SUBJECT: RENEWAL OF RIGHT-OF-WAY USE AGREEMENT FOR WAYFINDING SIGNS Dear Mr. Foster:
As you may know, the Building Industry Association of Southern California (“BIA”) and the City of San Jacinto (“City”) are parties to a certain Right-of-Way Use Agreement for Wayfinding Signs (“Agreement”) dated June 1, 2021. The initial term of the Agreement was from June 1, 2021 to June 30, 2023. However, pursuant to Section 4 of the Agreement, the City has the “unilateral option, at its sole discretion, to renew this Agreement for five additional one-year terms.”
The purpose of this letter is to: (1) confirm that the City has previously exercised the first two of its five one-year renewal options, extending the current expiration date of the Agreement to June 30, 2025; and (2) notify the BIA that, on September 2, 2025, the City Council exercised the third renewal option, thereby extending the term of the Agreement through June 30, 2026.
