E. LEAGUE OF CALIFORNIA CITIES ANNUAL CONFERENCE RESOLUTIONS PACKET
On April 5, 2022, the City Council appointed Mayor Tony Ding as the Delegate and Council Member John Wu as the Alternate to serve as the City’s voting delegate for the League of California Cities. Each year, the League of California Cities accepts resolutions from member cities and elected officials to be voted on at its annual conference. This year, the League of California Cities (Cal Cities) Board of Directors voted to present proposed bylaws amendments to the General Assembly during the 2022 Cal Cities Annual Conference and Expo. At least two-thirds of the General Assembly must vote in favor of the proposed bylaws amendments for them to take effect. There is no fiscal impact for this item.
City Council Regular Meeting Agenda – August 16, 2022 4 Recommended Action:
Staff recommends that the City Council approve the voting delegate and voting alternate to use their discretion to vote on potential petitioned resolutions and the League’s proposed bylaws amendments.
F. ADOPTION OF RESOLUTION NOS. 22-47 AND 22-48 SETTING THE RATE AND AMOUNT NECESSARY FOR THE 2022-23 FISCAL YEAR RETIREMENT LEVY
The City’s retirement costs are funded by a special property tax levy authorized by the voters in 1948. The special property tax levy approved by the voters requires the City Council to annually establish a tax rate sufficient to meet the City’s obligations to the state employees’ retirement system. No Change in the tax rate is recommended for the 2022-23 Fiscal Year and the City Council is asked to confirm the current rate and fix the amount of property taxes to be generated by adopting two resolutions. Based on the assessed valuation ($6,489,280,378) – an increase of 6.1% over (Fiscal Year 2021-22 value) prepared by the Auditor Controller and the recommended continued levy of 14 cents per $100 of assess property value, the amount to be generated is estimated at $9,084,993 for Fiscal Year 2022-23. This levy, along with the current fund balance in the Retirement Fund, will be sufficient to cover the retirement costs, budgeted at $9,366,652 for Fiscal Year 2022-23.
Recommended Action:
Staff recommends that the City Council adopt Resolution No. 22-47, setting the tax rate at 14 cents per $100 assessed valuation, and Resolution No. 22-48, fixing the amount of property taxes to be generated for the City’s employees’ retirement cost for Fiscal Year 2022-23.
G. PURCHASE AND INSTALLATION OF UPDATED PARKING PERMIT PAY STATIONS IN THE AMOUNT OF $46,502.62 FROM PACIFIC PARKING
SYSTEMS
The City is currently utilizing two parking permit pay stations purchased from Pacific Parking Systems, Incorporated (formerly Pacific Parking Installations) in 2004. The outdated pay stations are not capable of accepting credit card payments or giving adequate change, creating a significant inconvenience to residents and visitors seeking to purchase parking permits. Pacific Parking Systems is a well-established vendor and offers the lowest price compared to VenTek International and Northwest Parking Equipment Company. The City Council Regular Meeting Agenda – August 16, 2022 5 purchase of new overnight parking permit pay stations is currently budgeted in Police Department’s Special Project Fund #124-751-15-261 and the fiscal impact for Fiscal Year 22-23 is $46,502.62.
Recommended Action:
Staff recommends the City of San Gabriel purchase three venSTATION C2-GC pay stations from Pacific Parking Systems, Incorporated with installation and associated annual fees.
H. PURCHASE OF TWO ELECTRIC JOHN DEERE GATOR TE UTILITY VEHICLES IN THE AMOUNT OF $29,341.67 FOR THE PARKS DIVISION
The Parks Division within the Public Works Department is responsible for the operation and maintenance of the City’s parks and park facilities. The City has six park locations with open areas for residential recreation. These park areas have designated picnic shelters with restroom facilities as well as designated sports courts and fields. The Parks Division, with the help of Facilities staff, maintains the daily operations of our parks, including restroom maintenance, trash pickup and on-going landscape maintenance. Currently, the Parks Division has three Gator utility vehicles, but two will be sent to auction due to their age, condition, and on-going upkeep costs. Staff is seeking approval to purchase two new John Deere Gator TE 4x2 electric utility vehicles from Deere & Company through a Sourcewell Awarded Contract. The total cost for both utility vehicles is $29,341.67.
Recommended Action:
Staff recommends that the City Council waive formal bidding and authorize the Cooperative Purchase Agreement for two John Deere Gator TE 4x2 electric utility vehicles, consistent with the piggyback bidding requirements pursuant to Municipal Code Section 34.35, and authorize the City Manager to approve a Purchase Order with Deere and Company in an amount not to exceed $29,341.67 from the Air Quality Management District budget account #124- 800-51-99-922.
I. A MEMORANDUM OF AGREEMENT WITH THE SAN GABRIEL VALLEY
COUNCIL OF GOVERNMENTS FOR PARTICIPATION IN THE SAN GABRIEL
VALLEY REGIONAL FOOD RECOVERY PROGRAM
The passage of Senate Bill 1383 (Lara, 2016) (SB 1383) implemented statewide targets to reduce statewide disposal of organic waste and increase recovery of City Council Regular Meeting Agenda – August 16, 2022 6 currently disposed edible food for human consumption. Specifically, SB 1383 aims to recover at least 20% of currently disposed edible food for human consumption by 2025. To recover 20% of edible food that would otherwise be sent to landfills by 2025, SB 1383 requires local jurisdictions to establish food recovery programs and strengthen their existing food recovery networks.
Approval of a Memorandum of Agreement with the San Gabriel Valley Council of Governments to Participate in a Regional Food Recovery Program will allow a regional approach toward compliance with SB 1383’s food recovery components by enhancing the capacity of local food recovery organizations to recover edible food waste and provide outreach and education activities. There will be no fiscal impact on the General Fund.
Recommended Action:
Staff recommends that the City Council authorize the City Manager to execute a Memorandum of Agreement between the City of San Gabriel and the San Gabriel Valley Council of Governments.
J. VALLEY BOULEVARD AND DEL MAR AVENUE INTERSECTION
IMPROVEMENTS PROJECT
The City of San Gabriel is proposing improvements to the intersection of Valley Boulevard and Del Mar Avenue as part of the State Route 710 (SR-710) North Mobility Improvement Projects (MIP). Improvements to the intersection would include lane reconfiguration, intersection corner improvements, lengthening of turn lanes on Valley Boulevard, vegetation and on-street parking removal, the addition of continental crosswalks, and the synchronization of traffic signals along Valley Boulevard. Environmental impacts have been evaluated and a draft Mitigated Negative Declaration has been prepared for this project for Council’s consideration. There are no fiscal impacts to the general fund associated with the recommended action.
Recommended Action:
Staff recommends that the City Council adopt a Mitigated Negative Declaration and Mitigation Monitoring and Reporting Program.

2. Decide that the street closure event is not in the best interests of the City and deny the Applicant’s request to hold the event.
B. FUND BALANCE RESERVE POLICY AMENDMENT
A key component of a well-managed organization is a written policy that stipulates prudent fund balance reserve levels. The fund balance reserve policy supports proactive financial management and is a strategic tool to fund certain and uncertain future expenditures. INTRODUCTION
In the wake of several high-profile incidents, recent policing reform efforts have resulted in changes in legislation that directly impact policing in the City of San Gabriel. As a result of emerging concerns related to the use of military-style equipment by local law enforcement, and the requisite oversight and accountability, Assembly Bill 481 was passed. It mandates certain requirements for the acquisition, use, and funding of military-style equipment. On July 19, 2022 Council provided temporary approval governing the continued use of equipment already in possession and use by the Police Department until the matter could be brought back to be adopted or ordinance. Such Ordinance is now before the Council for consideration.
Recommended Action:
Staff recommends that the City Council read by title only, waive further reading, and introduce Ordinance No. 684 entitled, “An Ordinance of the City Council of San Gabriel, California, adopting Police Department Lexipol Policy, Section 707, Military Equipment, pursuant to Assembly Bill (AB) 481 Military Equipment Acquisition, Use, and Reporting” and schedule the second reading and adoption for the next City Council meeting.
