TO: City Council
REQUESTED BY: Erika Gomez, Finance Director
APPROVED BY: Robert A. Johnson, City Manager
SUBJECT: LLPD1 Resolution 4075 - Intent Annual Assessments FY 25-26 RECOMMENDATION:

Staff recommends that the City Council approve and adopt Resolution No. 4075, a resolution to levy and collect assessments within LLPD No. 1 for the Fiscal Year 2025-2026, and give notice of and set the time and place of the hearing on the levy of the proposed assessment.

DISCUSSION:

The Landscaping and Lighting Act of 1972, Part 2 of Division 15 of the Streets and Highways Code, requires that the City annually adopt an engineering report substantiating the need for the levy and assessment, set a public hearing date to accept any public testimony, and set the assessments for the next fiscal year. The amount of the levy on each parcel will remain the same as it was for the fiscal year 2024-2025. Article XIIID of the California Constitution requires approval by the property owners of the District in order to increase the assessments. It is anticipated that the cost of the District will exceed the costs recovered from the levy of assessments. The estimated fiscal year 2025-2026 cost includes a subsidy of approximately $2 million from the General Fund in order to continue the current level of service to the district.

Funding any subsidy would be subject to the availability of funds. The adoption of this Resolution is required in the annual legal procedure to continue the assessment of properties in LLPD No. 1.

FISCAL IMPACT:

There is no impact by this action. This action accepts the Engineer’s report and sets the City Council meeting of June 17, 2025, as the date of the public hearing to set the assessments.
