SUBJECT: JCFA Approval - EMWD CFD 2022-94 Maravilla 28224 RECOMMENDATION:

Staff recommends that the City Council adopt Resolution No. 4093, approving the Joint Community Facilities Agreement as to form between Eastern Municipal Water District and SanJac 55, LLC, for Easter Municipal Water District Community Facilities District No. 2022-94 DISCUSSION:

Eastern Municipal Water District (EMWD) has formed Community Facilities District (CFD) No. 2022-94 pursuant to the provisions of the Mello-Roos Community Facilities Act of 1982. The Board of Trustees for EMWD approved the Resolution of Intention for CFD No. 2022-94 on December 21, 2022, and the Resolution of Formation on March 1, 2023, with a Public Hearing on the types of public facilities or services financed on July 2, 2025. This project is planned for single-family homes within Tract No. 28224. The CFD is located in the City of San Jacinto, south of Seventh Street and East of Mountain Avenue, as depicted on the attached Boundary Map (Exhibit A).

The property owners, SanJac 55, LLC (SanJac 55), along with EMWD, have requested the City of San Jacinto (City) enter into a Joint Community Facilities Agreement with EMWD relating to EMWD CFD No. 2022-94. SanJac 55 is the owner of the property within the CFD boundary.

The CFD will be structured in accordance with the City’s land-secured financing policy, ensuring that the overall effective tax rate does not exceed two percent at the time of bond issuance. The CFD will finance EMWD fees, City development impact fees, and EMWD facility costs in lieu of fees. The City may assume ownership and operation of the City fee facilities financed through this CFD. Additionally, EMWD has agreed that the City’s name will not appear on the property tax roll for any parcels within CFD No. 2022-94.

Resolution No. 4093 (Exhibit B) approving the Joint Community Facilities Agreement (Exhibit C), as to form, will authorize the Mayor and the City Clerk to execute and deliver the Joint Community Facilities Agreement.

FISCAL IMPACT:
