E. RESOLUTION NO. 24-24 ADOPTING RETIREE MEDICAL VESTING UNDER SECTION 22904 OF THE PUBLIC EMPLOYES’ MEDICAL AND HOSPITAL
CARE ACT
In November 2022, the City and its five distinct employee bargaining groups mutually agreed upon successor labor agreements. An important part of these agreements was the restructuring of the City’s retiree medical benefit provided by Section 22893 of the Public Employees’ Medical and Hospital Care Act (PEMHCA). Resolution No. 24-24 adopts Section 22904 of the Public Employees’ Medical and Hospital Care Act and establishes a multi-tiered retiree medical benefit system for the City of San Gabriel for employees starting service on January 1, 2023 and after. Resolution No. 24-24 and Section 22904 of PEMHCA are expected to markedly reduce the City’s $44.1 million Other Post Employment Benefits Liability over the next 10-15 years as the number of retiree medical beneficiaries subject to Section 22904 (Tier 3) increases.
California Environmental Quality Act (CEQA) Determination: Not a Project as defined in Section 15378 of the State CEQA Guidelines.
Recommended Action:
Staff recommends that the City Council adopt Resolution No. 24-24, which approves the implementation of Section 22904 of Public Employees’ Medical and Hospital Care Act and establishes a third tier of retiree medical benefits for employees first hired on a full-time basis on or after January 1, 2023, and elected officials who first served as elected officials on or after January 1, 2023.

F. ORDINANCE NO. 706: AMENDING CHAPTER 153 OF THE SAN GABRIEL
MUNICIPAL CODE TO UPDATE THE SAN GABRIEL MUNICIPAL CODE
RELATING TO NEW STATE LAW FOR ACCESSORY DWELLING UNITS AND JUNIOR ACCESSORY DWELLING UNITS (ZTA24-001) – SECOND READING
AND ADOPTION
Adoption of Ordinance No. 706 would amend Title XV, Chapter 153 (Zoning Code) of the San Gabriel Municipal Code (SGMC) relating to new state law for new accessory dwelling units and junior accessory dwelling units (ZTA24-001).
Ordinance No. 706 was approved at introduction by a 5-0 vote at the City Council at the April 16, 2024, City Council meeting. The Fiscal Year 2023-24 Adopted Budget includes the cost for required legal publication and codification of the Ordinance.
California Environmental Quality Act (CEQA) Determination: The proposed amendments were reviewed for compliance with the California Environmental Quality Act (CEQA). Pursuant to Section 15061(b)(3) of the CEQA Guidelines, the amendment to a Zoning Ordinance is not considered a project as defined in Section 15378 and can be seen with certainty that it will not have a significant effect on the environment. The proposed amendment to the Zoning Ordinance qualifies for this CEQA exemption as there is no possibility that the ordinance will have a significant effect on the environment as it amends the City’s Municipal Code to demonstrate compliance with State Accessory Dwelling Units Law.
Recommended Action:
Staff recommends that the City Council waive reading and adopt Ordinance No. 706 entitled, “An Ordinance of the City Council of the City of San Gabriel, California, Approving Planning Case No. ZTA24-001, Amending Title XV, Chapter 153 (Zoning) Relating to New State Law for Accessory Dwelling Units and Junior Accessory Dwelling Units.”

Due to the scope and cost of the project, the County policy requires a Cooperative Agreement be executed for the joint-agency repaving project. The City’s share is estimated to be $2,052,929.64 and the County’s share is estimated to be $557,015. The County will pay a deposit of $590,000 to the City, covering the City Council Regular Meeting Agenda – May 7, 2024 6
anticipated estimated project cost share of $557,015. Upon the completion of the project, the City will invoice the County for their actual share costs of the project.
California Environmental Quality Act (CEQA) Determination: This project is determined to be Categorical Exempt per CEQA Section 15301 – Existing Facilities. The project will improve the existing condition of local streets. No potential for significant impacts to the environment are anticipated in this project.

WITH AUDIENCEVIEW
Since 2016, the City of San Gabriel has used Ticketmaster LLC for ticketing services for the Mission Playhouse. The initial User Agreement had a set term of three years and expired in December of 2019.

Staff has reviewed options for new ticketing software and recommends the approval of a contract with AudienceView. The proposed agreement is for five years and will be up for renewal in April of 2029.

K. PURCHASE OF NEW POLICE MOTORCYCLE - $39,316.78
Public Works Fleet staff have determined that the 2015 Honda police motorcycle is long overdue for replacement as a viable patrol motorcycle and will likely soon need major repairs. The proposed replacement for the 2015 Honda ST 1300 is the 2024 Harley Davidson FLTRXP which is more reliable, has lower maintenance costs, and has been a tested and proven a more reliable police motorcycle than the older Honda which has been phased out of service at many agencies. Honda has discontinued its production of police motorcycles. This information was confirmed by the 48th Annual Law Enforcement Motorcycle Test and Evaluation program conducted in 2022. The Harley Davidson model received the overall rating of “Above Average” for the evaluation, and no major manufacturer changes have been implemented in 2024.
California Environmental Quality Act (CEQA) Determination: Not a Project as defined in Section 15378 of the State CEQA Guidelines.
Recommended Action:
Staff recommends that the City Council approve the purchase of one 2024 Harley Davidson from Laidlaw Harley Davidson utilizing Office of Traffic Safety Selective Traffic Enforcement Program Grant #24174 funds from account #124- 751-52-99-201.

The consumer price index (CPI) for the Los Angeles Metro area, for January 2024, increased by 2.5%. Based on the Fiscal Year 2024-25 forecasted revenues, a 2.5% to general fund fees is estimated to generate approximately an additional $160,000 in general fund revenue.
