TO: City Council
REQUESTED BY: Stuart McKibbin, City Engineer
APPROVED BY: Robert A. Johnson, City Manager
SUBJECT: Subdivision Agreement - SanJac 55 & LGI Tr 28224 RECOMMENDATION:

Staff recommends that the City Council approve the Subdivision Improvement Agreement for SanJac 55 and LGI (“Developer”) specific to Tract 28224 in substantially the form set forth in the accompanying agreements, and authorize the City Manager to execute any other documents necessary to implement said agreements.

DISCUSSION:

On September 19, 1995, the City Council of San Jacinto approved Tentative Tract Map No. 28224 for property located within the City limits. On March 13, 2003, the Planning Commission adopted Resolution No. 03-11, amending the conditions of approval associated with the tract.

In accordance with Sections 13.1 and 13.2 of the Subdivision Improvement Agreement, the Developer is required to provide security bonds in an amount determined by the Engineer’s estimate of actual costs to construct the required public improvements. As permitted under the California Subdivision Map Act (Government Code §§ 66410 et seq.), the Developer has elected to use traditional bonding as the form of security.

Pursuant to Chapter 16.80.050 of the San Jacinto Municipal Code and relevant provisions of the Subdivision Map Act, the Developer and the City are entering into a formal agreement to ensure timely construction and completion of the public improvements, supported by the required security.

Execution of these agreements and provision of bonding by the Developer are being made in consideration of the City’s approval of the Final Map for Tract No. 28224.

FISCAL IMPACT:

Approval of this agreement does not impact the General Fund. All costs associated with the completion of the conditioned public improvements are the responsibility of the Developer.
