SUBJECT: Virtual Meeting Findings
RECOMMENDATION:
Make findings that state and local officials continue to recommend measures to support social distancing due to the COVID-19 emergency and authorize virtual meetings for the City Council and all City bodies for the next 30 days.
DISCUSSION:
AB 361, adopted and effective this year, amended the Brown Act to allow city councils to meet virtually without a physical meeting location during or following a proclaimed state of emergency. To meet virtually, the City Council must make a finding that state and local officials continue to recommend measures to promote social distancing. The finding must be renewed every 30 days. Meetings under AB 361 will comply with the Brown Act if the public may observe and participate in the meeting telephonically or electronically. The posted agenda includes instructions for public participation.
The City Council had been meeting virtually under the previous Executive Order, which was replaced by AB 361. However, the City Council recently returned to holding standard in-person meetings in October. As a result of the omicron variant, the State Health Officer issued a statewide mandate to wear masks indoors in all public places. Therefore, this meeting has been moved to a virtual location. Making the AB 361 Findings will enable, but not require, the City Council and other City Boards to continue meeting virtually for the next 30 days.
