E. FISCAL YEAR 2023-2024 YEAR-END APPROPRIATION ADJUSTMENTS [RESOLUTION NO. 24-63]
As the City’s Fiscal Year 2023-2024 financial books are being closed, it becomes necessary to make budget adjustments prior to the forthcoming audit. These adjustments are necessary to allocate additional funds to general fund departments or other funds that have surpassed their initially allocated or City Council Regular Meeting Agenda – October 15, 2024 4 amended budgets. This report seeks the approval of the City Council for these budget adjustments, which may involve transferring appropriations between general fund departments or appropriating funds to a fund that has exceeded its budget appropriations. General fund departments and funds that exceed approved budgets are disclosed in the audited financial statements.

Additionally, this report provides detailed explanations for each of the proposed adjustments. Budgeted funds will be adjusted to bring all general fund departments and City funds within approved budgets.

California Environmental Quality Act (CEQA) Determination: Not a Project as defined in Section 15378 of the State CEQA Guidelines.

Staff recommends that the City Council adopt Resolution No. 24-63 approving proposed amendments to the annual budget for fiscal year 2023-2024.

F. RESOLUTION NO. 24-53 AMENDING RESOLUTION NO. 14-39, ARTICLE 8.,

DISPATCHER TRAINING BONUS
As the San Gabriel Police Department continues to grow in size and embrace new technology to better serve the community, training new employees is a vital step in their development and, more importantly, in the mission of the organization. To fulfill the training needs of new employees and to have tenured Department employees conduct the training, it is equitable that all Department employees who train to be fairly compensated for this additional responsibility, which is not part of their current job classification or daily responsibilities. The fiscal impact on the San Gabriel Police Department general fund is limited, as the training pay is only applied to full-time employees who are actively training a probationary coworker. The bonus is capped at 5% of the employee’s base salary. Training periods regularly last between four and six months. The cost associated with this amendment is estimated to be $3,600 for the remainder of the fiscal year. Funds are available in the Department budget to absorb this additional cost.

California Environmental Quality Act (CEQA) Determination: Not a Project as defined in Section 15378 of the State CEQA Guidelines.

Recommended Action:

Staff recommends that the City Council adopt Resolution No. 24-53, amending Resolution No. 14-39, Article 8, to include the job classifications of Dispatcher, City Council Regular Meeting Agenda – October 15, 2024 5 Property and Evidence Technician and Records Specialist to change the title for Article 8.

G. PURCHASE OF AIR RESPIRATORS FROM MALLORY SAFETY AND SUPPLY UNDER 2022 STATE HOMELAND SECURITY GRANT PROGRAM IN THE AMOUNT OF $51,390.06
The San Gabriel Police Department was awarded a grant from the 2022 State Homeland Security Program (SHSP) in the amount of $51,363 dedicated to the procurement of Unmanned Aircraft Systems (UAS). Due to an urgent need and priority to replace the current aging air respirators, staff is seeking to utilize this funding towards the purchase of sixty-five air respirators to enhance the safety of our Police Officers. The initial outlay of $51,363 for the air respirators will be fully funded by the 2022 SHSP grant award. The remaining balance of $27.06 will come out of the Department’s budget. The deadline to use these funds is February 2025 and will be reimbursed within 120 days of the submission of a reimbursement request.

California Environmental Quality Act (CEQA) Determination: Not a Project as defined in Section 15378 of the State CEQA Guidelines.

Recommended Action:

Staff recommends that the City Council authorize the City Manager to purchase 65 air respirators equipment using the allocated State Homeland Security Program grant funding.

H. ORDINANCE NO. 710: AMENDING THE VALLEY BOULEVARD SPECIFIC

PLAN RELATING TO GROUND FLOOR OFFICE USE AND ESTABLISHING MINIMUM DENSITIES (SPA24-001) – SECOND READING AND ADOPTION Ordinance No. 710 was introduced by a 5-0 vote of the City Council at the October 1, 2024, City Council meeting. Adoption of Ordinance No. 710 would amend the Valley Boulevard Specific Plan relating to ground floor office use and establish minimum densities intended to implement the goals and programs identified in the 2021-2029 Housing Element. The Fiscal Year 2024- 2025 adopted budget includes the cost for required legal publication (Account No. 121-702-00-65-000) and codification (Account No. 121-702-00-22-000) of the ordinance.

California Environmental Quality Act (CEQA) Determination: The proposed amendments were reviewed for compliance with the California Environmental Quality Act (CEQA). An Initial Study / Negative Declaration (IS/ND) was prepared City Council Regular Meeting Agenda – October 15, 2024 6 for the 2021-2029 Housing Element, as required by CEQA, Public Resources Code (PRC) Section 21000 et seq., the CEQA Guidelines, and the City of San Gabriel Local Guidelines for Implementing CEQA. The IS/ND considered the policies and programs outlined in the Housing Element. The Housing Element establishes the objectives, policies, and programs to assist the City in achieving state-mandated housing goals. No formal land use changes or physical development would require separate environmental evaluation.

Recommended Action:

Staff recommends that the City Council waive reading and adopt Ordinance No. 710 entitled, “An Ordinance of the City Council of the City of San Gabriel, California, Approving Planning Case No. SPA24-001, Amending the Valley Boulevard Specific Plan Relating to ground floor office use and establish minimum densities intended to implement the goals and programs identified in the 2021-2029 Housing Element.”

There is no fiscal impact to the budget for this event. Regularly scheduled staff time will be used for this event.

California Environmental Quality Act (CEQA) Determination: Not a Project as defined in Section 15378 of the State CEQA Guidelines.

Recommended Action:

Staff recommends that the City Council adopt Resolution No. 24-55 authorizing a temporary street closure on the 800 block of Commercial Avenue from South Gladys Avenue to the end of the cul-de-sac from 12:00 p.m. to 5:00 p.m. on Saturday, October 26, 2024.

5. PUBLIC HEARING
A. 405 SOUTH DEL MAR AVENUE
PLANNING CASE NO: GPA24-001, ZC24-002, DENSITY BONUS AND

STREET VACATION (GENERAL PLAN AMENDMENT, ZONE CHANGE)
APPLICANT: THE RELATED COMPANIES OF CALIFORNIA, LIMITED LIABILITY COMPANY [ORDINANCE NO. 714]
City Council Regular Meeting Agenda – October 15, 2024 7 The subject request is a General Plan Amendment, Zone Change, Density Bonus, and Street Vacation to allow for the development of a one hundred percent affordable senior housing development at 405 South Del Mar Avenue.

The property is zoned M-1 (Light Manufacturing) and has a General Plan Use Designation of Light Industrial. The project site is 70,307 square feet (1.6 acres) in size, including a 12-foot street vacation totaling 11,392 square feet, and is currently vacant. The Fiscal Year 2024-2025 Adopted Budget includes the cost for required legal publication (Account No. 121-702-00-65-000) and codification (Account No. 121-702-00-22-000) of the ordinance, if adopted by the City Council.

California Environmental Quality Act (CEQA) Determination: This project was reviewed for compliance with the California Environmental Quality Act (CEQA).

This project is exempt from the requirements of CEQA, per Guideline Section 21080.40 (Definitions; affordable housing projects and rezoning exemption).

Technical studies, including traffic, acoustic, and a Phase I and Phase II environmental site assessment were prepared by the applicant team and submitted to the City and Department of Toxic Substances Control for review.

On July 23, 2024, the City submitted letters requesting tribal consultation with the associated tribal representatives by August 22, 2024. The City received a request for consultation from the Gabrielino Band of Mission Indians – Kizh Nation. Consultation concluded on September 3, 2024. The project site has a moderate sensitivity for buried Native American archaeological deposits and cultural materials. Therefore, the potential to tribal cultural resources on-site is moderate. Given the moderate sensitivity of the project site, even with the previous disturbance, there could still be a moderate likelihood of encountering tribal cultural resources during project construction. The Native American Historic Resource Act; Archaeological, Paleontological, and Historic Sites; Native American Historical, Cultural, and Sacred Sites (Public Resources Code Section 5097-5097.994) specifies the procedures to be followed in the event of unexpected discovery of human remains on nonfederal public lands. Adherence to existing State regulations and the procedures in the City’s Historic Preservation and Cultural Resources Ordinance (SGMC Section 153.630); would ensure that potential impacts on tribal cultural resources would be reduced to less than significant levels.

Recommended Action:

The action of the City Council may be to approve, approve with modifications, or deny the General Plan Amendment, Zone Change, Density Bonus, and Street Vacation applications. Staff recommends that the City Council:

6. CONTINUED BUSINESS
A. CONSIDERATION OF A PROFESSIONAL SERVICES AGREEMENT WITH FARM HABITS FOR THE CERTIFIED FARMER’S MARKET AND BUDGET APPROPRIATION OF AN ADDITIONAL $4,000 FOR MARKETING AND EQUIPMENT [RESOLUTION NO. 24-62]
In late April, the City and Supporting Arms launched the San Gabriel Farmer’s Market. Despite many efforts, the Farmer’s Market was not able to consistently retain vendors, attendance to the event decreased. At the August 20, 2024, City Council meeting, the City Council directed staff to return with an agreement to onboard Farm Habits as the new farmer’s market operator. The Council determined that the closure of Mission Drive adjacent to Blossom Market Food Hall would be the best location to relaunch the market and to host the market on Saturday mornings. At the September 17, 2024, City Council meeting, the Couuncil continued the item to allow time for the owner of Farm Habits to attend the meeting. The intent of this report is to present the City Council with the draft agreement with Farm Habits for consideration and approval and to discuss the next steps toward relaunching the farmer’s market. $25,000 would be needed to cover equipment rental costs as well as advertising and marketing efforts for fiscal year 2024-2025. The fiscal year 2024-2025 includes $21,000 for the farmer’s market special event. To meet the staff recommended $25,000 budget for the event, and additional $4,000 will need to be appropriated to the fiscal year 2024-2025 budget for this special event. The fee waiver, if approved, would reduce the potential revenue by $3,237.

City Council Regular Meeting Agenda – October 15, 2024 9 California Environmental Quality Act (CEQA) Determination: Not a Project as defined in Section 15378 of the State CEQA Guidelines.

Recommended Action:

Staff recommends that the City Council:

1. Review and authorize the Professional Services Agreement with Farm Habits and authorize the City Manager to execute it;

2. Adopt Resolution No. 24-62 for the appropriation of funds; and

3. Approve a fee waiver of all business license fees and taxes for the farmer’s market.

A. CONSIDERATION AND DISCUSSION ON ESTABLISHING A SISTER CITY

BETWEEN THE CITY OF SAN GABRIEL AND HUALIEN COUNTY, TAIWAN

REPUBLIC OF CHINA

In June 2024, the City Council approved a Sister City Agreement with the Banqiao District of New Taipei City in Taiwan Republic of China (R.O.C.). Since that time, Hualien County, Taiwan R.O.C. has shown interest in forming a Sister City with San Gabriel and would like to move forward with drafting a formal agreement.

California Environmental Quality Act (CEQA) Determination: Not a Project as defined in Section 15378 of the State CEQA Guidelines, as it has no reasonable potential for significantly impacting the environment.

Recommended Action:

Staff recommends that the City Council Discuss and provide direction on establishing a Sister City Program with Hualien County, Taiwan R.O.C. to promote cultural diversity. Should the City Council decide to form a Sister City partnership, a draft agreement has been attached to the report for consideration.
