REQUESTED BY: Erika Gomez, Finance Director
APPROVED BY: Robert A. Johnson, City Manager
SUBJECT: LLPD2 Resolution 4076 - Intent Annual Assessments FY 25-26 RECOMMENDATION:

Staff recommends that the City Council approve and adopt Resolution No. 4076, a resolution to levy and collect assessments for LLPD No. 2 Annual Assessments for FY 2025-2026, accepting the Engineer’s Report, and giving Notice of and Setting the Time and Place of the Hearing on the Levy of the Proposed Assessment related to maintenance of public improvements in City of San Jacinto LLPD No. 2 for the FY 2025-2026 Property Tax Roll.

BACKGROUND:

Landscaping, Lighting, and Park District No. 2 (LLPD No. 2) was created pursuant to Part 2 of Division 15 of the California Streets and Highways Code (§22500, et. seq.) The District is divided among the original area and 91 annexation areas called zones, with assessments involving approximately 5,983 parcels. A Resolution of Initiation sets the assessment procedure in action for the FY 2025-2026 tax roll to be adopted on June 17, 2025.

Staff will present, when available, the Engineer’s Report for approval and set a public hearing date for any public input at a subsequent meeting. After public input, City Council may then adopt a resolution confirming the diagram and assessments and authorizing the levy of assessments in LLPD No. 2.

LLPD No. 2 is a post Proposition 218 district. Every year, the maximum assessment rate is increased by the CPI, not to exceed 7.5%, but the actual assessment levies are based on the actual costs incurred to maintain the facilities of the district up to the maximum assessment.

California Streets and Highways Code §22622 requires City Council to adopt a resolution generally describing any proposed new improvements or substantial changes in existing improvements in such a district and ordering the District’s Engineer to prepare and file a report related to annual maintenance and assessment in such a district. The attached Resolution initiates work on the annual assessment district levy required by California Streets and Highways Code, Section 22622.

FISCAL IMPACT:

There is no impact by this action. This action sets the City Council meeting of June 17, 2025, as the date of the public hearing to set the assessments.
