In entering into a public works contract or a subcontract to supply goods, services, or materials pursuant to a public works contract, the contractor or Subcontractor offers and agrees to assign to the City all rights, title, and interest in and to all causes of action it may have under Section 4 of the Clayton ct (15 U.S.C. Sec. 15) or under the Cartwright Act (Chapter [commencing with Section 16700] of Part 2 of Division 7 of the Business and Professions Code), arising from purchases of goods, services, or materials pursuant to the Public Works Contract or the Contract or the Subcontract. This assignment shall be made and become effective at the time the Agency tenders final payment to the Contractor, without further acknowledgement by the parties.

FLEET COMPLIANCE CERTIFICATION
Bidder hereby acknowledges that they have reviewed the California Air Resources Board’s policies, rules and regulations and are familiar with the requirements of Title 13, California Code of Regulations, Division 3, Chapter 9, effective on January 1, 2024 (the “Regulation”). Bidder hereby certifies, subject to penalty for perjury, that the option checked below relating to the Bidder’s fleet, and/or that of their subcontractor(s) (“Fleet”) is true and correct:
 The Fleet is subject to the requirements of the Regulation, and the appropriate Certificate(s) of Reported Compliance have been attached hereto.  The Fleet is exempt from the Regulation under section 2449.1(f)(2), and a signed description of the subject vehicles, and reasoning for exemption has been attached hereto.
 Bidder and/or their subcontractor is unable to procure R99 or R100 renewable diesel fuel as defined in the Regulation pursuant to section 2449.1(f)(3). Bidder shall keep detailed records describing the normal refueling methods, their attempts to procure renewable diesel fuel and proof that shows they were not able to procure renewable diesel (i.e. third party correspondence or vendor bids).  The Fleet is exempt from the requirements of the Regulation pursuant to section 2449(i)(4) because this Project has been deemed an Emergency, as defined under section 2449(c)(18). Bidder shall only operate the exempted vehicles in the emergency situation and records of the exempted vehicles must be maintained, pursuant to section 2449(i)(4).
 The Fleet does not fall under the Regulation or are otherwise exempted and a detailed reasoning is attached hereto.

Reasons Why Project Is Exempt:

The proposed project is exempt from environmental review under the California Environmental Quality Act (CEQA) in accordance with the California Code of Regulations, pursuant to State CEQA Guidelines (Cal. Code Regs., § 15000 et seq.). It qualifies for exemption under Section 15061(b)(2) as it falls within several categorical exemptions, including Section 15301 – Existing Facilities, Section 15302 – Replacement or Reconstruction, Section 15303 – New Construction or Conversion of Small Structures, Section 15304 – Minor Alterations to Land, and Section 15332 – In-Fill Development Projects. Additionally, it qualifies for exemption under Section 15061(b)(3) – Common Sense Exemption, as it can be determined with certainty that the project will not have a significant impact on the environment.

The Grand Well and Treatment Plant are intended to replace the aging treatment plant and a recently abandoned well, both located on the same parcel as the existing facilities. The new treatment plant will be situated approximately 100 feet west of an existing two-million-gallon reservoir on a site that has been previously and continuously disturbed. The site does not provide habitat for rare or endangered species. While construction activities will result in short-term noise disruptions, these impacts will be temporary and minimal. Furthermore, there are no sensitive receptors on or near the project site.
