TO: City Council
REQUESTED BY: Erika Gomez, Finance Director
APPROVED BY: Robert A. Johnson, City Manager
SUBJECT: Detach Territory from LLPD2 - Zone 44
RECOMMENDATION:

Staff recommends that the City Council adopt Resolution No. 4058, the Resolution of Intention to Detach Territory from Landscaping, Lighting, and Park District No. 2, previously referred to as Zone 44 Tract 31293, currently known as Lennar Tract 38202 (Canterwood).

DISCUSSION:

The City Council previously annexed Tract 38202, referenced as Tract 31293, into its Landscaping, Lighting, and Park District No. 2 as Zone No. 44 to fund various maintenance activities provided by the City.

After annexing Zone 44 to Landscaping, Lighting, and Park District No. 2, the City Council and Planning Commission identified the need for a financing mechanism for maintenance and services on improvements related to new development within the City. In response, the City Council formed Community Facilities District 2020-1 (the "CFD") and approved the levy of special taxes therein. The CFD provides funding for services including, but not limited to, the maintenance of landscaped areas, parkways, and median improvements throughout the CFD, and the maintenance and servicing of streetlights, traffic signals, and appurtenant facilities (the "Services").

The property owner of Tract 38202 has petitioned the City to annex its territory into the CFD, in lieu of levying special assessments under Landscaping, Lighting, and Park District No. 2. As such, the territory needs to be detached from Landscaping, Lighting, and Park District No. 2 so that only one financing mechanism is in place to fund the Services.

FISCAL IMPACT:

Detaching the territory from Landscaping, Lighting, and Park District No. 2 will have a beneficial impact on the City’s General Fund, as the territory is annexing into the CFD to fund similar services. This action is anticipated to result in full cost recovery, whereas no action would have resulted in partial cost recovery.
