TO: City Council
REQUESTED BY: Preston Sullens, Superintendent
APPROVED BY: Robert A. Johnson, City Manager
SUBJECT: CSA 152 – Adoption of Resolution No. 4114, Maintaining BAU for FY2025-2026 and FY2026-27
RECOMMENDATION:
Staff recommends that the City Council adopt Resolution No. 4114, maintaining the County Service Area 152 assessment within the City of San Jacinto at the annual rate of $10.00 per Benefit Assessment Unit (BAU) for fiscal years 2026-2027 and 2027-2028 and therefore funding the City’s National Pollutant Discharge Elimination System (NPDES) Permit requirements.
DISCUSSION:
At the request of the City of San Jacinto (“City”), the County of Riverside adopted, on December 6, 1994, Resolution No. 94-411. This resolution annexed the City to its County Service Area (CSA) 152 in order to partially fund the costs of maintaining and operating the City’s Municipal Separate Storm Sewer System (MS4) and to comply with the requirements set forth in the National Pollutant Discharge Elimination System (NPDES) Permit. This permit includes stormwater discharge requirements from the Riverside County Flood Control and Water Conservation District for incorporated Cities of Riverside County within the Santa Ana Region (NPDES No. CAS 618033).
Under the NPDES Permit, the City is required to monitor, inspect, and clean the City’s storm drainage system in an effort to prevent unauthorized and potentially hazardous discharge into the San Jacinto River as a tributary to the Santa Ana River and to carry out programs and activities to maintain compliance with the NPDES Permit.
The City desires to continue the proactive implementation and subsequent renewals of the NPDES Permit requirements imposed upon the City. Participation in CSA-152 provides partial funding for the City’s obligations under the NPDES program and reduces the impact of the NPDES program upon the General Fund.
By adopting this Resolution, the City Council requests the Riverside County Board of Supervisors to maintain the CSA 152 assessments within the City at its current annual rate of $10.00 per BAU for Fiscal Year 2026-27 and Fiscal Year 2027-28, with an effective date of July 1, 2026.
No further increases to the annual rate may occur unless enacted upon through a Proposition 218 process.
FISCAL IMPACT:
The annual assessment of $10.00 per BAU for funding CSA 152 generates approximately $227,702.30 annually from assessments placed on approximately 13,761 units related to properties located throughout the City. Without the CSA 152 levy, funding for the NPDES program would be required from the General Fund.
