5. PUBLIC HEARING
A. ORDINANCE NO. 693 AMENDMENT TO UPDATE THE SAN GABRIEL
MUNICIPAL CODE, VALLEY BOULEVARD SPECIFIC PLAN, AND MISSION
DISTRICT SPECIFIC PLAN RELATING TO OBJECTIVE DESIGN STANDARDS FOR MULTI-FAMILY AND MIXED-USE PROJECTS (ZTA23-002) –
INTRODUCTION AND FIRST READING
In recent years, the State of California has been in an ongoing housing supply crisis. As a result, numerous laws have been passed by the State to help alleviate the housing shortage. At the March 2, 2023 joint City Council and Planning Commission study session, Staff presented an informational staff report summarizing the new bills and legislation as well as draft language for the Objective Design Standards. The City Council directed Planning staff to work with the City Architect and the Design Review Commission to finalize the Objective Design Standards and prepare an ordinance. A draft ordinance was provided to the Design Review Commission and the Planning Commission for further consideration and recommendation on May 22, 2023 and August 14, 2023, respectively. Following further discussions, the Planning Commission recommended approval to the City Council of the proposed zone text amendment (ZTA23-002) for Ordinance No. 693. Impact fees will be charged for new development in accordance with City requirements, but because this project does not directly result in specific development, the financial impacts to the City, if any, are unknown at this time.
City Council Regular Meeting Agenda – November 7, 2023 11 California Environmental Quality Act (CEQA) Determination: The proposed amendment would be exempt from the California Environmental Quality Act under Section 15061(b)(3) of the CEQA guidelines, under the common sense exemption, because it can be seen with certainty that it would not have significant effect on the environment and, thus, is not subject to CEQA review.
Recommended Action:
Staff recommends that the City Council:
1. Conduct the public hearing and discuss proposed Ordinance No. 693.
2. Waive full reading and introduce Ordinance No. 693 by title only;
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
GABRIEL, CALIFORNIA, AMENDING CHAPTER 153 (ZONING CODE),
THE VALLEY BOULEVARD NEIGHBORHOODS SUSTAINABILITY PLAN,
AND THE MISSION DISTRICT SPECIFIC PLAN TO INCORPORATE
OBJECTIVE DESIGN STANDARDS FOR MULTI-FAMILY AND MIXEDUSE DEVELOPMENTS.
3. Waive further reading and schedule the second reading and adoption of Ordinance No. 693 for the next regular City Council meeting. The ordinance would then become effective 30 days after adoption.
Alternative Option for Consideration:
Provide comments and direct staff to return at a later date with revisions to the amendment for the City Council’s review and approval.
B. ORDINANCE NO. 695 AMENDING CHAPTER 153 OF THE SAN GABRIEL MUNICIPAL CODE RELATING TO MIXED-USE STANDARDS IN THE C-1 AND C-3 ZONE DISTRICTS (ZTA23-003) – INTRODUCTION AND FIRST
READING
The proposed Zone Text Amendment would amend Chapter 153 of the San Gabriel Municipal Code relating to Mixed-Use Standards in the C-1 and C-3 Zone Districts. The proposed Zone Text Amendment is intended to implement the goals and programs identified in the 2021-2029 Housing Element. The Fiscal Year 2022-23 Adopted Budget includes the cost for required legal publication (Account No. 121-702-00-65-000) and codification (Account No. 121-702-00-22-000) of the ordinance.
California Environmental Quality Act (CEQA) Determination: The proposed amendments were reviewed for compliance with CEQA. An Initial City Council Regular Meeting Agenda – November 7, 2023 12 Study/Negative Declaration was prepared to the 2021-2029 Housing Element, as required by the California Environmental Quality Act, Public Resources Code Section 21000 et seq., the CEQA guidelines, and the City of San Gabriel Local Guidelines for Implementing CEQA. The Initial Study/Negative Declaration considered the policies and programs outlined in the Housing Element. The Housing Element establishes objectives, policies, and programs to assist the City in achieving state-mandated housing goals. No formal land use changes or physical development are proposed at this time and future land use and physical development would require separate environmental evaluation.
Recommended Action:
Staff recommends that the City Council:
1. Conduct the public hearing and discuss proposed Ordinance No. 695;
2. Waive full reading and introduce Ordinance No. 695 by title only:
AN ORDINANCE OF THE CITY COUNCIL OF SAN GABRIEL,
CALIFORNIA, AMENDING CHAPTER 153 (ZONING CODE) OF THE SAN
GABRIEL MUNICIPAL CODE RELATING TO MIXED-USE STANDARDS IN THE C-1 AND C-3 ZONES.
3. Waive future reading of the Ordinance and schedule the second reading and adoption of the Ordinance for the next Regular City Council meeting.
The Ordinance would then become effective 30 days after adoption.
C. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN GABRIEL EXTENDING EXISTING DEVELOPMENT AGREEMENT FOR PROJECT NO.
PL-15-149, A PLANNED DEVELOPMENT AND DEVELOPMENT
AGREEMENT, AND VESTING TENTATIVE PARCEL MAP NO. 74993 FOR THE SYMPHONY AT SAN GABRIEL ASSISTED LIVING PROJECT AT 806- 824 SOUTH GLADYS AVENUE VIA ADOPTION OF FIRST AMENDMENT TO THE DEVELOPMENT AGREEMENT – INTRODUCTION AND FIRST READING On September 8, 2023, the representatives of the development project for 806-824 S. Gladys Avenue submitted a request to extend the Planned Development and Development Agreement and Vesting Tentative Parcel Map No. 74993 for the Elegance Senior Assisted Living Project (Planning Case No.
PL-15-149) from January 4, 2023 to January 4, 2024. Pursuant to Section 5.02 of the Development Agreement, City Council has the authority to approve an amendment extending the term of the Development Agreement. There is no negative fiscal impact as it relates to this request for extension. Should the extension not be approved, this project would most likely not move forward reducing the potential property tax revenue for the City.
City Council Regular Meeting Agenda – November 7, 2023 13 California Environmental Quality Act (CEQA) Determination: The Mitigated Negative Declaration adopted in conjunction with the Project remains valid and in effect and continues to be the proper and legal environmental document for the Project.
Recommended Action:
Staff recommends that the City Council:
1. Conduct the public hearing and discuss proposed Ordinance No. 698;
2. Motion to waive full reading and introduce Ordinance No. 698 by title only;
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN GABRIEL EXTENDING EXISTING DEVELOPMENT AGREEMENT FOR PROJECT NO.
PL-15-149, A PLANNED DEVELOPMENT AND DEVELOPMENT
AGREEMENT, AND VESTING TENTATIVE PARCEL MAP NO. 74993 FOR THE SYMPHONY AT SAN GABRIEL ASSISTED LIVING PROJECT AT 806- 824 SOUTH GLADYS AVENUE VIA ADOPTION OF FIRST AMENDMENT
TO THE DEVELOPMENT AGREEMENT
3. Motion to waive future reading of the Ordinance and schedule the second reading and adoption of the Ordinance for the next regular City Council meeting. The ordinance would then become effective 30 days after adoption.
6. CONTINUED BUSINESS
A. DISCUSSION AND POTENTIAL COUNCIL DIRECTION REGARDING THE
STREET NAME CHANGE GUIDELINES
On May 3, 2022, the City Council directed staff to draft guidelines for street name changes. To help facilitate the drafting of such guidelines, the City Council directed staff to solicitate feedback and comments from the HEAR Commission, Planning Commission, and the Historic Preservation and Cultural Resources Commission. At the February 7, 2023 City Council meeting, the City Council directed staff to seek direction from the Historic Preservation and Cultural Resources Commission regarding the definition of a legacy business and the number of years to be deemed eligible. At the September 13, 2023 Historic Preservation and Cultural Resources Commission meeting, the Commission provided feedback and comments regarding the definition for a legacy business. The application fee will be $768 plus the plan check fee for Public Works which is based on staff’s fully burden rate plus outside costs.
City Council Regular Meeting Agenda – November 7, 2023 14 California Environmental Quality Act (CEQA) Determination: Not a Project as defined in Section 15378(b)(5) of the State CEQA Guidelines as adoption of a policy is not organizational or administrative activity which will result in direct, or indirect physical change to the environment.
Recommended Action:
Staff recommends that the City Council discuss the matter and provide direction to staff regarding the new policy or guidelines.
In addition, the Council may also elect to amend the application procedures to require an application to go before the HEAR Commission and the Historic Preservation and Cultural Resources Commission before proceeding to the City Council for final consideration.
