City Council Regular Meeting Agenda – April 16, 2024 3
Staff recommends that the City Council approve Material Demands as presented.

C. RESOLUTION NO. 24-14 ADDING THE POSITION OF ASSISTANT TO THE

CITY MANAGER TO THE AUTHORIZED POSITION CLASSIFICATION AND

SALARY SCHEDULE AND RECLASSIFYING THE POSITION OF

MANAGEMENT ANALYST-PUBLIC INFORMATION OFFICER TO ASSISTANT

TO THE CITY MANAGER IN ADMINISTRATION
In January 2024, the Management Analyst-Public Information Officer (PIO) position within Administration was vacated. Since that time, staff has assessed the operational needs to the department and determined that the Management Analyst-PIO position should be reclassified to Assistant to the City Manager to cover a greater range of administrative duties and functions. If approved by Council, a classification specification and salary range for Assistant to the City Manager will be added to the City’s Authorized Position Classification and Salary Schedule, and the Management Analyst-PIO position in Administration will be reclassified to Assistant to the City Manager. The annualized cost impact for reclassifying the Management Analyst-PIO position to Assistant to the City Manager in Administration is $37,076.

California Environmental Quality Act (CEQA) Determination: Not a Project as defined in Section 15378 of the State CEQA Guidelines.

Recommended Action:

Staff recommends that the City Council adopt Resolution No. 24-14, which approves the classification specification and base salary range for Assistant to the City Manager, adds the Assistant to the City Manager position classification and base salary range to the Authorized Position Classification and Salary Schedule, and reclassifies the Management Analyst-PIO to Assistant to the City Manager in Administration.

D. AUTHORIZE ACCEPTANCE OF SELECTIVE TRAFFIC ENFORCEMENT PROGRAM (STEP) GRANT IN THE AMOUNT OF $140,000 [RESOLUTION NO. 24-17]
The Police Department has received a renewed grant from the Office of Traffic Safety (OTS) to participate in the Selective Traffic Enforcement Program (STEP) for Federal Fiscal Year 2023-2024. The grant will reimburse the City for overtime costs incurred while participating in this campaign, and for the purchase of related equipment for training up to $140,000.

City Council Regular Meeting Agenda – April 16, 2024 4
California Environmental Quality Act (CEQA) Determination: Not a Project as defined in Section 15378 of the State CEQA Guidelines.

Recommended Action:

Staff recommends that the City Council adopt Resolution No. 24-17 approving and accepting the requirements of the Office of Traffic Safety Grant Agreement outlined in the report.

E. POLICE DEPARTMENT PURCHASE OF THREE FRONTLINE VEHICLES IN THE AMOUNT OF $181,859.46 AND ONE UNMARKED DETECTIVE BUREAU VEHICLE IN THE AMOUNT OF $59,168.08 [RESOLUTION NO. 24-19] Three 2017-2018 Ford Explorer Interceptors frontline patrol vehicles are past their useful life as they all have over 100,000 miles and are exhibiting significant mechanical issues. An unmarked police unit is also requested for use in the Detective Bureau. The frontline police units have been budgeted for replacement in Fiscal Year 2023-2024. The unmarked police unit has been budgeted for replacement in Fiscal Year 2023-2024 utilizing Air Quality Management District (AQMD) funding. This police unit qualifies as a “Clean Air Vehicle” since Staff opted to purchase the hybrid variant of the 2025 Ford Explorer Interceptor.

California Environmental Quality Act (CEQA) Determination: Not a Project as defined in Section 15378 of the State CEQA Guidelines.

Recommended Action:

Staff recommends that the City Council authorize the Police Chief to purchase the vehicles as listed in the quotations for an amount not to exceed $241,027.54 and to adopt Resolution No. 24-19, increasing appropriations in the Special Projects Fund (Fleet Maintenance) by $984.93 and Air Quality Management District by $9,168.08.

F. THEATRE FEE REDUCTION REQUEST BY SAN GABRIEL MISSION HIGH SCHOOL
San Gabriel Mission High School has requested a partial waiver of theatre rental fees for their upcoming graduation ceremony, scheduled for Thursday, May 30, 2024. The request is for a $3,043 fee reduction, to reduce their total rental cost to $5,000. The current rental subsidy account has sufficient funds to cover $1,100 in rental fee reduction.

City Council Regular Meeting Agenda – April 16, 2024 5
California Environmental Quality Act (CEQA) Determination: Not a Project as defined in Section 15378 of the State CEQA Guidelines.

Recommended Action:

Staff recommends that the City Council approve staff’s recommendation to grant a partial waiver of the San Gabriel Mission Playhouse rental fee in the amount of $1,100 for the May 30th event day.

G. COLLECTION AGREEMENT WITH PROFESSIONAL CREDIT TO PERFORM

ACCOUNTS RECEIVABLE COLLECTION SERVICES FOR DELINQUENT

CUSTOMER ACCOUNTS
From time to time, the City needs collection services to help collect money owed to the City. Previously, the City had an agreement with Account Recovery Services to provide collection services for delinquent receivable accounts.

Account Recovery Services underwent a change in ownership, and all active collection accounts were transferred to FCR Collection Services, operating under the name FedChex. With the unexpected change, staff took the opportunity to perform an assessment of the collection service providers to determine if the City was receiving the best overall value available. The proposed agreement with Professional Credit includes an 18% collection fee.

This fee would only apply to the delinquent accounts that the City requested collection services for and is contingent upon the collection of a portion or the entire outstanding amount. The City is not charged a fee when funds are not collected.

California Environmental Quality Act (CEQA) Determination: Not a Project as defined in Section 15378 of the State CEQA Guidelines.

Recommended Action:

Staff recommends that the City Council authorize the City Manager to enter into a Professional Services Agreement with Professional Credit to perform accounts receivable collection services for delinquent customer accounts.

5. PUBLIC HEARING
A. ORDINANCE NO. 706 AMENDMENT TO UPDATE THE SAN GABRIEL

MUNICIPAL CODE RELATING TO NEW STATE LAW FOR ACCESSORY
DWELLING UNITS AND JUNIOR ACCESSORY DWELLING UNITS (ZTA24- 001) – INTRODUCTION AND FIRST READING
City Council Regular Meeting Agenda – April 16, 2024 6
The California Legislature adopted Senate Bill 897 (“SB 897”) and Assembly Bill 2221 (“AB 2221”) in 2022, amending existing State law pertaining to Accessory Dwelling Units (ADU) and Junior Accessory Dwelling Units (JADU). The new bills took effect on January 1, 2023. An ADU ordinance that is not in full compliance with the amended State Law became invalid at the time the laws took effect.

California Environmental Quality Act (CEQA) Determination: The proposed amendments were reviewed for compliance with the California Environmental Quality Act (CEQA). Pursuant to Section 15061(b)(3) of the CEQA Guidelines, the amendment to a Zoning Ordinance is not considered a project as defined in Section 15378 and can be seen with certainty that it will not have a significant effect on the environment. The proposed amendment to the Zoning Ordinance qualifies for this CEQA exemption as there is no possibility that the ordinance will have a significant effect on the environment as it amends the City’s Municipal Code to demonstrate compliance with State ADU Law.

Recommended Action:

Staff recommends that the City Council:

1. Conduct the public hearing and discuss the proposed Ordinance No. 706.

2. Waive full reading and introduce Ordinance No. 706 by title only:

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN GABRIEL, CALIFORNIA, AMENDING CHAPTER 153 (ZONING CODE) OF THE SAN

GABRIEL MUNICIPAL CODE RELATING TO ACCESSORY DWELLING
UNITS AND JUNIOR ACCESSORY DWELLING UNITS.

3. Waive future reading of the Ordinance and schedule the second reading and adoption of the Ordinance for the next regular City Council meeting. The Ordinance would then become effective 30 days after the adoption.

Alternative Option for Consideration:

Provide comments and direct staff to return at a later date with revisions to the amendment for the City Council’s review and approval.

6. CONTINUED BUSINESS – None.

7. NEW BUSINESS
City Council Regular Meeting Agenda – April 16, 2024 7
A. CONSIDERATION OF ADOPTION OF ORDINANCE NO. 707 DELETING TITLE III, CHAPTER 33, SECTIONS 33.50-3.57 FROM THE SAN GABRIEL

MUNICIPAL CODE TO DISSOLVE THE HUMAN EQUITY, ACCESS AND

RELATIONS (HEAR) COMMISSION AND POTENTIAL APPOINTMENT OF

TWO COUNCILMEMBERS TO A HUMAN RELATIONS SUBCOMMITTEE
The Human Equity, Access, and Relations (HEAR) Commission was established by the City Council on October 20, 2020 through Ordinance No. 670. Since then, the HEAR Commission has hosted monthly meetings to accomplish the goals set forth in their annual workplans to advance the purpose and mission of the Commission. At the March 5, 2024 City Council meeting, Council requested that the dissolution of the HEAR Commission be placed on the agenda of a future meeting for consideration. Adopting Ordinance No. 707 would result in the dissolution of the Commission. Also under consideration is the creation of a new subcommittee comprised of two Council Members to provide guidance to the full City Council on any future human relations issues in San Gabriel. There is no fiscal impact associated with discussing the dissolution of the HEAR Commission. Should the City Council adopt the attached ordinance, there will be a small budget savings for the expenses that were approved to support the HEAR Commission, as well as a reduction in the staff time involved in supporting a commission.

California Environmental Quality Act (CEQA) Determination: Not a Project as defined in Section 15378 of the State CEQA Guidelines.

Recommended Action:

Staff recommends that the City Council determine the preferred course of action pertaining to the future of the HEAR Commission. Possible actions are as follows and are not mutually-exclusive; for example, the City Council could choose to do items one and two below.

1. Waive full reading, introduce by title only, and waive future reading of Ordinance No. 707 Deleting Title III, Chapter 33, Sections 33.50-3.57 from the San Gabriel Municipal Code to dissolve the HEAR Commission; and waive future reading and schedule the second reading and adoption of the Ordinance for the next regular City Council meeting.

2. Appoint two members of the City Council to an ad hoc subcommittee and provide specific direction on a human relations issue to explore and provide recommendations to the entire City Council.

City Council Regular Meeting Agenda – April 16, 2024 8

3. Appoint two members of the City Council to a standing Brown Act subcommittee to explore human relations issues in San Gabriel. Issues could be assigned at any time in the future to the subcommittee as needed.

4. Provide new direction to the HEAR Commission that aligns with the needs of the City as well as the purpose and scope of the HEAR Commission, including but not limited to amendments to the 2024 annual workplan, purpose, and scope of the Commission.

5. Do nothing, thereby maintaining full operation of the HEAR Commission in its existing capacity.

6. Other options that the City Council determines appropriate after discussing the item.

8. PUBLIC COMMENT
