TO: City Council
REQUESTED BY: Craig Hayes,
APPROVED BY: Robert A. Johnson, City Manager
SUBJECT: ERRATA TO RESOLUTION NO. 4094 TO INCORPORATE EXHIBITS RECOMMENDATION:

Staff recommends that the City Council adopt the attached Errata Resolution No. 4103 to Resolution of Necessity No. 4094, incorporating Exhibits “1” through “9” (legal descriptions and depictions) into the legislative record.

DISCUSSION:

On September 2, 2025, the City Council adopted Resolution No. 4094, a Resolution of Necessity authorizing the acquisition of permanent road easement interests in portions of certain real property for the San Jacinto Street (Avenue) Safety Improvement Project.

Resolution No. 4094 references Exhibits “1” through “9,” which contain the legal descriptions and depictions of the property interests to be acquired. However, due to a clerical oversight, these exhibits were inadvertently omitted from the version of the Resolution included in the agenda packet and entered into the legislative record.

CONCLUSION:

The omission of the referenced exhibits was clerical in nature and does not affect the validity of the Council’s original action. To ensure the record is complete and legally sufficient for eminent domain purposes, adoption of the Errata Resolution will formally incorporate Exhibits “1” through “9” into Resolution No. 4094.

The Errata Resolution does not modify or alter the findings, determinations, or approvals made by the City Council on September 2, 2025. It simply corrects the record to reflect the Council’s original intent.

Adoption of the Resolution of Necessity will authorize the City to proceed with eminent domain if voluntary acquisitions cannot be completed in time, ensuring that the City can meet federal funding obligations and project construction schedules while safeguarding public health, safety, and welfare.

FISCAL IMPACT:

There is no fiscal impact.
