3 are scheduled to expire in October 2026, concluding the Zero Term established as part of the appointment structure approved in 2024. In accordance with the City’s Boards, Commissions and Committees appointment process, staff contacted the affected Commissioners to determine their interest in continuing to serve. Additionally, Staff received a notice of resignation. This report identifies Commissioners who have expressed interest in reappointment, identifies vacancies, and requests Council action regarding reappointments and direction on filling vacancies.

RECOMMENDATION
City Staff recommends that the City Council:
• Decide whether to reappoint the following Commissioners, for the next applicable twoyear term beginning after the expiration of their current terms in October 2026: Janice Bartolo, Maya Yassine, John Davis, James Shirley, Robert Olander II, Orlando Pimentel, William Beebe and Margarita McGee.
• Provide direction to the City Clerk regarding the three vacancies: Equestrian Commission, District 1 and Parks and Recreation Commission, District 1 and Senior Citizens Commission, District 4.

For the Meeting of September 8, 2026

FISCAL IMPACT
Planning Commissioners receive a $50.00 stipend for each meeting attended. Any fiscal impact associated with the reappointment of Planning Commissioners is limited to these existing meeting stipends and is included within the City’s adopted budget.

BACKGROUND
With the exception of the Planning Commission, candidates are appointed to a term of two years and can serve a maximum of two terms or as otherwise specified under Section III of Boards Commission and Committees Handbook. After serving two consecutive terms, Commission, Committee, or Board members must wait one year before being eligible to reapply for service on the same commission, committee, or board. Service of one year or longer of an unexpired term, is considered a term and therefore, a member serving is eligible to serve one additional term.

Planning Commissioners are appointed to two-year terms; however, there are no limits to the number of terms that members may serve.

The City Clerk shall notify the City Council of expiring terms of office for any member presently serving on a Commission, Board or Committee. Upon receipt and review, the City Council may reappoint an eligible member; fill the vacancy from an existing list of active applications; or direct the City Clerk to advertise the vacancy.

DISCUSSION/ANALYSIS
Appointments for seats 1, and 3 are set to expire in October 2026 concluding the Zero Term implemented in 2024 with approval of the new appointment structure. The Zero Term was established when the new appointment structure was implemented in 2024 to provide a transition period for Commissioners who were serving at that time. The Zero Term allowed those Commissioners to continue serving during the transition without that period counting toward the term limits established under the new appointment structure. In addition, a Senior Citizens Commissioner informed staff of their resignation on September 3, 2026.

Staff reached out to the Commissioners whose terms are expiring to confirm their interest in reappointment. Nine Commissioners identified below have confirmed their interest in continuing to serve. Two Commissioners have declined reappointment creating anticipated vacancies on the Equestrian Commission and on the Parks and Recreation Commission for District 1.

Reappointments approved with this item would be for the next applicable two-year term following expiration of the current terms in October 2026. Council may direct the City Clerk to fill the anticipated vacancies from the City’s active application list, if qualified applicants are available, or to advertise the vacancies and return with applications for consideration. Youth Commissioners ages 16-21 are appointed at the beginning of each school year for a one-year term and are eligible for reappointment as long as they are enrolled in a local high school, college or university.
