Ordinance No. 25-07
STATE OF CALIFORNIA ) ORDINANCE NO. 25-07
COUNTY OF RIVERSIDE ) SS
CITY OF SAN JACINTO )
AN ORDINANCE OF THE CITY OF SAN JACINTO AMENDING
SECTION 10.16.210 (COMMERCIAL VEHICLES) OF CHAPTER
16 (PARKING AND TRAFFIC CONTROL) OF TITLE 10
(VEHICLES AND TRAFFIC) OF THE SAN JACINTO MUNICIPAL
CODE, RELATING TO THE REGULATION OF COMMERCIAL
VEHICLE PARKING AND THE ESTABLISHMENT OF A LIMITED
EXEMPTION FOR HISTORIC COMMERCIAL VEHICLES.
WHEREAS, the City of San Jacinto regulates the parking and storage of commercial vehicles to protect public safety, maintain neighborhood character, and promote compatibility among land uses; and
WHEREAS, the City Council has determined that certain historically significant commercial vehicles may be appropriately stored on residential property under limited conditions without adversely affecting surrounding neighborhoods; and
WHEREAS, the City Council finds that replacing existing Section 10.16.210 in its entirety and adopting new provisions will provide clear, enforceable standards for commercial vehicle storage, including a narrowly tailored exemption for Commercial Vehicles that are registered with the California Department of Motor Vehicles as Historic Vehicles; and
WHEREAS, the City Council introduced Ordinance No. 25-07 at its duly noticed public meeting held on August 19, 2025; and
WHEREAS, prior to adoption, the City Council remanded Ordinance No. 25-07 for further review and refinement at its duly noticed public meeting held on September 2, 2025; and
WHEREAS, following such remand and revisions, the City Council introduced this revised Ordinance No. 25-07 for first reading at its duly noticed public meeting held on March 17, 2026; and
WHEREAS, the proposed amendments are consistent with the City’s General Plan and further the public health, safety, and welfare; and WHEREAS, the City Council finds that this Ordinance is not subject to the California Environmental Quality Act (“CEQA”) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the State CEQA Guidelines, as the adoption of this Ordinance Ordinance No. 25-07
will not result in a direct or reasonably foreseeable indirect physical change in the environment and does not constitute a “project” under CEQA; and WHEREAS, the City Council further finds that, pursuant to Section 15061(b)(3) of the State CEQA Guidelines, it can be seen with certainty that the provisions herein will have no potential to cause a significant effect on the environment, and any future activities subject to this Ordinance will remain subject to independent CEQA review, as applicable.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN JACINTO, CALIFORNIA, DOES ORDAIN AS FOLLOWS:
SECTION 1. Incorporation of Recitals. The recitals set forth above are true and correct and are incorporated into this Ordinance.
SECTION 2. Amendment to City’s Municipal Code. Section 10.16.210 of the San Jacinto Municipal Code is hereby repealed in its entirety and replaced with the language set forth in Exhibit “A,” attached hereto and incorporated herein by this reference.
SECTION 3. CEQA. This Ordinance has been evaluated in accordance with the California Environmental Quality Act (CEQA), the State CEQA Guidelines, and the City’s local environmental regulations. The City Council finds that adoption of this Ordinance is not subject to CEQA under Sections 15060(c)(2) and 15060(c)(3) of Title 14 of the California Code of Regulations because it will not result in a direct or reasonably foreseeable indirect physical change in the environment. Specifically, the Ordinance establishes zoning and administrative standards for the storage and parking of certain vehicles and does not authorize any development or physical improvements that would cause an environmental impact.
Furthermore, pursuant to Section 15061(b)(3) of the State CEQA Guidelines, this Ordinance is exempt from CEQA because it can be seen with certainty that the provisions herein would have no potential to cause a significant effect on the environment. Any future activities or development projects subject to the provisions of this Ordinance would remain subject to independent CEQA review, as applicable, prior to approval.
SECTION 4. Severability. If any section, subsection, subdivision, sentence, clause, phrase, or portion of this Ordinance for any reason is held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council hereby declares that it would have adopted this Ordinance, and each section, subsection, subdivision, sentence, clause, phrase, or portion thereof, irrespective of the fact that any one or more sections, Ordinance No. 25-07
subsections, subdivisions, sentences, clauses, phrases, or portions thereof be declared invalid or unconstitutional.
SECTION 5. Publication/Effective Date. This Ordinance shall take effect thirty (30) days after its adoption and, within fifteen (15) days after its passage, shall be published at least once in a newspaper of general circulation published and circulated within the City.
