SUBJECT: Subdivision Agreement Parcel Map 38359
RECOMMENDATION:
Staff recommends that the City Council approve the Subdivision Improvement Agreement for Maple Lane Group, LLC a California Limited Liability Company (“Developer”) specific to Parcel Map 38359, in substantially the form set forth in the accompanying agreements, and authorize the City Manager to execute any other documents necessary to implement said agreements.
DISCUSSION:
As per Sections 13.1 and 13.2 of the agreements, Developer shall provide the City with security bonds in the amount based on the Engineer’s approximation of the actual cost to construct the applicable public improvements. California Subdivision Map Act (Gov. Code §§ 66410 et seq.) permits various forms of security. In this case, Developer has opted to place traditional bonds as a form of security.
Pursuant to Chapter 16.24 of the San Jacinto Municipal Code and the applicable provisions of the Subdivision Map Act, the Developer and City shall enter into these Agreements for the timely construction and completion of the public improvements and the furnishing of the security. Therefore, acceptable to the City Engineer and City Attorney for Parcel Map 38359.
The Developer’s execution of this Agreement and the provision of the security are made in consideration of the City’s approval of Parcel Map 38359.
FISCAL IMPACT:
All costs associated with completion of the conditioned public improvements are the responsibility of the developer.
