This information is for the sole purposes of the client and is not intended to provide specific advice or recommendations. Pl ease review the contents of this information carefully. Should you have any questions regarding the information presented, calculation methodology, investment portfolio, security detail, or any other f acet of this information, please feel free to contact us.

Public Trust Advisors, LLC (Public Trust) statements and reports are intended to detail our investment advisory activity as w ell as the activity of certain client accounts managed by Public Trust. The custodian bank maintains the control of assets and executes and settles all investment transactions. The custodian statement is the official record of security and cash holdings transactions. Public Trust recognizes that clients may use these reports to facilitate record keeping; therefore, it is recommended that the clien t reconcile this information with their custodian bank statement. Many custodians use a settlement date basis that may result in the need to reconcile due to a timing difference. The underlying ma rket value, amortized cost, and accrued interest may differ between the custodian and this statement or report. This can be attributed to differences in calculation methodologies and pricing source s used.

Public Trust does not have the authority to withdraw funds from or deposit funds to the custodian. Our clients retain responsibility for their internal accounting policies, implementing and enforcing internal controls, and generating ledger entries or otherwise recording transactions. The total market value represents price s obtained from various sources; it may be impacted by the frequency at which prices are reported, and such prices are not guaranteed. Prices received from pricing vendors are generally based on cu rrent market quotes but when such quotes are not available, the pricing vendors use a variety of techniques to estimate value. These estimates, particularly for fixed -income securities, may be based on certain minimum principal amounts (e.g. $1 million) and may not reflect all the factors that affect the value of the security including liquidity risk. The prices provided are not firm bids or offers. Certain securities may reflect N/A or unavailable where the price for such security is generally not available from a pricing source. The market value of a security, including those priced at par value, may differ from its purchase price and may not closely reflect the value at which the security may be sold or purchased based on various market factors. The securities in this investment portf olio, including shares of mutual funds, are not guaranteed or otherwise protected by Public Trust, the FDIC (except for certain non-negotiable certificates of deposit), or any government agency unless specifically stated otherwise.

Clients may be permitted to establish one or more unmanaged accounts for the purposes of client reporting. Clients may also b e permitted to provide externally managed assets for the purposes of client reporting. Public Trust defines unmanaged accounts or assets as one where the investment direction remains the sole re sponsibility of the client rather than the Investment Manager.

Unmanaged accounts or external assets do not receive ongoing supervision and monitoring services. The Investment Manager does not make any investment recommendations and may not charge a fee for reporting on these accounts or assets. The primary purpose for this service is to include unmanaged accounts or assets owned by the client in the performance reports provided by the Investment Manager. The Investment Manager assumes no liability for the underlying performance of any unmanaged accounts or a ssets, and it is the client’s sole responsibility for the accuracy or correctness of any such performance.

Beginning and ending balances are based on market value plus accrued interest on a trade date basis. Statements and reports m ade available to the end user either from Public Trust or through the online reporting platform may present information and portfolio analytics using various optional methods including, but not l imited to, historical cost, amortized cost, and market value. All information is assumed to be correct, but the accuracy has not been confirmed and therefore is not guaranteed to be correct. TO: City Council
REQUESTED BY: Michael Maurer, City Attorney
APPROVED BY: Robert A. Johnson, City Manager
SUBJECT: Ordinance No. 22-08 and Urgency Ordinance No. 22-09 RECOMMENDATION:

Staff recommends that the City Council:

1. ADOPT Ordinance No. 22-08, “Ordinance of the City Council of the City of San Jacinto, California, Adding Section 8.24.020 and 8.24.030 to Chapter 8.24 regarding enforcement and penalties of the County of Riverside Ordinance 492;” and

2. ADOPT Urgency Ordinance No. 22-09, “Ordinance of the City Council of the City of San Jacinto, California, Adding Section 8.24.020 and 8.24.030 to Chapter 8.24 regarding enforcement and penalties of the County of Riverside Ordinance 492.” BACKGROUND:

On September 17, 2018, Governor Brown signed Senate Bill 946 (SB 946), which limits the City's ability to regulate sidewalk vending. The bill took effect on January 1, 2019, and nullified many current restrictions that cities used to place on sidewalk vending and itinerant vendors.

With the enactment of SB 946, the Legislature amended California Government Code Sections 51036 and 51069 to decriminalize sidewalk vending. On February 5, 2019, the City Council adopted a Code Amendment adding Chapter 5.54 of the San Jacinto Municipal Code imposing regulations on sidewalk vending that are consistent with SB 946.

Staff is recommending an amendment to the City's Municipal Code to strengthen the City's ability to enforce illegal street vending activities related to food service due to the significant number of complaints received from businesses and residents of the community.

DISCUSSION:

At the July 19, 2022, City Council meeting, the City received a staff report on both an urgency and standard ordinance related to penalties for violations of the County Health Code, which the City previously adopted by reference. The City Council introduced Ordinance No. 22-08, which is now on the agenda for a second reading and approval and will take effect thirty days after approval.

Additionally, at the July 19, 2022, City Council took no action on the urgency ordinance because only three City Council members were present and participating. The City Council, therefore could not obtain the 4/5 vote of the City Council needed to pass. The urgency ordinance continues to be necessary for the immediate preservation of the public peace, health, and safety.

3.A.7
Packet Pg. 207
Unlawful food vendors have continued to serve food in the City without having a County health permit and without complying with County health laws. These actions represent an immediate risk to public peace, health, and safety in that these vendors may be serving food that is unsafe and putting the public unwittingly at risk. These actions have been occurring regularly and may be anticipated to continue occurring before a standard ordinance takes effect. Without the additional enforcement tools provided by the urgency ordinance, the City may not be able to effectively combat such health and safety risks.

The proposed Code Amendment being presented for the consideration by the City Council would add section 8.24.020 and 8.24.030 to Chapter 8.24, of the San Jacinto Municipal Code so that it is clear that the City has authority to enforce Riverside Ordinance No. 492 dealing with regulating food establishments and food facilities.

Currently, the Code establishes that the County Director of the Department of Environmental Health Services and his or her duly authorized Environmental Health Specialist has enforcement authority. This amendment would expand the authority to both the City of San Jacinto, including its contracted law enforcement officers, as well as the County. Such action would further the City Council finding that, unless properly regulated, sidewalk vending of prepared food poses a unique risk to the health, safety, and welfare of the public, including but not limited to unsanitary conditions involving food preparation risks to children, and consumer protection.

While staff has worked cooperatively and collaboratively with the County Health Department, the County lacks sufficient staff to be out each time these activities take place. Adoption of the proposed addition of sections 8.24.020 and 8.24.030 of the Municipal Code will provide City staff with the authority needed to enforce the County's regulations regarding unlawful food services.

FISCAL IMPACT:

There is no fiscal impact related to the adoption of the proposed Code Amendment.

REQUESTED BY: Stuart McKibbin, City Engineer
APPROVED BY: Robert A. Johnson, City Manager
SUBJECT: Subdivision Agreement Amendment No. 3 Tract 30878 - DR Horton RECOMMENDATION:

Staff recommends that the City Council approve Amendment No. 3 to the Subdivision Improvement Agreement for D.R. Horton Los Angeles Holding Company, located at NW Lyon Avenue and Seventh Street.

DISCUSSION:

On December 3, 2004, the Subdivision Improvement Agreement for Tract 30878 listed the conditions that were mutually agreed upon between the City and Park Meadows 171, LLC. As a result of the economic downturn, Park Meadows 171, LLC did not complete the agreed-upon improvements.

D.R. Horton Los Angeles Holding Company (DR Horton) is proposing to complete the balance of public improvements to Tract 30878. As such, DR Horton will assume the responsibility for executing an agreement and posting new securities in the form of bonds.

The City Engineers' office reviewed the cost estimate and exhibits, and the City Attorney's office completed its review of the attached agreements in preparation for Council approval.

FISCAL IMPACT:

All costs associated with the completion of improvements are the responsibility of the developer.

TO: City Council
REQUESTED BY: Arthur Mullen, Water Utilities Superintendent APPROVED BY: Robert A. Johnson, City Manager
SUBJECT: Recycled Water Accelerated Retrofit at Catalpa Park RECOMMENDATION:

Staff recommends that the City Council:

1. APPROPRIATE funds for the recycled water accelerated retrofit at Catalpa Park in the amount of $100,000.00; and

2. AUTHORIZE the City Manager to execute the Notice of Intent with Eastern Municipal Water District; and

3. AUTHORIZE the City Manager to execute a change order with Inland Empire Landscaping for additional work at Catalpa Park; and

4. AUTHORIZE the City Manager to execute an agreement with Eastern Municipal Water District; and

5. AUTHORIZE the City Manager to accept reimbursement from Eastern Municipal Water District
DISCUSSION:

Eastern Municipal Water District (“EMWD”) provides potable water for irrigation at multiple City parks. In order to incentivize conservation of potable water and to encourage the use of recycled (non-potable) water for irrigation, EMWD offers the Recycled Water Accelerated Retrofit Program (“Program”) that provides support services and funding sources to jurisdictions who wish to retrofit landscaping and irrigation systems to use recycled water use. Benefits of the Program include:
 EMWD will provide support services, including permitting and technical design, at no cost
 EMWD will provide a recycled water meter connection at no cost  EMWD will provide funding up to $5,000.00 per acre-foot, per year, of potable water usage to fund costs associated with retrofitting the on-site landscape and irrigation systems

3.A.9
Packet Pg. 228
 Following completion of on-site work, jurisdictions will receive a reduced rate of 75% of potable water rates for 10 years. After 10 years, the rate will transition to current recycled water rates
EMWD and City Staff has identified Catalpa Park as a prime location for the Program. Located at the intersection of 7th Street and Cawston Avenue, Catalpa Park was originally constructed in 2004. While the park uses potable water for irrigation, it was built with the infrastructure necessary to accommodate a recycled water retrofit in the future.

On average, Catalpa uses 19 acre-feet (AF) of water annually. Based on this average, the City will receive up to $95,000.00 in reimbursement funding from EMWD for the retrofit. EMWD will also provide planning and design services at no cost to the City, as well as the trenching and utility work required to connect the irrigation system to EMWD’s recycled water line. Once connected, the City’s landscaping contractor, Inland Empire Landscape, would then complete all necessary “above ground” work, such as upgrading sprinkler heads, replacing valve and control boxes, and installing appropriate signage.

Per current California Department of Water Resources guidelines, a full excavation and replacement of existing irrigation piping is not required. As a result, staff anticipates minimal disruption to the park as trenching across the park for the connection should be completed within two days. Complete park closure will not be necessary during this project.

Beyond the financial assistance and services provided by EMWD, the retrofit program would result in significant long-term cost savings through the post-construction reduced water rates.

Current potable water rates are expressed in tiers. Tier 1 is classified as “normal use” and billed at $1,006.24 per AF. Tier 2 is classified as “excessive use” and billed at $3,084.05 per AF. Tier 3 is classified as “wasteful use” and billed at $5,562.61 per AF.

Over the past 3 years, the City has paid an annual average of $24,000.00 on irrigation for the park, for an average of $1,263.16 per AF. After completion of the retrofit project, EMWD would move the City into a discounted rate tier of $957.23 per AF, resulting in an estimated savings of $3,671.00 annually. After a period not to exceed 10 years, EMWD would further reduce the rate for the City by switching to the recycled water rate of $606.24 per AF, resulting in an estimated savings of $7,883.00 annually (based on current rate structure). It should be noted that the recycled water rate is not tiered, thereby protecting the City from price fluctuations in times of increased water usage.

FISCAL IMPACT:

The City’s portion of the project costs are not anticipated to exceed the funding of $95,000.00 provided by EMWD. An appropriation is required, however, as this project was not included in the FY2022-2023 adopted budget. Staff recommends an appropriation of $100,000.00 to account 363-8831-500-3405 (LLPD2 Zone 63). The City will be reimbursed by EMWD for all costs up to $95,000.00, which would be included as Miscellaneous Revenue to the Zone. The City will also reduce water costs by a minimum of $7,883.00 annually once the recycled water rate is in effect. There is no impact to the General Fund.

TO: City Council
REQUESTED BY: Arthur Mullen, Water Utilities Superintendent APPROVED BY: Robert A. Johnson, City Manager
SUBJECT: Budget Request & Support of Senate Drought Infrastructure Package RECOMMENDATION:

Staff recommends that the City Council receive and file the Budget Request and Support of Senate Drought Infrastructure Package: Funding for Stormwater Capture and Stormwater Management, prepared by CASQA.

DISCUSSION:

The California Stormwater Quality Association (“CASQA”) is a professional member association that advances sustainable stormwater management practices on behalf of stormwater permittees and is intended to help California comply with municipal and industrial National Pollutant Discharge Elimination System (“NPDES”) stormwater mandates of the federal Clean Water Act. While the State of California’s FY2022-2023 budget proposal calls for $1.5 Billion in funding for Drought Resilient Water Supply Grants, it does not include any dedicated funding for stormwater capture infrastructure. Historically, stormwater capture is one of the most chronically underfunded infrastructure needs facing local governments today. Local governments face funding gaps of hundreds of millions of dollars annually to comply with existing stormwater permit conditions.

Recognizing the need for stormwater funding, CASQA authored a letter of support titled “Budget Request & Support of Senate Drought Infrastructure Package: Funding for Stormwater Capture and Stormwater Management”. This letter of support, sent to Governor Newsom and to both the Senate and Assembly Budget Committees, requests dedicated funding in the amount of $750 Million for stormwater capture projects. As an NPDES permittee, San Jacinto accepted the invitation to co-sign the letter alongside other NPDES stakeholders. The final budget request, sent July 25, 2022, includes the City Manager as a co-signer.

By signing on to the budget request, the City joins CASQA and other permittees in an appeal to the state legislature to recognize the importance of stormwater capture programs and provide appropriate funding for this essential sector of infrastructure.

Dear Governor Newsom, Pro Tem Atkins and Speaker Rendon, Chair Skinner and Chair Ting:

Subject: Budget Request & Support of Senate Drought Infrastructure Package: Funding for Stormwater Capture and Stormwater Management
While stormwater management is one of the most important ways we can protect our precious waterways while also increasing valuable water supplies, stormwater capture remains one of the most chronically underfunded infrastructure needs facing local governments today. The California Stormwater Quality Association and its members representing 26 million Californians support the Senate’s Budget Proposal calling for $1.5 Billion in Drought Resilient Water Supply Grants, and specifically requests $750 Million for stormwater capture projects.

With changing precipitation patterns and declining snowpack, capturing stormwater in our urban communities simply must occur to adapt to climate change and long periods of drought. Our aging flood control systems were designed to capture and move water from urban landscapes as fast as possible. Meaning, even though we are experiencing extreme drought, the majority of our rainwater simply washes out of our communities. We applaud the Senate for shifting our thinking as a state and prioritizing the policies and investments that are necessary to reshape our urban landscapes and respond to the weather and rainfall patterns to utilize every last drop. Capturing water in our communities and protecting our water resources will provide substantial value — healthier, more livable, and more resilient communities. An investment in stormwater capture is also an investment in flood control, green infrastructure, street beautification, sanitation, water conservation, and groundwater recharge.

CASQA STORMWATER MAY BUDGET REQUEST

CRITICAL NEED
Unlike all other water resources, most stormwater programs in California lack dedicated funding. Almost all municipalities rely solely on their local general fund — the same source of funding for law enforcement, fire, paramedics, parks, street lighting and libraries. Even if local communities were to secure a dedicated local source of funding, local communities alone cannot provide the resources needed to reshape our urban landscapes. The State of California has a significant role to play, particularly in our underserved communities.

To comply with existing stormwater permit conditions, local governments are already facing funding gaps of hundreds of millions of dollars per year, with cumulative gaps over the next 20 years in the billions of dollars. Existing requirements for stormwater needs in the Los Angeles area alone will require $20 billion over 20 years, averaging out to a $ 1 billion needed each year. The County of San Mateo has a need of $700 million- $1 Billion. The annual funding gap to achieve existing permit requirements is hundreds of millions of dollars, per county.

At the city scale, the City of San Diego has identified a funding gap of $467.8M in FY 2022, with a cumulative funding gap of $5.47B over FYs 2022-2041.

BUDGET REQUEST
It will require visionary thinking and long-term, substantial investment to replumb California and mitigate for the increasing envionrmental challenges we see due to climate change. It is therefore critical not only to recognize and value stormwater capture as vital to climate adaptation, but to provide the significant financial investments to make it a reality. It is essential the 2022-23 State Budget invests in stormwater capture infrastructure, one of the most important resources for California’s future – both in terms of water resiliency and in terms of climate adaptation. We believe securing $800 million in stormwater funding is critical to protecting our waterways and increasing water supplies.

TO: City Council
REQUESTED BY: Julia Espinoza, Deputy City Clerk
APPROVED BY: Robert A. Johnson, City Manager
SUBJECT: Amended Sheriffs Contract
RECOMMENDATION:

Staff recommends that the City Council approve the amended contract for increased staffing to coincide with the approved FY 2022-2023 Budget and Authorize the Mayor to the sign the agreement.

DISCUSSION:

The City of San Jacinto contracts with Riverside County Sheriff’s Department to provide public safety police services, which operate out of the San Jacinto Sheriff’s Station (SJSS) building owned by the City of San Jacinto.

One of the components of the Measure V ballot measure proposition in November 2020, which was approved by San Jacinto registered voters by some 68%, was to increase public safety inside the City limits.

During the budget development for the fiscal year 2022-2023, City staff and the Riverside County Sheriff’s Department, headed by San Jacinto Station Chief Lt. Jeremy Harding, agreed to increase services to meet the demand of the growing population.

In the past few years, the City Council has been aggressive in staffing up the SJSS. For FY 21/22, the City increased from 97 patrol hours per day to 120 (for a 23 hour increase, equal to about 4 Deputies), and added two (2) SET Officer positions and two (2) Community Service Officer positions.

For FY 22/23, the adopted budget included the addition of one (1) Sergeant position and two (2) Motorcycle Officer positions. Along with the approximately 90 Flock automatic license plate readers (ALPR’s) that the City has purchased and installed citywide, the City is now contracted for its highest level of service in, at least, the past 10 years.

FISCAL IMPACT:

The increase in the attached Amendment was approved with the approval of the FY 2022-2023 Adopted Budget in June 2022.

TO: City Council
REQUESTED BY: Arthur Mullen, Water Utilities Superintendent APPROVED BY: Robert A. Johnson, City Manager
SUBJECT: Emergency Replacement of Water Main Line on Artesia Street RECOMMENDATION:

Staff recommends that the City Council:

1. DETERMINE that the damaged water main line on Artesia Street between N. Jordan Avenue and N. Alognia Avenue necessitates replacement on an emergency basis, consistent with San Jacinto Municipal Code §3.08.070(B); and

2. AUTHORIZE the City Manager to procure services necessary to prevent or mitigate the emergency, consistent with San Jacinto Municipal Code §3.08.070(B)(1); and

3. APPROPRIATE up to $600,000.00 from the American Rescue Plan Act (ARPA) fund to complete the emergency replacement project.

DISCUSSION:

In June 2022, an outside paving contractor was performing work on a section of Artesia Street, between N. Jordan Avenue and Alessandro Avenue, when the weight of heavy equipment ruptured a 6-inch water main. City staff promptly repaired the break, but discovered that the estimated 60-year-old water line running from N. Jordan Avenue to N. Algonia Avenue was installed at a depth of only 24-inches below grade instead of the current industry standard of 48 inches. The paving project is part of a larger Community Development Block Grant (CDBG) project. Given the issues, the contractor was directed to finish the remaining portion of the project from N. Algonia Avenue to Alessandro Avenue, while the City assesses options.

Upon inspection, the piping material for the water line was determined to be asbestos cement.

Asbestos cement piping was widely used until the 1980s, when its use was discontinued over the health concerns of asbestos. Asbestos cement is also a soft and brittle material, prone to cracking under heavy loads, and is difficult to repair. Accordingly, the Public Utilities Department, along with the City Engineer, has determined that the appropriate course of action is to remove the asbestos cement piping and replace it with modern C-900 PVC piping, buried at a depth of 48 inches below grade.

Due to the unexpected nature of this event, as well as the potential for significant damage to City infrastructure and resident property, it is necessary to conduct this project on an emergency basis.

Though the initial rupture was repaired, the asbestos cement pipe between N. Jordan Avenue and N. Algonia Avenue is now more likely to fail at other points on the line, necessitating further

costly repairs and posing a property risk to approximately 10 resident households on Artesia Street.

Further adding to the need to expedite this project is the present condition of Artesia Street.

While the paving contractor completed work between N. Algonia Avenue and Alessandro Avenue, the condition of the road between N. Jordan Avenue and N. Algonia Avenue is substandard. The road has been partially excavated and now sits approximately 2-inches below the existing sidewalk. If paving were to be completed without replacing the existing water line, the weight of the paving vehicles will likely further damage the pipe. The road cannot be restored without significant risk of future failures. Should future repairs be required on the original line, City Staff would need to cut through the asphalt, undermining the City’s investment in pavement upgrades.

San Jacinto Municipal Code §3.08.070(B) delegates to the City Manager “…the power to repair or replace the public facility, take any directly related and immediate action required by the emergency, and procure the necessary equipment, services, and supplies for those purposes, without giving notice for bids to let contracts”. Staff believes that the risk presented by the existing water line is time-sensitive and that undertaking a formal bidding process, in this case, would not be in the best interest of the City or its residents.

Staff has contacted six pipeline construction companies and are obtaining quotes from two professional companies. The scope of service includes trenching and removal of 340 feet of existing pipe, installation of new C-900 pipe at 48 inches below grade, final connection of the new line, reconnection of service lines, backfilling the trench, and paving with 3-inch asphalt.

In 2020, San Jacinto voters approved local ballot Measure V – a one-cent increase in local sales tax. A survey of registered voters identified protecting local drinking water and repairing streets, roads, and potholes as major priorities for the additional revenue raised by Measure V. The replacement of this section of the water line addresses both of these priorities. Upgrading this water line with modern materials at the correct depth will ensure reliability in water transmission for the residents of this line. The project will also provide a fully paved road between N. Jordan Avenue and N. Algonia Street to replace the current compacted dirt road.

FISCAL IMPACT:

This emergency project was not included in the adopted FY 2022-2023 budget. An appropriation of $600,000.00 from ARPA funds is requested, and will be recorded in CIP #23-002. It is anticipated that the project will cost less than this amount, but quotes have not yet been received from the interested companies. There is no impact to the General Fund.
