Packet Pg. 139 Attachment: Warrant Register January 2025 (Warrants and Disbursements - January 2025) February 18, 2025
TO: City Council
REQUESTED BY: Erika Gomez, Finance Director
APPROVED BY: Robert A. Johnson, City Manager
SUBJECT: Proposed Ordinance to Update Participation in the TUMF Program RECOMMENDATION:

Staff recommends that the City Council conduct the second reading and adopt Ordinance No. 24-14, amending and updating the City’s TUMF Ordinance:

AN ORDINANCE OF THE CITY OF SAN JACINTO AMENDING AND
SUPERSEDING ORDINANCE NO. 19-14 TO UPDATE PARTICIPATION IN THE

WESTERN RIVERSIDE COUNTY TRANSPORTATION UNIFORM MITIGATION FEE (TUMF) PROGRAM.

BACKGROUND:

The City is a Member Jurisdiction of the Western Riverside Council of Governments (“WRCOG”), a joint powers agency comprised of the County of Riverside and eighteen (18) cities located in Western Riverside County. Acting in concert, in 2002-2003, the WRCOG Member Jurisdictions developed a plan whereby the shortfall in funds needed to enlarge the capacity of the Regional System of Highways and Arterials due to new development in Western Riverside County could be made up in part by a Transportation Uniform Mitigation Fee (“TUMF”) on future residential, commercial and industrial development.

As a Member Jurisdiction of WRCOG and as a TUMF Participating Jurisdiction, the City participated in the preparation of a certain “Western Riverside County Transportation Uniform Fee Nexus Study,” (“2002 Nexus Study”) later adopted by the WRCOG Executive Committee.

Based on the 2002 Nexus Study, the City adopted and implemented an ordinance authorizing the City’s participation in a TUMF Program.

Pursuant to the Mitigation Fee Act (Gov. Code §§ 66000 et seq.), WRCOG has prepared a new nexus study (“2024 Nexus Study”) to update the fees. On September 9, 2024, the WRCOG Executive Committee reviewed the 2024 Nexus Study and recommended TUMF Participating Jurisdictions update fees by amending applicable TUMF ordinances to reflect changes in the TUMF network and the cost of construction.

DISCUSSION:

The proposed Ordinance provides the legal basis for a revised TUMF schedule. The actual TUMF schedule was established through Resolution 4048.

In accordance with the Mitigation Fee Act, the proposed Ordinance and 2024 Nexus Study: (i) identify the purpose of the revised fees; (ii) identify the use to which the revised fees is to be put, including identification of any facilities to be financed; (iii) determine how there is a reasonable

3.A.5

relationship between the fee’s use and the type of development project on which the fee is imposed; (iv) determine how there is a reasonable relationship between the need for the public facilities and the type of development project upon which the fees are imposed; and (v) determine how there is a reasonable relationship between the amount of the fees and the cost of the public facilities or portion or the public facility attributable to the development on which the fees are imposed.

The resolution established the Fee Schedule for TUMF as follows:

1. $12,380 per single family residential unit 1,800 square feet or less

2. $13,927 per single family residential unit between 1,801 and 2,300 square feet

3. $15,476 per single family residential unit between 2,301 and 2,700 square feet

4. $19,344 per single family residential unit greater than 2,700 square feet

5. $7,816 per multi-family residential unit

6. $2.33 per square foot of an industrial project

7. $7.72 per square foot of a retail commercial project

8. $4.89 per square foot of a service commercial project

9. $2.45 per square foot of a service Class A and B Office FISCAL IMPACT:

There is no fiscal impact to the City, as TUMF fees are directly collected by WRCOG.

TO UPDATE PARTICIPATION IN THE WESTERN

RIVERSIDE COUNTY TRANSPORTATION UNIFORM

MITIGATION FEE (TUMF) PROGRAM
The City Council of the City of San Jacinto, California “(City”) ordains as follows:

Section 1. Title.

This Ordinance shall be known as the “Western Riverside County Transportation Uniform Mitigation Fee Program Ordinance of 2025” (“Ordinance”).

Section 2. Findings.

A. The City is a member agency of the Western Riverside Council of Governments (“WRCOG”), a joint powers agency comprised of the County of Riverside and 18 cities located in Western Riverside County. Acting in concert, the WRCOG Member Agencies developed a plan whereby the shortfall in funds needed to enlarge the capacity of the Regional System of Highways and Arterials in Western Riverside County (the “Regional System”) could be made up in part by a Transportation Uniform Mitigation Fee (“TUMF”) on future residential, commercial and industrial development.

A map depicting the boundaries of Western Riverside County and the Regional System is attached here as Exhibit “A” and incorporated herein. As a Member Agency of WRCOG and as a TUMF Participating Jurisdiction, the City participated in the preparation of a certain “Western Riverside County Transportation Uniform Fee Nexus Study,” dated October 18, 2002 (the “2002 Nexus Study”) prepared in compliance with the Mitigation Fee Act (Gov. Code §§ 66000 et seq.) and adopted by the WRCOG Executive Committee. Based on the 2002 Nexus Study, the City adopted and implemented an ordinance authorizing the City’s participation in a TUMF Program.

B. In 2016, the TUMF Nexus Study (“2016 Nexus Study”) was updated for the purpose of updating the fees. On July 10, 2017, the WRCOG Executive Committee reviewed the 2016 Nexus Study and TUMF Program and recommended TUMF Participating Jurisdictions amend their applicable TUMF ordinances to reflect changes in the TUMF network and the cost of construction in order to update the TUMF Program.

C. On September 5, 2017 the City adopted Ordinance No. 17-05 which adopted the 2016 Nexus Study and updated the TUMF.

3.A.5.a
Packet Pg. 142 Attachment: Ordinance No. 24-14 (Proposed Ordinance to Update Participation in the TUMF Program) Ordinance No. 24-14
D. In 2018, the TUMF Program was altered to adopt a process in which WRCOG calculates and collects TUMF on behalf of member agencies under the Western Riverside County Transportation Uniform Mitigation Fee Program Ordinance of 2018.

E. The City adopted Ordinance No. 19-14 on August 6, 2019, allowing WRCOG to calculate and collect TUMF on behalf of the City.

F. WRCOG, with the assistance of TUMF Participating Jurisdictions, has prepared an updated nexus study entitled “Transportation Uniform Mitigation Fee Nexus Study: 2024 Update” (“2024 Nexus Study”) pursuant to California Government Code sections 66000 et seq. (the Mitigation Fee Act), for the purpose of updating the fees.

On September 9, 2024, the WRCOG Executive Committee reviewed the 2024 Nexus Study and TUMF Program and recommended TUMF Participating Jurisdictions amend their applicable TUMF ordinances to reflect changes in the TUMF network and the cost of construction in order to update the TUMF Program.

G. Consistent with its previous findings made in the adoption of Ordinance No. 19-14, the City Council has been informed and advised, and hereby finds, that if the capacity of the Regional System is not enlarged and unless development contributes to the cost of improving the Regional System, the result will be substantial traffic congestion in all parts of Western Riverside County, with unacceptable Levels of Service. Furthermore, the failure to mitigate growing traffic impacts on the Regional System will substantially impair the ability of public safety services (police and fire) to respond and, thus, adversely affect the public health, safety and welfare. Therefore, continuation of a TUMF Program is essential.

H. The City Council finds and determines that there is a reasonable and rational relationship between the use of the TUMF and the type of development projects on which the fees are imposed because the fees will be used to construct the transportation improvements that are necessary for the safety, health and welfare of the residential and non-residential users of the development in which the TUMF will be levied.

I. The City Council finds and determines that there is a reasonable and rational relationship between the need for the improvements to the Regional System and the type of development projects on which the TUMF is imposed because it will be necessary for the residential and non-residential users of such projects to have access to the Regional system. Such development will benefit from the Regional System improvements and the burden of such developments will be mitigated in part by payment of the TUMF.

J. The City Council finds and determines that the cost estimates set forth in the new 2024 Nexus Study are reasonable cost estimates for constructing the Regional System improvements and the facilities that compromise the Regional System, and that the amount of the TUMF expected to be generated by new development will not exceed the total fair share cost to such development.

K. The fees collected pursuant to this Ordinance shall be used to help pay for the design, planning, construction of and real acquisition for the Regional System improvements and its facilities as identified in the 2024 Nexus Study. The need for the improvements and facilities is related to new development because such development results in additional traffic and creates the demand for the improvements.

L. By notice duly given and published, the City Council set the time and place for a public hearing on the 2024 Nexus Study and the fees proposed thereunder and at least fourteen (14) days prior to this hearing, the City Council made the 2024 Nexus Study available to the public.

M. At the time and place set for the hearing, the City Council duly considered data and information provided by the public relative to the cost of the improvements and facilities for which the fees are proposed and all other comments, whether written or oral, submitted prior to the conclusion of the hearing.

N. The City Council finds that the 2024 Nexus Study proposes a fair and equitable method for distributing a portion of the unfunded costs of improvements and facilities to the Regional system.

O. The City Council hereby adopts the 2024 Nexus Study and its findings.

The 2024 Nexus Study is attached and incorporated herein as Exhibit “B.” P. The City Council hereby adopts this Ordinance to amend and supersede the provisions of Ordinance No. 19-14.

The City Council finds that this Ordinance is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. In the alternative, and if a project, this Ordinance is exempt under State CEQA Guidelines section 15061(b)(3), the common sense exemption, because it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF

SAN JACINTO AMENDING THE APPLICABLE

TRANSPORTATION UNIFORM MITIGATION FEE (TUMF)

APPLICABLE TO ALL DEVELOPMENTS IN THE CITY OF SAN

JACINTO
WHEREAS, the City of San Jacinto (“City”) is a member agency of the Western Riverside Council of Governments (“WRCOG”), a joint powers agency comprised of the County of Riverside and seventeen cities located in Western Riverside County; and WHEREAS, the member agencies of WRCOG recognized that there was insufficient funding to address the impacts of new development on the regional system of highways and arterials in Western Riverside County (the “Regional System”); and WHEREAS, in order to address this shortfall, the member agencies formulated a plan whereby a transportation mitigation fee would be assessed on new development and would be used to fund the necessary improvements for the Regional System; and WHEREAS, in furtherance of this plan, the WRCOG Executive Committee adopted the “Western Riverside County Transportation Uniform Fee Nexus Study”, dated October 18, 2002 (the “2002 Nexus Study”); and
WHEREAS, based on the 2002 Nexus Study, the City adopted Ordinance No. 03-03 on April 3, 2003 (the “TUMF Ordinance”) pursuant to California Government Code sections 66000 et seq. authorizing the City to impose the Transportation Uniform Mitigation Fee (“TUMF”) upon new development; and
WHEREAS, in 2016, the TUMF Nexus Study (“2016 Nexus Study”) was updated for the purpose of updating the fees. On July 10, 2017, the WRCOG Executive Committee reviewed the 2016 Nexus Study and TUMF Program and recommended TUMF Participating Jurisdictions amend their applicable TUMF ordinances to reflect changes in the TUMF network and the cost of construction in order to update the TUMF Program; and
WHEREAS, on September 5, 2017, the City adopted Ordinance No. 17-05 which adopted the 2016 Nexus Study and updated the TUMF; and
WHEREAS, in 2018, the TUMF Program was altered to adopt a process in which WRCOG calculates and collects TUMF on behalf of member agencies under the Western Riverside County Transportation Uniform Mitigation Fee Program Ordinance of 2018; and

3.A.5.b
Packet Pg. 157 Attachment: Resolution No. 4048 (Proposed Ordinance to Update Participation in the TUMF Program) WHEREAS, the City adopted Ordinance No. 19-14 August 6, 2019, allowing WRCOG to calculate and collect TUMF on behalf of the City; and WHEREAS, WRCOG, with the assistance of TUMF Participating Jurisdictions, has prepared an updated nexus study entitled “Transportation Uniform Mitigation Fee Nexus Study: 2024 Update” (“2024 Nexus Study”) pursuant to California Government Code sections 66000 et seq.

WHEREAS, consistent with its previous findings made in the adoption of Ordinance No. Furthermore, the failure to mitigate growing traffic impacts on the Regional System will substantially impair the ability of public safety services (police and fire) to respond and, thus, adversely affect public health, safety, and welfare. Therefore, continuation of a TUMF Program is essential.

WHEREAS, the City Council finds and determines that there is a reasonable and rational relationship between the use of the TUMF and the type of development projects on which the fees are imposed because the fees will be used to construct the transportation improvements that are necessary for the safety, health, and welfare of the residential and non-residential users of the development in which the TUMF will be levied.

WHEREAS, the City Council finds and determines that there is a reasonable and rational relationship between the need for the improvements to the Regional System and the type of development projects on which the TUMF is imposed because it will be necessary for the residential and non-residential users of such projects to have access to the Regional system. Such development will benefit from the Regional System improvements and the burden of such developments will be mitigated in part by payment of the TUMF.

WHEREAS, the City Council finds and determines that the cost estimates set forth in the new 2024 Nexus Study are reasonable cost estimates for constructing the Regional System improvements and the facilities that compromise the Regional System, and that the amount of the TUMF expected to be generated by new development will not exceed the total fair share cost to such development.

WHEREAS, the fees collected pursuant to the TUMF Ordinance shall be used to help pay for the design, planning, construction of, and real acquisition of the Regional System improvements and its facilities as identified in the 2024 Nexus Study. The need for the improvements and facilities is related to new development because such

3.A.5.b
Packet Pg. 158 Attachment: Resolution No. 4048 (Proposed Ordinance to Update Participation in the TUMF Program) development results in additional traffic and creates the demand for the improvements.

WHEREAS, by notice duly given and published, the City Council set the time and place for a public hearing on the 2024 Nexus Study and the fees proposed thereunder and at least ten (10) days prior to this hearing, the City Council made the 2024 Nexus Study available to the public.

WHEREAS, at the time and place set for the hearing, the City Council duly considered data and information provided by the public relative to the cost of the improvements and facilities for which the fees are proposed and all other comments, whether written or oral, submitted prior to the conclusion of the hearing.

WHEREAS, the City Council finds that the 2024 Nexus Study proposes a fair and equitable method for distributing a portion of the unfunded costs of improvements and facilities to the Regional system.

WHEREAS, section Section 4.C. of Ordinance No. 24-14 authorizes periodic review and adjustment to the applicable TUMF in accordance with any adjustments made by the WRCOG Executive Committee; and

SUBJECT: Lennar Canterwood TR 38202 Grading Agreement
RECOMMENDATION:

Staff recommends that the City Council approve the Grading, Erosion, and Sediment Control Security Agreement for Lennar Homes of California for the development of Tract 38202 - Canterwood, north of Cottonwood Avenue, east of Marilyn Drive, east of N Lyon Avenue and south of Monte Vista Middle School.

DISCUSSION:

On January 16, 2024, the City Council approved the development application for Tract 38202.

Subsequent to the approval, the developer, Lennar Homes of California (“Developer”), prepared the project’s Grading, Erosion, and Sediment Control Plans.

The Developer is proposing to complete the grading and installation of the erosion and sediment control provisions and, as such, is responsible for posting the security and agreement.

The City Engineer’s office reviewed the cost estimate, and the City Attorney’s office completed its review of the attached agreements and recommends Council approval.

FISCAL IMPACT:

All costs associated with the completion of improvements are the responsibility of the developer.

REQUESTED BY: Arthur Mullen, Chief of Public Utilities
APPROVED BY: Robert A. Johnson, City Manager
SUBJECT: Fourth Amendment to Landscape and Irrigation Maintenance Agreement with Inland Empire Landscape
RECOMMENDATION:

Staff recommends that the City Council:

1. Authorize the City Manager to execute the Fourth Amendment to the Landscape and Irrigation Maintenance Agreement for Inland Empire Landscape, extending service through March 1, 2026, in the amount of $1,686,290.05 annually

2. Authorize the recently accepted addendums for CFD 2020-1 and LLPD2 zones at an annual cost of $624,961.32.

3. Authorize a 2.29% CPI increase in the amount of $37,151.53, effective March 1, 2025.

DISCUSSION:

In October 2018, the City posted a Request for Proposals (“RFP”) for Citywide Landscape and Irrigation Maintenance covering over 150 acres of parks, parkways, and City Rights-of-ways.

On January 22, 2019, the San Jacinto City Council approved two contracts to provide landscape and irrigation maintenance; one of these contracts was awarded to Inland Empire Landscape in the annual amount of $406,641.96 (“Agreement”). The other was with Executive Image for $235,680. The contract was effective on March 1, 2019, for an initial three-year term with five possible one-year extensions.

On January 3, 2022, the San Jacinto City Council authorized the First Amendment to the 2019 Landscape and Irrigation Maintenance Agreement with Inland Empire Landscape to provide landscaping and irrigation maintenance for a not to exceed annual amount of $524,013.96 (“First Amendment”).

On February 7, 2023, the San Jacinto City Council authorized the Second Amendment to the 2019 Landscape and Irrigation Maintenance Agreement with Inland Empire Landscape to include additional landscaping and irrigation maintenance services at Mountain Avenue West Recharge Facility and various LLPD2 zones and allow a one-year extension for a not to exceed annual amount of $652,665.96 (“Second Amendment”).

On February 6, 2024, the San Jacinto City Council authorized the termination of the Landscape and Irrigation Maintenance Agreement with Executive Image and executed the Third Amendment to the Landscape and Irrigation Maintenance Agreement with Inland Empire Landscape to include the areas of responsibility previously held by Executive Image. As a result,

3.A.7
Packet Pg. 179
the Inland Empire Agreement was extended one year for a not to exceed the annual amount of $1,078,423.61, which included a 4.8% consumer price index (CPI) increase (“Third Amendment”).

The current contract is set to expire on March 1, 2025. To avoid service interruption and ensure ongoing maintenance, staff recommends that the City Council approve a Fourth Amendment to the Agreement extending service through March 1, 2026.

In addition, the proposed Fourth Amendment incorporates additional work for areas of the City that have recently been accepted for long-term maintenance, as listed below for the CFD 2020-1 and LLPD2 zones at an annual cost of $624,961.32.
• Addendum # ACC – Ano Court Basin - $2,745 per month
• Addendum # ZQBPP – Qeweewish Basin and Booster Station - $4,589.59 per month • Addendum # CFWTU – Cottonwood Frontage by Paseo Park - $9,361 per month • Addendum # CAUA – Cottonwood and Upperline - $997.00 per month • Addendum # Z53HU – Hunal Circle Basin - $10,360.27 per month • Addendum # SPWGB – White Gate/Basin and East Side Vernon - $6,764 per month • Addendum # SPCLBF – Camino Los Baños Frontage - $454 per month • Addendum # 7ACPB – Seven Acre Park and Basin - $13,813 per month • Addendum # Z55JBF – Julian Park Basin and Frontages $2,996.25 per month Staff further recommends including a 2.29% CPI increase of $37,751.53 to the Landscape and Irrigation Maintenance Agreement.

If approved by the City Council, the Fourth Amendment will have a total, not to exceed, annual amount of $1,686,290.05.

FISCAL IMPACT:

The LLPD1 zone generates funding through annual levies on the Riverside County property tax roll, but since there has been no escalation allowed of these levies since the 1980s, excess expenditures are subsidized by the General Fund. The FY 2024-2025 budget includes all projected expenditures for LLPD1.

In contrast, LLPD2 and CFD 2020-1 zones generate enough independent funding through annual levies on the Riverside County property tax roll. These assessments ensure that each zone remains financially self-sustaining, with revenues covering all associated maintenance and operational costs. The FY 2024-2025 budget includes all projected expenditures for LLPD2 and CFD 2020-1 zones, with no fiscal impact on the General Fund.

TO: City Council
REQUESTED BY: Stuart McKibbin, City Engineer
APPROVED BY: Robert A. Johnson, City Manager
SUBJECT: Subdivision Agreement - Lennar Tract 38202 - Canterwood RECOMMENDATION:

Staff recommends that the City Council approve the Subdivision Improvement Agreements for Lennar Homes of California (“Developer”) specific to Tract 38202 in substantially the form set forth in the accompanying agreements and authorize the City Manager to execute any other documents necessary to implement said agreements.

DISCUSSION:

On June 12, 2021, the Developer submitted an application for approval of tentative tract map 38202 (the "Tract") to the City for review by the City Engineer. The Developer’s application for a tentative parcel/tract map for the Tract was deemed complete on January 16, 2024. The Tract represents a residential project consisting of 181 residential lots.

As per Sections 13.1 and 13.2 of the agreements, the Developer shall provide the City with security bonds in the amount based on the Engineer's approximation of the actual cost to construct the applicable public improvements. The California Subdivision Map Act (Gov. Code §§ 66410 et seq.) permits various forms of security. In this case, the Developer has opted to place traditional bonds as a form of security.

Pursuant to Chapter 16.24 of the San Jacinto Municipal Code and the applicable provisions of the Subdivision Map Act, the Developer, and City shall enter into these Agreements for the timely construction and completion of the public improvements and the furnishing of the security.

The Developer's execution of this agreement and the provision of the security are made in consideration of the City's approval of the final map for Tracts 38202.

FISCAL IMPACT:

Approval of this agreement will not impact the General Fund. All costs associated with the completion of the conditioned public improvements are the responsibility of the Developer.
