City Council Regular Meeting Agenda – December 5, 2023 4 E. ORDINANCE NO. 693: AMENDING CHAPTER 153 OF THE SAN GABRIEL

MUNICIPAL CODE, VALLEY BOULEVARD SPECIFIC PLAN, AND MISSION

DISTRICT SPECIFIC PLAN RELATING TO OBJECTIVE DESIGN STANDARDS FOR MULTI-FAMILY AND MIXED-USE PROJECTS (ZTA23-002) – SECOND

READING AND ADOPTION
Adoption of Ordinance No. 693 would amend Title XV, Chapter 153 (Zoning Code) of the San Gabriel Municipal Code, Valley Boulevard Specific Plan, and Mission District Specific Plan relating to objective Design Standards for MultiFamily and Mixed-Use Projects. The Fiscal Year 2023-24 Adopted Budget includes the cost for required legal publication (Account No. 121-702-00-65- 000) and codification (Account No. 121-702-00-22-000) of the ordinance.

California Environmental Quality Act (CEQA) Determination: The proposed amendment would be exempt from the California Environmental Quality Act under section 15061(b)(3) of the CEQA guidelines, under the commonsense exemption, because it can be seen with certainty that it would not have a significant effect on the environment and, thus, is not subject to CEQA review.

Recommended Action:

Staff recommends that the City Council waive reading and adopt Ordinance No. 693 entitled, “An Ordinance of the City Council of the City of San Gabriel, California, Approving Planning Case No. ZTA23-002, Amending Title XV, Chapter 153 (Zoning), Valley Boulevard Specific Plan, and Mission District Specific Plan relating to Objective Design Standards for Multi-Family and Mixed-Use Projects.”
F. ORDINANCE NO. 695: AMENDING CHAPTER 153 OF THE SAN GABRIEL MUNICIPAL CODE TO ADDRESS MIXED-USE STANDARDS IN THE C-1 AND C-3 ZONE DISTRICTS (ZTA 23-003) – SECOND READING AND ADOPTION Adoption of Ordinance No. 695 would amend Title XV, Chapter 153 (Zoning Code) of the San Gabriel Municipal Code (SGMC) relating to Mixed-Use Standards in the C-1 and C-3 Zone Districts
California Environmental Quality Act (CEQA) Determination: The proposed amendments were reviewed for compliance with the California Environmental Quality Act. An Initial Study/Negative Declaration was prepared for the 2021- 2029 Housing Element, as required by the California Environmental Quality Act, Public Resources Code Section 21000 et seq., the CEQA Guidelines, and the City of San Gabriel Local Guidelines for Implementing CEQA. The Initial City Council Regular Meeting Agenda – December 5, 2023 5 Study/Negative Declaration considered the policies and programs outlined in the Housing Element. The Housing element establishes objectives, policies, and programs to assist the City in achieving state-mandated housing goals. No formal land use changes or physical development are proposed at this time and future land use and physical development would require separate environmental evaluation.

Recommended Action:

Staff recommends that the City Council waive reading and adopt Ordinance No. 695 entitled, “An Ordinance of the City Council of the City of San Gabriel, California, Approving Planning Case No. ZTA23-003, Amending Title XV, Chapter 153 (Zoning) relating to mixed-use standards in the C-1 and C-3 Zone Districts.”
G. ORDINANCE NO. 698 EXTENDING EXISTING DEVELOPMENT AGREEMENT FOR PROJECT NO. PL-15-149, A PLANNED DEVELOPMENT AND
DEVELOPMENT AGREEMENT, AND VESTING TENTATIVE PARCEL MAP NO. 74993 FOR THE ELEGANCE AT SAN GABRIEL ASSISTED LIVING PROJECT AT 806-824 SOUTH GLADYS AVENUE VIA ADOPTION OF FIRST
AMENDMENT TO THE DEVELOPMENT AGREEMENT – SECOND READING

AND ADOPTION
Adoption of Ordinance No. 698 would extend the term of the Development Agreement, Planned Development and Vesting Tentative Parcel Map for the Elegance Project at 806-824 South Gladys Ave. There is no negative fiscal impact as it relates to this request for extension. Should the extension not be approved, this project would most likely not move forward reducing the potential property tax revenue for the City.

California Environmental Quality Act (CEQA) Determination: The Mitigated Negative Declaration adopted in conjunction with the Project remains valid and in effect and continues to be the proper and legal environmental document for the Project.

Recommended Action:

Staff recommends that the City Council waive the second reading and adopt by title Ordinance No. 698 entitled, “An Ordinance of the City Council of the City of San Gabriel, California, Extending Existing Development Agreement for Project No. PL-15-149, a Planned Development and Development Agreement, and Vesting Tentative Parcel Map No. 74993 for the Elegance Assisted Living City Council Regular Meeting Agenda – December 5, 2023 6 Project at 806-824 South Gladys Avenue via Adoption of First Amendment to the Development Agreement.”
H. APPROVAL OF FINAL PARCEL MAP NO. 82763, A 2-UNIT CONDOMINIUM DEVELOPMENT PROJECT LOCATED AT 313 WEST NORWOOD PLACE
The development project located at 313 West Norwood Place is a 2-unit condominium on a 10,018 square-foot-lot. Staff and RKA Consulting Group Inc., the City’s contract consultant for land surveying, have reviewed the Final Parcel Map and determined that it is in compliance with the State Subdivision Map Act, Conditions of Approval, and the City’s ordinances regarding subdivision.

There is no fiscal impact related to this item.

California Environmental Quality Act (CEQA) Determination: The project has been reviewed for compliance with the California Environmental Quality Act (CEQA) and is exempt from CEQA based on Section 15332, Class 32 exemption (In-Fill-Development).

Recommended Action:

Staff recommends that the City Council approve Final Parcel Map No. 82763, authorize its filing with the Los Angeles County Recorder and authorize the City Manager to execute the Subdivision Agreement on behalf of the City.
