TO: City Council
REQUESTED BY: Erika Gomez, Finance Director
APPROVED BY: Robert A. Johnson, City Manager
SUBJECT: Ordinance 24-16 Second Reading - CFD 2020-1 Annex 16 DR Horton Serrano Pt Tract 38339
RECOMMENDATION:

Staff recommends that the City Council conduct the second reading and approve Ordinance No. 24-16, Authorizing the Levy of Special Taxes of Community Facilities District No. 2020-1:

ORDINANCE OF THE CITY COUNCIL OF THE CITY OF

SAN JACINTO AUTHORIZING THE LEVY OF SPECIAL

TAXES IN A COMMUNITY FACILITIES DISTRICT,

INCLUDING CERTAIN ANNEXATION TERRITORY
IDENTIFIED AS ANNEXATION NO. 16 (TAX ZONE NO.
17), INTO SAN JACINTO COMMUNITY FACILITIES

DISTRICT
DISCUSSION:

At the October 15, 2024, City Council meeting, the City Council adopted Resolution No. 4044, declaring their intention to annex territory, a commercial development known as Serrano Pt, into Community Facilities District 2020-1 (CFD 2020-1), based upon a petition from the property owners.

On November 19, 2024, the City Council held a public hearing and conducted the Special Annexation Landowner Election. Upon conducting the election, one affirmative vote was received from the property owner, and Annexation No. 16 was complete. The City Council also introduced Ordinance No. 24-16, authorizing the levy of special taxes in CFD 2020-1, including the newly annexed area. This second reading and adoption of Ordinance No. 24-16 is required to allow for the levy of special taxes related to this newly annexed area in the future.

FISCAL IMPACT:

The revenue received from the special tax will assist in funding the Services as defined in the Rate and Method of Apportionment. Based on Fiscal Year 2024/2025 projections, it is anticipated that the CFD will collect $57,988 in special tax revenue based upon full project buildout, which will increase annually by the change in CPI up to a maximum of 5%, with no Contingent Special Tax. Approval of Ordinance 24-16 would authorize the City to levy this territory the special taxes for CFD No. 2020-1, providing dedicated funding for maintenance and administrative service. Failure to approve Ordinance 24-16 would result in the inability to collect the annual special taxes, and the maintenance and service costs of the territory would be borne entirely by the City’s General Fund.
