TO: City Council
REQUESTED BY: Stuart McKibbin, City Engineer
APPROVED BY: Robert A. Johnson, City Manager
SUBJECT: Warren Road Minor Drainage Improvement Project (SJ-507) (CIP# 24- 002)
RECOMMENDATION:

Staff recommends that the City Council take the following actions:

1. APPROVE the plans and specifications for the WARREN ROAD MINOR DRAINAGE IMPROVEMENT PROJECT (SJ-507) (CIP# 24-002);

2. AWARD the construction contract to the lowest responsible bidder submitting a responsive bid Wright Construction Engineering for the sum of $331,750;

3. ALLOCATE 13% ($43,127.50) of total bid for administration, inspection, and testing;

4. ALLOCATE 15% ($49,762.50) of total bid for construction contingencies; and

5. AUTHORIZE the City Manager to execute the construction contract.

BACKGROUND:

The City of San Jacinto and KB Home Coastal Inc. came to an agreement that KB Home Coastal Inc. would provide a $162,500 fair share contribution in lieu of constructing drainage improvements as a part of their conditions of approval.

Riverside County Flood Control District (RCFCD) agreed to fund the remaining costs for the construction of this drainage channel. The funding agreement between the City and RCFCD will come to the Council at an upcoming meeting.

This project will consist of constructing a new 1500-foot-long concrete channel and installing flexible post lane delineators to provide safer traffic conditions.

This project is exempt from CEQA requirements under CCR 15301(c).

DISCUSSION:

Notice Inviting Bids for WARREN ROAD MINOR DRAINAGE IMPROVEMENT PROJECT (SJ-507) (CIP# 24-002) advertised online on Planet Bids on November 21, 2024. On December 19, 2024, ten bids were received ranging from $331,750 to $537,200. Wright Construction Engineering submitted the lowest responsible and responsive bid for the sum of $331,750.

Wright Construction Engineering has not performed work for the City before, so Engineering contacted the Contractor’s references. The agencies referenced by the Contractor were all satisfied with the Contractor’s work.

4.1 Packet Pg. 4
The project’s general work occurs on a segment of Warren Road beginning on Scott St. and approximately 1500 feet south of Scott St. The general work of this project involves installation of the following proposed drainage improvements and traffic control: concrete channel, concrete drainage apron, and reflective post delineators. The scope of work also includes the removal and replacement of the existing concrete headwall and wingwall found at the north end of the site by Scott St. As part of the work the Contractor shall furnish all labor, technical and professional services, supervision, materials, equipment, tools, and incidentals as required by the Plans, Specifications, and Contract Documents.

City staff recommends the City Council award the construction contract for the sum of $331,750 to Wright Construction Engineering as the lowest responsible bidder submitting a responsive bid.

FISCAL IMPACT:

Approval of this item will not impact the General Fund. The existing developer funds supplemented by RCFCD funds is sufficient to fund construction, construction contingencies, administration, and inspection.

Project Expenditures
Construction Contract $ 331,750.00
Design Cost to Date $ 36,465.00
Contingencies $ 49,762.50
Admin, Inspection, Testing $ 43,127.50

TO: City Council
REQUESTED BY: Craig Hayes,
APPROVED BY: Robert A. Johnson, City Manager
SUBJECT: Selection of Mayor and Mayor Pro Tem
RECOMMENDATION:

Staff recommends that the City Council review the mayoral selection options in this staff report and either:
. Keep the current selection process for Mayor and Mayor Pro Tem adopted via Resolution No. 4042 on October 15, 2024, and take action to confirm Mayor Pro Tem Valerie Vandever as Mayor and Councilmember Alonzo Ledezma as Mayor Pro Tem;

2. Adopt Resolution No. 4055 and amend the current selection process for Mayor and Mayor Pro Tem by appointing a Mayor and Mayor Pro Tem through nomination of any member of the City Council and three (3) affirmative votes and then take action to select a Mayor and Mayor Pro Tem; or

3. Provide direction to staff and bring this item back at a later date for further discussion.

DISCUSSION:

At the October 15, 2024, City Council meeting, the City Council adopted a mayoral rotation policy via Resolution No. 4042. At the December 17, 2024, City Council meeting, the City Council did not take action on appointing a Mayor or Mayor Pro Tem and directed staff to bring back a resolution at the next City Council meeting that would amend the current selection process for Mayor and Mayor Pro Tem and appoint a Mayor and Mayor Pro Tem through nomination of any member of the City Council and three (3) affirmative votes.

1. State Law and Procedures for Selecting the Mayor
Government Code Section 36801 grants the City Council the authority to select the mayor:
“[t]he city council shall meet at the meeting at which the declaration of the election results for a general municipal election is made…and, following the declaration of the election results and the installation of elected officials, choose one of its number as mayor, and one of its number as mayor pro tempore.”
State law does not prescribe a particular method the City Council must use to select a mayor and mayor pro tempore. Rather, the City Council may select the mayor and mayor pro tempore in the manner it chooses.

4.2 Packet Pg. 15

2. Current Selection Process.

Section 3.1 of the City of San Jacinto Council Orientation and Procedure Handbook (the, “Handbook”) provides the procedures for selecting the Mayor and Mayor Pro Tem. The current selection process for Mayor and Mayor Pro Tem was adopted by the City Council via Resolution No. 4042 on October 15, 2024.

Resolution No. 4042 states that after the November 2024 General Election, the City Council would appoint the current Mayor Pro Tem as Mayor, and the most senior City Council member, who has never served as Mayor or Mayor Pro Tem, as Mayor Pro Tem. If there is no incumbent of the City Council who has never served as Mayor or Mayor Pro Tem, the most senior incumbent member of the City Council would become Mayor Pro Tem. Following these appointments, the selection process would then default to a rotational system where, after each election, the current Mayor Pro Tem would become the Mayor, and the Councilmember at the top of the rotation list would become Mayor Pro Tem.

3. Proposed Method for Selecting a Mayor and Mayor Pro Tem The following is an option for the City Council to consider as it pertains to the selection process for the offices of the Mayor and Mayor Pro Tem. This option is how the City Council selected the Mayor and Mayor Pro Tem prior to the adoption of Resolution No. 4042. The City Attorney’s office has prepared a resolution attached to this staff report if the City Council desires to adopt this option tonight.

With this option, the City Council appoints a Mayor and Mayor Pro Tem through nomination by any member of the City Council. Following these nominations, each nomination must be confirmed by three (3) or more affirmative votes. In the event that no person receives three (3) or more votes for either one of the offices, the process must be repeated, with the two persons receiving the highest number of votes previously being the only nominees for that office seeking to be filled. If, after repeating the selection process, no person receives three (3) affirmative votes for the office, the City Council has the option to either repeat the selection process until the officer has been duly selected or continue the selection to the next regular meeting of the City Council.

FISCAL IMPACT:

AMENDED SECTION 3.1 OF THE CITY OF SAN JACINTO

COUNCIL ORIENTATION AND PROCEDURE HANDBOOK

3. PRESIDING OFFICER

3.1 Presiding Officer
(a) The Mayor shall be the Presiding Officer at all meetings of the Council.

In the absence of the Mayor, the Mayor Pro Tem shall preside. In the absence of both the Mayor and Mayor Pro Tem, the Council shall select a temporary presiding officer to serve until the arrival of the Mayor or the Mayor Pro Tem or until adjournment, whichever first occurs. (b) The Council shall reorganize each year. In even-numbered years, the Council shall reorganize itself by appointing the Mayor and Mayor Pro Tem from its members pursuant to the selection procedure established by this section at the first regular meeting following the official canvass of results of the election, but no later than the fourth Tuesday following the date of said general and municipal election.

In odd-numbered years, at the first meeting in December the Council shall reorganize by appointing one of its members as Mayor and another of its members as Mayor Pro Tem pursuant to the selection procedure established by this section.

In the event the Mayor or Mayor Pro Tem cannot fulfill their term, a Mayor or Mayor Pro Tem shall be appointed pursuant to the selection procedure established by this section to serve the remainder of the current term at any meeting of the City Council.
(c) The City Clerk shall preside at the portion of the Council meeting to appoint the Mayor and Mayor Pro Tem.
(d) Notwithstanding anything in this Section 3.1, when appointing the Mayor and Mayor Pro Tem at the first regular meeting following the official canvass of results of the November 2024 general election, the position of Mayor shall be filled by the current Mayor Pro Tem. The most senior incumbent member of the City Council, who has never served as Mayor or Mayor Pro Tem, shall be appointed as Mayor Pro Tem. If there is no incumbent member of the City Council who has never served as Mayor or Mayor Pro Tem, the most senior incumbent member of the City Council shall become Mayor Pro Tem.

(e) Following appointments of the Mayor and Mayor Pro Tem after the November 2024 general election, the selection process would then default to a rotational system of who will serve as Mayor and Mayor Pro Tem based, to the extent possible, on the following rules and policies:
a. The position of Mayor shall be filled by the current Mayor Pro Tem. If the Mayor Pro Tem is no longer on the Council, the Council Member at the top of the rotation list would become Mayor.
b. The Council Member at the top of the rotation list would become Mayor Pro Tem.
c. The senior incumbent Council Member would be at the top of the rotation list followed by other incumbent Council Members in order of seniority.
d. In a non-election year, the previous Mayor shall be placed in the rotation below other Council Members, even if the previous Mayor is more senior than the other Council Members.
e. Upon the election or appointment of a new Council Member, the new individual shall be placed at the bottom of the rotation list. In the event of an election of more than one new individual to the City Council, the ranking of order of the new Council Member(s) shall be in relation to the number of votes received at the election.

The individual with the greatest number of votes shall be placed immediately below more senior Council Members including incumbent Council Members who are reelected. The individual with the second greatest number of votes shall be placed below the first and so on. Following an election, the previous incumbent Mayor shall be placed in the rotation above the newly elected Council Member(s) and below other incumbent Councilmembers, including incumbent Councilmembers who are reelected.

Incumbent Councilmembers shall stay in their position in the rotation relative to other incumbents, even after reelection. f. In instances where there are four or five new individuals elected to the City Council, those individuals filling positions with shorter terms remaining shall be placed at the top of the rotation list in order of votes received at the election. Councilmembers with longer terms shall be placed below the shorter-term
Councilmembers on the rotation list in order of votes received at the election.
g. In the event of a tie in seniority between two incumbent Councilmembers of the City Council, the tie shall be broken by flipping a coin.
(f) Voting in the selection of Mayor and Mayor Pro Tem shall be by voice vote administered by the City Clerk.
