VI. INTERPRETATION OF RATE AND METHOD OF APPORTIONMENT
The City reserves the right to make minor administrative and technical changes to this document that do not materially affect the rate and method of apportioning the Special Tax. In addition, the interpretation and application of any section of this document shall be at the City’s discretion. Interpretations may be made by the City by ordinance or resolution for purposes of clarifying any vagueness or ambiguity in this Rate and Method of Apportionment of Special Tax.

VII. MANNER AND DURATION OF SPECIAL TAX
The Special Tax shall be collected in the same manner and at the same time as ordinary ad valorem property taxes, provided that the City may directly bill the Special Tax, may collect the Special Tax at a different time or in a different manner if needed to meet the financial obligations of CFD 2020-1, and may collect delinquent Special Taxes through foreclosure or other available methods.

A Special Tax shall continue to be levied and collected within CFD 2020-1, as needed to fund the Annual Special Tax Requirement, in perpetuity.

VIII. APPEAL OF SPECIAL TAX LEVY
Any property owner may file a written appeal of the Special Tax with the CFD Administrator claiming that the amount or application of the Special Tax is not correct.

The appeal must be filed not later than one calendar year after having paid the Special Taxes that are disputed, and the appellant must be current in all payments of Special Taxes. In addition, during the term of the appeal process, all Special Taxes levied must be paid on or before the payment date established when the levy was made.

The appeal must specify the reasons why the appellant claims the Special Taxes are in error. The CFD Administrator shall review the appeal, meet with the appellant if the CFD Administrator deems necessary, and advise the appellant of its determination.

If the property owner disagrees with the CFD Administrator’s decision relative to the appeal, the owner may then file a written appeal with the City Council whose subsequent decision shall be final and binding on all interested parties. If the decision of the CFD Administrator or subsequent decision by the City Council requires the Special Taxes to be modified or changed in favor of the property owner, no cash refund shall be made for prior years’ Special Taxes, but an adjustment shall be made to credit future Special Taxes.

This procedure shall be exclusive and its exhaustion by any property owner shall be a condition precedent to filing any legal action by such owner.

Attachment: CFD 2020-1 Annex 9 (Soboba Crossroads) (CFD 2020-1 Annexation 9 - Soboba Crossroads ROI) December 19, 2023
TO: City Council
REQUESTED BY: Robert Johnson, City Manager
APPROVED BY: Robert A. Johnson, City Manager
SUBJECT: Interwest Hourly Rate Adjustment
RECOMMENDATION:

Staff recommends that the City Council Approve the new hourly rates for Municipal Engineering Support Services.

DISCUSSION:

The City of San Jacinto has contracted for engineering services for over 25 years and has enjoyed a strong partnership with Trilake Consultants, now Interwest, a Safebuilt Company.

Since 2013, the engineering company has maintained the same schedule of compensation.

Unfortunately, as the City grows and its needs for services grow, the company is not able to retain high-quality team members due to below-market pricing and economic changes.

Typically, fees would increase by an agreed upon Consumer Price Index (CPI%) percentage on an annual basis, but that has not occurred over the past 14 years.

Interwest has requested an increase in fees and after some negotiation, has agreed to provide stepped increases in pricing to further assist the City and the development community over the next two years.

The chart below shows the current fees from 2013, the proposed fees for 2024, and the current standard rates (2023) that Interwest charges (dark grey column) in other municipalities that it serves :

3.A.7
Packet Pg. 181
*For prevailing wage projects, there is an additional $20 charged per hourly rate. *Mileage will be charged at the current IRS rate
*Overtime, weekend and holiday work will be charged at 150% of the above hourly rates Furthermore, Interwest is requesting that beginning January 2025, and on the anniversary annually thereafter, the hourly rates listed below shall be automatically increased based upon the annual increase in the Department of Labor, Bureau of Labor Statistics or successor thereof, Consumer Price Index (United States Average, All Items {CPI-U}, not seasonally adjusted, All Urban Consumers, referred to herein as the “CPI”).

Such an increase shall not exceed 4% per annum. The increase will become effective upon publication of the applicable CPI data. If the index decreases, the rates listed shall remain unchanged.

Staff recommends that the City Council Approve the new hourly rates for Municipal Engineering Support Services.

FISCAL IMPACT:

3.A.7

There is no impact to the General Fund. Engineering rates and fees are charged to the development applications associated with the work being performed.

Re: Municipal Engineering and Support Services Contract – Hourly Rate Adjustment Dear Mr. Johnson,
We wanted to start by thanking you and the City Council for the honor of providing Engineering services to the City of San Jacinto since 1997. We have maintained our current fee schedule with the City since 2013. We have now, however, come to the point that to maintain our high caliber employees and maintain our level of exceptional service we kindly request an adjustment to our hourly rates that is consistent with current market and inflationary conditions.

We are very proud of the value we provide to the City of San Jacinto and we work very hard to maintain a level of service unmatched by our competitors. We look forward to continuing our relationship with the City into the future. Below you will find an updated fee schedule for your review and consideration.

Please note that in recognizing the long-term partnership we have developed over time, and the financial impact of increasing rates to the City, we propose to discount our rates from our standard rate structure. Please see the proposed rate schedule below.

FEE SCHEDULE
Beginning January 2025 and on the anniversary annually thereafter the hourly rates listed below shall be automatically increased based upon the annual increase in the Department of Labor, Bureau of Labor Statistics or successor thereof, Consumer Price Index (United States City Average, All Items (CPI - U), Not Seasonally adjusted, All Urban Consumers, referred to herein as the “CPI”). Such increase shall not exceed 4% per annum. The increase will become effective upon publication of the applicable CPI data. If the index decreases, the rates listed shall remain unchanged.

TO: City Council
REQUESTED BY: Robert Johnson, City Manager
APPROVED BY: Robert A. Johnson, City Manager
SUBJECT: Approval of Flock Agreement
RECOMMENDATION:

Staff recommends that the City Council Approve a Five (5) Year Agreement with Flock Safety to guarantee current prices, and Authorize the City Manager and City Attorney to negotiate the terms of the Agreement.

DISCUSSION:

On September 15, 2020, the City Council approved the City Manager’s request to implement a new Automated License Plate Reader (ALPR) program to assist the San Jacinto Sheriff’s Department in combating stolen vehicles and associated crimes.

The ALPR technology, provided by Flock Safety, allows for the automated detection of license plates using a mobile or fixed camera. The data images captured by the camera are processed and associated with vehicle license plates for law enforcement purposes, including for identifying and locating stolen or wanted vehicles, stolen license plates, or missing persons. The technology may also be used to gather information related to active warrants, homeland security, electronic surveillance, suspect interdiction, and stolen property recovery.

The City of San Jacinto was the second city in Riverside County to approve and implement the Flock Safety ALPR system. It was so successful, so quickly, that the City’s Sheriff’s Department was recovering an average of one stolen vehicle per day. Then Chief Ken Reichle made a presentation to Sheriff Chad Bianco and other Department officials that led to the County and other cities implementing the system.

The City currently has 60 ALPR cameras throughout the city, and the system is a force multiplier in assisting the San Jacinto Sheriff’s Department to recover vehicles and solve crimes.

Flock Safety has approached the City with an offer to lock in annual pricing at the current rate for the next five years without any increases. The current rate of annual renewal for each ALPR is $2,500, which is an annual contract cost of $150,000. The annual cost includes the camera and covers the cost to replace the camera if the camera malfunctions. The cost per installation of new or replacement cameras is $250. If a camera is stolen, the replacement cost is $800; however, the City may choose not to replace the camera for financial or other reasons.

The system has enabled the City’s Sheriff’s Department to recover a minimum of 200+ vehicles with an estimated value (average $15k/vehicle) of over $3M.

Staff recommends that the City Council Approve a Five (5) Year Agreement with Flock Safety

Packet Pg. 197 Attachment: CA - City of San Jacinto - Law Enforcement Agreement -_ (Approval of Flock Agreement) December 19, 2023
TO: City Council
REQUESTED BY: Robert Johnson, City Manager
APPROVED BY: Robert A. Johnson, City Manager
SUBJECT: ARPA Agreement with Riverside County
RECOMMENDATION:

Staff recommends that the City Council Approve the agreement, Allocate the funding to the two projects, and Authorize the City Manager to sign the Agreement.

DISCUSSION:

Some months ago, the City Manager was contacted by Riverside County Chief Operating Officer Juan Perez to discuss a potential allocation of County American Rescue Plan Act (ARPA) funds for the City of San Jacinto.

The Fifth District Supervisor, Yxstian Gutierrez, had identified funds to be allocated directly to the City of San Jacinto, if the City had shovel ready infrastructure projects, and would be able to spend the funds and deliver the projects by the deadline of December 31, 2026.

The City Manager shared two State Street Rehabilitation projects that the City Engineer is currently designing, and both were approved for allocations of ONE MILLION DOLLARS ($1,000,000) each.

The first project, which will be completed second, is outlined on page 10 of the attached agreement. The State Street widening project consists of increasing capacity from two lanes to four lanes in the segment from the northern city limit south to Community College Drive, drainage improvements would be completed along the east side of State Street, and an adequate culvert crossing would be installed. The Engineer’s estimated project cost is $5,048,314, about $1.1 million of which is budgeted in CIP #21-002. Supervisor Gutierrez has allocated $1,000,000 of Riverside County ARPA funds to the project.

The second project, which will be completed first, is outlined on page 11 of the attached agreement. The State Street full-width reclamation/grind & overlay project from Idyllwild south to 9
th Street is currently under design with the intent of bidding out for construction in Spring 2024. The project would contain resurfacing most of State Street, including four lanes, turn lanes and median asphalt, by removing and replacing old asphalt with new asphalt. The project is roughly 1.5 miles in length. The Engineer’s project cost estimate is $3,092,000, which will be a new CIP project when approved. Supervisor Gutierrez has allocated $1,000,000 of Riverside County ARPA funds to the project.

The City Attorney has reviewed and approved the agreement.

Staff recommends that the City Council Approve the agreement, Allocate the funding to the two

projects, and Authorize the City Manager to sign the Agreement.

FISCAL IMPACT:

The allocation of Riverside County ARPA funds assists the City in bringing the projects to the community sooner than anticipated.
