STATE OF CALIFORNIA ) PC RESOLUTION NO. 25-03
COUNTY OF RIVERSIDE ) ss

CITY OF SAN JACINTO )

A RESOLUTION OF THE PLANNING COMMISSION OF

THE CITY OF SAN JACINTO, CALIFORNIA, FINDING THE

SUMMARY VACATION OF A PORTION OF THE

OOSDTDAM DRIVE RIGHT-OF-WAY TO BE IN
CONFORMANCE WITH THE CITY OF SAN JACINTO’S

GENERAL PLAN
WHEREAS, the City of San Jacinto (“City”) received an application from D.R.

Horton requesting the summary vacation of a portion of Oostdam Drive (“Excess ROW”) in order to comply with the conditions of approval for Tentative Tract Map 38339; and WHEREAS, the segment of Oostdam Drive proposed for vacation was originally constructed as part of Tract 31294, which created 37 lots between Oostdam Drive, Seventh Street, and Ivy Crest Drive, and included a short roadway extension intended to eventually provide an east–west connection between Ivy Crest Drive and Kirby Street; and
WHEREAS, no subsequent development extended Oostdam Drive to Kirby Street, resulting in a partially improved, unused roadway stub west of Wildrose Circle that remained incomplete for nearly twenty years; and
WHEREAS, Tentative Tract Map 38339 introduced a revised circulation system that redirected the east–west neighborhood connection northward through the new subdivision before connecting to Kirby Street, thereby eliminating the need for the original roadway extension shown on Tract 31294; and
WHEREAS, the improvements within the Excess ROW were removed as part of the construction of Tract 38339, the remaining segment was never opened for vehicular access, and the City has determined that this right-of-way is no longer necessary for present or future street or highway purposes; and
WHEREAS, the Excess ROW qualifies for summary vacation under California Streets and Highways Code sections 8330 through 8336, because: (1) the segment has not been used for vehicular travel for five consecutive years and has not been maintained with public funds; (2) the segment has been determined to be excess right-of-way and contains no public facilities requiring retention; and (3) the right-of-way is not required for street or highway purposes due to the revised, approved circulation system; and WHEREAS, pursuant to California Government Code Section 65402(a) and California Streets and Highways Code Section 8313, the Planning Commission is required to review the proposed right-of-way vacation and determine whether the action is in conformance with the City’s General Plan before the City Council may act on the request; and
WHEREAS, notice of the public hearing was provided in accordance with Government Code Section 65090, including mailed notice to property owners within 300 feet of the project site and publication in a newspaper of general circulation, and the matter was duly noticed for consideration by the Planning Commission on December 9, 2025; and
WHEREAS, all other legal prerequisites to the adoption of this Resolution have occurred.

NOW, THEREFORE, BE IT RESOLVED, BY THE PLANNING COMMISSION OF THE CITY OF SAN JACINTO:

SECTION 1. The above recitals set forth above are true and correct and are incorporated herein by this reference.

SECTION 2. General Plan Conformance Findings. The Planning Commission finds that the summary vacation of a portion of Oostdam Drive is in conformance with the Envision San Jacinto General Plan based on the following policies and goals:

Goal HE-2. Provide adequate sites for new residential construction to meet the needs of all segments of the community while promoting the character of the City.

The vacation facilitates the orderly buildout of Tentative Tract Map 38339 and removes an unused roadway stub, improving neighborhood character and supporting efficient residential development.

Policy LU-2.1: Plan for New Development. Ensure that new development corresponds to the provision of infrastructure, public services, and community facilities, and that new development funds and constructs its fair share of improvements.

The improved circulation network within TTM 38339 has been completed, and the excess right-of-way is no longer needed. Vacating the remnant segment ensures the public system contains only necessary improvements consistent with the approved subdivision.

Policy M-1.1: Balanced Circulation System. Provide for a balanced circulation system that promotes the safe and efficient movement of people and goods throughout the City.

The revised circulation system within TTM 38339 provides the appropriate east–west neighborhood connection, rendering the unused segment unnecessary and maintaining a safe, efficient local street network.

Policy M-1.8: Traffic Calming. Encourage programming and design strategies to maintain safe vehicular speeds on roadways, including traffic calming measures, where applicable.

The approved circulation layout for TTM 38339 includes geometric design features that naturally calm traffic, reduce cut-through activity, and enhance neighborhood safety.

Vacating the unused roadway segment supports these design objectives.

Based on these findings, the proposed vacation is consistent with the Envision San Jacinto General Plan and meets the requirements of Streets and Highways Code Section 8313 and Government Code Section 65402.

SECTION 3. Streets & Highways Code Findings. The proposed vacation meets the requirements for summary vacation under California Streets and Highways Code Sections 8330–8336 for the reasons stated in the recitals.

SECTION 4. Public Hearing. The Planning Commission conducted a properly noticed public hearing on December 9, 2025, received all public testimony, and reviewed all evidence presented.

SECTION 5. CEQA. The Planning Commission finds that the proposed summary vacation is exempt from the California Environmental Quality Act (“CEQA”) pursuant to CEQA Guidelines Sections 15061(b)(3) (common-sense exemption) and 15305 (Class 5, Minor Alterations in Land Use Limitations). Further, no subsequent review is required under CEQA Guidelines Section 15162, as the subdivision and related improvements were previously analyzed in the Mitigated Negative Declaration for Tentative Tract Map 38339 and the vacation does not create new or more severe environmental impacts.

SECTION 6. Effective Date. This Resolution shall become effective upon its adoption.

PASSED, APPROVED, AND ADOPTED at a regular meeting of the Planning Commission of the City of San Jacinto on the 9th day of December 2025, by the following vote:
