TO: City Council
REQUESTED BY: Travis Randel, Deputy City Manager, Development Services APPROVED BY: Robert A. Johnson, City Manager
SUBJECT: Contract Extension of Right of Way Use Agreement for Wayfinding Signs RECOMMENDATION:

Staff recommends that the City Council authorize the City Manager to execute future extensions permitted in the Right-of-Way Use Agreement for Wayfinding Signs dated June 1, 2021, between the City of San Jacinto and the Building Industry Association of Southern California.

DISCUSSION:

On May 4, 2021, the City Council authorized the City Manager to execute a contract with the Business Industries Association of Southern California (“BIA”) to implement and administer the City’s New Home Kiosk Program (“Program”). The BIA Directional Sign Program has been in existence since the 1980s, providing wayfinding signs for home builders, commercial projects, and apartment communities in over 43 municipalities throughout Southern California, including Beaumont, Calimesa, Covina, Lake Elsinore, Rancho Cucamonga, Upland, Wildomar and the County of Riverside. The BIA operates and manages the sign program from installation to maintenance.

Under the agreement, the BIA administers, manages, operates, and maintains the Program. The Program included the removal of all previous signs constructed by United Communities Network, the City’s former Program administrator, and authorized the placement of new signs, as requested by local developers. The signs are constructed within the public rights-of-way and, therefore, subject to the issuance of an encroachment permit and approval by the City Engineer.

Under the Program, the BIA is responsible for all maintenance, installation, and removal of the signs as well as contracting with local participants, including new homebuilders that would like to lease space on the signs. Unlike the previous program, which required the City to authorize task orders, this program would allow the BIA to remove and install new panels as builders are added or removed from the Program; only a new sign would require City approval.

As part of the Program, the City will receive an allocation of sign panels to be placed throughout the City to provide direction to City facilities such as City Hall, Police Department, Fire Department, Community Center, Estudillo Mansion, etc. The specific allocation and placement would be determined by City Staff in collaboration with the BIA.

Panels on the new home kiosks are limited to City-approved subdivisions, regional entertainment destinations, and city facilities located within the City limits. Subdivisions or regional entertainment destinations located outside of the City will not be eligible to be placed on the kiosk signs.

The original Program Terms were for June 1, 2021, through June 30, 2023. The City has a unilateral option, at its sole discretion, to renew the Program for five additional one-year terms.

On May 7, 2024, the City Council authorized an additional year setting the new expiration date to June 30, 2025. While no directional signs were installed by the BIA during the initial term, the contract was fully executed with the removal of the United Communities Network signs.

FISCAL IMPACT:

There is no fiscal impact to extending the contract.
