Hi Travis,
I’d like to go over the current draft of the Historical Vehicle Parking Ordinance, as I feel it is far too restrictive and places an unfair burden on property owners and historic vehicle collectors. This draft creates an unequal standard by targeting historical vehicles, while other types of personal or recreational vehicles — such as RVs, boats, and horse trailers — are not subjected to the same level of regulation.
Below are several proposed adjustments I believe would help make the ordinance more fair and reasonable for residents:
G. Historical Commercial Vehicles in Residential Zoning Exemption – To start, it's important to clarify that there is no legal category recognized by the DMV as a "historical commercial vehicle." All historic vehicles are registered as automobiles with a weight rating of zero, and they cannot be used for any commercial activity under current DMV guidelines.
G1i. Permit and Ancillary Fees
– I strongly oppose the imposition of ancillary fees or permits for storing historical vehicles on private property. This is a personal hobby and form of preservation — not a business. Requiring fees creates an unnecessary burden and unfairly targets this specific group of vehicle owners. RVs, boats, and trailers are not subject to such charges, and historic vehicles should not be either.
G1iv. Parcel Size / Vehicle Count
– I respectfully request that the allowance be adjusted to permit two historic vehicles per acre. This would reasonably accommodate the four historic trucks I currently own and maintain, while still providing a scale-based limit tied to parcel size.
2 G1ix. Parking Surface Requirements
– I ask that parking on rock or gravel be recognized as an acceptable surface for historic vehicle storage.
These are stable, low-impact materials that offer practical and environmentally reasonable alternatives to pavement.
G1xi. Screening and Inspections
– These vehicles are stored on private property, and as such, should not be subject to periodic or unannounced inspections. I believe this could violate Fourth Amendment protections against unreasonable searches.
– I am willing to shield the vehicles as reasonably possible using existing fences or buildings. However, I do not support any mandate for total visual obstruction or ongoing compliance inspections for a personal hobby that does not pose a public hazard.
G2. City Registration and Zoning Clearance
– I respectfully oppose the requirement to register historic vehicles with the City’s Community Development Department or to obtain Zoning Clearance prior to parking them on one’s own land. – This requirement is excessive and not consistent with how other personal vehicles are regulated. To my knowledge, no surrounding cities impose this level of review for similar non-commercial vehicle storage.
Requiring site plans, parcel verification, and documentation for property use adds unnecessary red tape and feels like government overreach.
If the ordinance can be revised to be more reasonable in these key areas, I believe we can achieve a fair balance that maintains neighborhood standards while also respecting the rights and interests of vehicle collectors and hobbyists.
I appreciate your time and would be happy to discuss further.
Best regards,
Max Barry
