TO: City Council
REQUESTED BY: Erika Gomez, Finance Director
APPROVED BY: Robert A. Johnson, City Manager
SUBJECT: Code Enforcement Assessment of Time and Materials Tax Roll 25/26 RECOMMENDATION:

Staff recommends that the City Council adopt Resolution No. 4089, confirming the collection and assessment of time and materials resulting from unpaid nuisance abatement costs and administrative citations on the County property tax roll for Fiscal Year 2025-2026.

DISCUSSION:

The City’s Code Enforcement Division has issued administrative citations in response to municipal code violations, and in certain circumstances, has initiated emergency abatement actions to remedy conditions found to exist in land within the City that is considered to be detrimental to public health, safety, or welfare or which interfere with reasonable enjoyment of life or property, and thereby create a public nuisance.

Code Enforcement has provided proper notice to the affected property owners as determined by the Municipal Code, and the Community Preservation Committee (CPC) has reviewed and approved the fines on each of the properties. The list of properties has been reviewed in its entirety at the meeting of the CPC on July 1, 2025.

The attached list identifies parcels with outstanding Administrative Citations and associated abatement actions that remain unpaid as of the preparation of this report. Parcels may be removed from the list if payment is received prior to submission to the County, or through subsequent action by the Community Preservation Committee (CPC).

In accordance with the San Jacinto Municipal Code 8.44.220 and Government Code Sections 38773.5 and 1.28.110, the City is authorized to recover costs related to nuisance abatements and time and materials by placing unpaid charges, excluding the citation amounts, onto the property tax roll. The Code further requires City Council approval prior to submitting the finalized list of qualifying parcels to the County for inclusion on the tax roll.

FISCAL IMPACT:

An estimated $280,209 in nuisance abatement and time and materials costs is proposed for placement on the property tax roll. These recoverable charges, associated with unpaid administrative citations, will serve to offset expenditures incurred by the City's Code Enforcement program. Absent collection, such costs would otherwise be absorbed by the General Fund.
