TO: City Council
REQUESTED BY: Erika Gomez, Finance Director
APPROVED BY: Robert A. Johnson, City Manager
SUBJECT: 2024 Delinquent Solid Waste Tax Roll Placement RECOMMENDATION:
Staff recommends that the City Council:
1. Conduct the public hearing and adopt Resolution No. 4090;
2. Review the report determining the amount of delinquent, unpaid residential solid waste charges billed during the calendar year 2024;
3. Determine that such delinquent charges constitute a special assessment and lien; and
4. Direct that such charges be collected via the Riverside County secured property tax roll.
BACKGROUND:
On June 7, 2022, the City Council approved a Fifth Amendment to the CR&R franchise agreement established in 2005. A provision of this amendment authorized the collection of delinquent solid waste charges through the Riverside County secured property tax roll.
On June 17, 2014, the City Council adopted Ordinance No. 14-08, amending Section 8.32.150 of Chapter 8.32 of Title 8 of the San Jacinto Municipal Code, authorizing the placement of these charges on the tax roll.
DISCUSSION:
At specified intervals, CR&R sends notices to delinquent accounts, including information on tax roll placement. Once an account becomes 90 days delinquent, if the account is held in a name other than the property owner, a letter is sent to the property owner informing them that the delinquent charges are subject to placement on the tax roll. In addition to these routine notices, CR&R sent a Notice of Public Hearing to the affected property owners in June 2025.
CR&R has provided the City with the list of the properties and amounts with 2024 charges that remain unpaid, shown as Exhibit A of Resolution 4090.
FISCAL IMPACT:
This item has no fiscal impact.
