REQUESTED BY: Stuart McKibbin, City Engineer
APPROVED BY: Robert A. Johnson, City Manager
SUBJECT: Warren Road Minor Drainage Improvement Project (SJ-507) (CIP# 24- 002)
RECOMMENDATION:
Staff recommends the City Council take the following actions:
. Appropriate $298,605 from Fund 39, Flood Control, for the Warren Road Minor Drainage Improvements Project until RCFCD reimbursement agreement is executed.
DISCUSSION:
The City of San Jacinto and KB Home Coastal Inc. came to an agreement that KB Home Coastal Inc. would provide a $162,500 fair share contribution in lieu of constructing drainage improvements as a part of their conditions of approval. Riverside County Flood Control District (RCFCD) agreed to fund the remaining costs for the construction of this drainage channel.
On January 7th,2025, the City Council awarded the construction contract for the Warren Road Minor Drainage Improvement Project (SJ-507) (CIP# 24-002) to Wright Construction Engineering, Inc. At that time, the City had not yet finalized its agreement with RCFCD. The staff report stated that the RCFCD funding agreement would come back to the City Council at an upcoming meeting.
While RCFCD is committed to providing the necessary funding for this project, in subsequent discussions with RCFCD it has become apparent that the execution of the agreement would not occur before the contractor starts work.
Therefore, to bridge the funding gap until the funding agreement with RCFCD is executed, Engineering recommends the City Council appropriate $298,605 from Fund 39, Flood Control, to Warren Road Minor Drainage Improvement Project (CIP# 24-002). The Flood Control fund would be backfilled by RCFCD after execution of the funding agreement.
FISCAL IMPACT:
Approval of this item will not ultimately impact the General Fund. The existing developer funds supplemented by RCFCD funds are sufficient to fund construction, construction contingencies, administration, and inspection.

REQUESTED BY: Arthur Mullen, Chief of Public Utilities
APPROVED BY: Robert A. Johnson, City Manager
SUBJECT: Administrative Services Agreement with the County of Riverside for County Service Area 152 NPDES Pro
RECOMMENDATION:
Staff recommends that the City Council approve a five-year Administrative Services Agreement with two (2) two-year renewal options with the County of Riverside for the administration of County Service Area 152 (CSA152) National Pollutant Discharge Elimination System (NPDES).
DISCUSSION:
At the request of the City of San Jacinto (“City”), the County of Riverside adopted, on December 6, 1994, Resolution No. 94-411. This resolution annexed the City to its County Service Area 152 to partially fund the costs of maintaining and operating the City’s Municipal Separate Storm Sewer System (MS4) and to comply with the requirements set forth in the NPDES Permit. This permit includes stormwater discharge requirements from the Riverside County Flood Control and Water Conservation District for incorporated Cities of Riverside County (“County”) within the Santa Ana Region (NPDES No. CAS 618033).
Under the NPDES Permit, the City is required to monitor, inspect, and clean the City’s storm drainage system in an effort to prevent unauthorized and potentially hazardous discharge into the San Jacinto River as a tributary to the Santa Ana River and to carry out programs and activities to maintain compliance with the NPDES Permit.
The City desires to continue the proactive implementation and subsequent renewals of the NPDES Permit requirements imposed upon the City. Participation in “CSA 152” provides partial funding for the City’s obligations under the NPDES program and reduces the impact of the NPDES program upon the General Fund.
The Administrative Services Agreement with the County establishes individual responsibilities and requirements by each party. The term of the agreement is five years with an estimated cost of $67,500 and includes two (2) two-year renewal options with an estimated cost of $54,000.
Staff recommends that the City Council authorize the City Manager to execute the five-year agreement with two (2) two-year renewal options.
FISCAL IMPACT:
There is no impact to the General Fund. The City will receive funding net of expenses totaling approximately $1,903,500 over nine (9) years (or about $211,500 per year) to offset the cost of complying with the requirements set forth in the NPDES Permit.

TO: City Council
REQUESTED BY: Arthur Mullen, Chief of Public Utilities
APPROVED BY: Robert A. Johnson, City Manager
SUBJECT: Resident Complaint Regarding Tree Removal Request RECOMMENDATION:
Staff recommends that the City Council provide direction to the City Manager on how to resolve the resident complaint regarding a tree removal request.
BACKGROUND:
A resident has submitted multiple complaints over the course of four years requesting the removal of two Afghan Pine trees located in the public parkway adjacent to her property in the Center Channel of Rancho San Jacinto, along Esplanade Avenue between Villines Avenue and Meridian Street. While the resident has expressed concerns regarding the trees, the reasons stated do not align with the conditions outlined in the municipal code for removal.
ANALYSIS:
Municipal Code 12.20.060, Section 2, grants the Superintendent of Public Works the authority to remove trees or shrubs from parkways only under specific conditions, including:
• If the tree is dead, diseased, damaged, or in a dangerous condition. • If the tree interferes with the construction or removal of buildings. • If the tree interferes with the alignment or realignment of streets, highways, alleys, or driveways within the city.
Upon inspection, Public Utilities staff determined that the trees are in good health, do not pose a danger to the public or infrastructure, and do not obstruct any current or planned construction or realignment projects. City staff has spent a considerable amount of time communicating with the resident to no avail and has expended funds to determine the health of the tree.
A certified arborist has confirmed that the trees are healthy and well maintained, and each tree is valued at $9,830 for a total of $19,660 for both trees. Removing the trees would cost the City approximately $5,920.
NEED FOR DIRECTION:
Given that the requests do not meet the criteria for removal from the Public Utilities Department, staff requires direction from the City Council on how to proceed. Denying the request aligns with municipal code and urban forestry policies, which have been shared with the resident several times, while approving the removal would require an exception to existing regulations.
4.1 Packet Pg. 15
As this was not an item in the Approved Budget for FY 24/25, if the removal is approved, the $5,920 expense would be allocated to the Rancho San Jacinto section of LLPD #1, thereby increasing the subsidy of that fund from the General Fund’s unallocated Fund Balance.
OPTIONS FOR DISCUSSION:
1. Deny the request in accordance with municipal code 12.20.060 Section 2 and direct the City Manager to send a formal letter to the resident of the City Council’s decision.
2. Approve the resident’s request and direct the City Manager to have staff proceed with removal, as well as increase LLPD #1 budgeted appropriations by $5,920.
FISCAL IMPACT:
There is no fiscal impact if the request is denied.
However, if the removal is granted by the City Council, an additional budgeted appropriation in the sum of $5,920 would be approved for the LLPD #1 budget, subsidized by the General Fund.

REQUESTED BY: Robert Johnson, City Manager
APPROVED BY: Robert A. Johnson, City Manager
SUBJECT: International Council of Shopping Centers (ICSC) 2025 RECOMMENDATION:
Staff recommends that the Mayor appoint and authorize travel requests for up to two City Councilmembers to attend the International Council of Shopping Centers (ICSC) Real Estate Convention (RECON), Las Vegas, on May 18-20, 2025.
DISCUSSION:
Founded in 1957, the International Council of Shopping Centers (ICSC) is the leading shopping center industry trade association with over 70,000 members located throughout 100 countries.
ICSC is a global convention, which will be held May 18-20, 2025 in Las Vegas. With approximately 40,000 attendees and over 1,000 exhibitors, RECON is the largest gathering of retail estate professionals in the United States.
Approximately 50 percent of all retail deals are concluded at the annual ICSC event held each May. Consequently, the annual meetings in May in Las Vegas and the October Western Division Conference in Southern California are essential to keep San Jacinto fresh in the minds of retailers and developers as new locations are considered.
Ongoing efforts at these ICSC events have resulted in the attraction of the Dutch Bros Coffee, Popeye’s Louisiana Kitchen, Jersey Mike’s, In and Out, Dollar Tree, Quick Quack Car Wash, Circle K, McDonald’s, Grocery Outlet, and on-going tenant interest and development for seven active commercial project locations in San Jacinto.
In addition, staff has been able to meet with multiple developers regarding various development locations throughout the City of San Jacinto. With ongoing and active commercial activity and the increased residential construction, this has generated increased interest by retail developers and brokers looking for sites along San Jacinto’s main corridors. In order to accommodate the anticipated meeting schedule and to enhance the City’s visibility, the City will continue to have its own booth to host developers and provide maximum exposure to San Jacinto.
Over the last four years, City staff has been able to conduct over 125 scheduled meetings with potential developers and retailers throughout the three-day conference. With meetings held in the City’s booth, San Jacinto attracted attention from additional interested retail and residential developers and others enjoying the conference who were just walking past.
Councilmembers routinely accompany staff at the annual ICSC event and are teamed with staff to handle individual and group meetings. The team effort establishes, builds, cements, and maintains relationships with shopping center developers, retail tenants, and their representatives,
4.2 Packet Pg. 21
to show how engaged the city staff and elected officials are in obtaining new retailers.
The travel requests are being submitted now for City Council consideration in order to take advantage of advance registration rates and hotel accommodations.
Since 2017, the Mayor has had the privilege of appointing two councilmembers to attend the ICSC RECON event in Las Vegas to accompany staff in meeting with retail, commercial, and residential development companies, and many commercial brokerage firms.
Staff requests that the Mayor appoint two councilmembers to attend the event this May 2025.
FISCAL IMPACT:
The estimated cost for each Councilmember to attend is $2,500. This includes the ICSC membership and food and travel related expenses. Conference registration costs are included in the City’s booth registration; therefore individual registration costs are not required. Funds are available in the FY 2024-2025 Budget, Account #010-1100-411-3120 (Conference and Seminars).

SUBJECT: Resolution No. 4065; Adopting the City of San Jacinto Rules of Decorum Policy
RECOMMENDATION:
Staff recommends that the City Council approve Resolution No. 4065:
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JACINTO,
CALIFORNIA, ADOPTING THE CITY OF SAN JACINTO RULES OF DECORUM POLICY
BACKGROUND:
The City Council recognizes a need to establish rules of decorum that will promote a higher degree of efficiency in the performance of its duties while ensuring the free exchange of information and public debate at City Council meetings.
The purpose of the City of San Jacinto Rules of Decorum Policy (the “Policy”) is to promote mutual respect, civility, and orderly conduct among elected and appointed City officials, City staff, and members of the public and to promote and maintain the highest standards of personal and professional conduct in the City's governance.
