G. PURCHASE OF A CATERPILLAR MINI EXCAVATOR FOR THE WASTEWATER

OPERATIONS DIVISION
The Wastewater Operations Division has been utilizing rented mini excavators from multiple suppliers to complete several small stormwater infiltration projects. I. ORDINANCE NO. 685 DELETING TITLE III, CHAPTER 32, SECTION 32.70

FROM THE SAN GABRIEL MUNICIPAL CODE TO REMOVE THE MISSION

PLAYHOUSE DEPARTMENT
The Mission Playhouse Department has been consolidated into the Community Services Department for budgeting and administrative purposes. This item begins the process of amending the City’s Municipal Code to formalize this change. There is no fiscal impact as Mission Playhouse budgeting has been consolidated in the Community Services Department as of the Fiscal Year 2021- 2022 Adopted Budget.

Recommended Action:

Staff recommends that the City Council waive full reading, introduce by title only, and waive future reading of Ordinance No. 685, “An Ordinance of the City Council of San Gabriel, California, Deleting Title III, Chapter 32, Section 32.70 of the San Gabriel Municipal Code to Remove the Mission Playhouse Department,” and schedule the second reading and adoption of the Ordinance for the next regular City Council meeting.

The first phase of the project included painting the entire exterior of the building, with the exception of the decorative details. Phase II includes the decorative details, such as the façade crest and City Council Regular Meeting Agenda – September 20, 2022 6 moldings, the portico, lighting sconces and display cases. Donations of $2,166.46 and a grant of $3,500 were previously collected for this Phase II Façade Restoration Project.

7. NEW BUSINESS
A. DONATION OF ASSEMBLY BILL 481 MILITARY EQUIPMENT RESCUE

VEHICLE
The County of Los Angeles, Bureau of Investigations of the District Attorney’s Office recently notified Staff that their armored rescue vehicle was being relinquished for donation to a local Police Department. Staff is seeking approval to accept the donation due to the Police Department’s dire need of a rescue vehicle to conduct life-saving measures during critical incidents. By accepting the donation and transfer of the Ford armored rescue vehicle from the County of Los Angeles, the City will experience significant cost savings of approximately $400,000 since the vehicle is in excellent condition and does not require additional funding for immediate operational use. Assembly Bill 481 requires approval from City Council for all military equipment purchases and donations to comply with Government Code 7071.

Recommended Action:

City Council Regular Meeting Agenda – September 20, 2022 7 Staff recommends City Council approve and provide the City Manager the authority to accept the donation of a 2008 Ford armored rescue vehicle from the County of Los Angeles, Bureau of Investigations from the District Attorney’s Office.

B. DISCUSSION REGARDING THE INTERNAL PROSECUTION MISDEMEANOR

AND OTHER QUALITY-OF-LIFE CRIMES
On April 19, 2022, the City Council received a presentation and report from staff regarding alternatives for prosecuting local misdemeanor crimes. At the conclusion of that item, the City Council directed staff to return at a future meeting with further information and analysis regarding options for prosecution of quality-of-life crimes that negatively impact the community. Based upon further discussion with the District Attorney’s office and other cities that have been working through the local prosecution of misdemeanors, it appears as though creating local infractions in our municipal code is a more appropriate approach given the circumstances.

Recommended Action:

Staff recommends City Council discuss the staff report and options for the local prosecution of misdemeanors and other quality-of-life crimes and provide direction to staff on how to proceed with this item.
