RE: Resolution for the Initiation of Proceedings for the Annual Levy of Assessments for Assessment District No. 92-3, (Pursuant to the Landscaping and Lighting Act of 1972)
BACKGROUND
Assessment District No. 92-3 (District) was formed on November 10, 1992 for the purpose of financing maintenance costs for street lighting, streets, public landscaping, and park improvements in the District.
The levy of assessments to property owners in the District occur on an annual basis.

No annexations of property have occurred to the District over the past year therefore there will be no new properties to levy.
RECOMMENDATION
Staff recommends that Council approve the attached Resolution Initiating Proceedingsfor the Annual Levy of Assessments for Assessment District No. 92-3 and to have the City Engineer prepare and file his annual report on the levy.

14 STAFF REPORT TO COUNCIL
April 10, 2023
TO: Mayor and Council
FROM: Matt Flood, Assistant City Manager
SUBJECT: Consideration of Resolution No. 2023-14, exempting Contract City Recreation Providers from paying Business License fees pursuant to San Joaquin Municipal Code 110.03(C)(3)
Recommendation:
Council approval of Resolution No. 2023-14, exempting Contract City Recreation Providers from paying Business License Fees pursuant to San Joaquin Municipal Code 110.03(C)(3).
Executive Summary
The Recreation Department is preparing to provide programming that will offer various educational, cultural, and health benefits to our community. Some of these activities will require contract individuals to provide technical services from coaching and refereeing, to artistry, music, and dance.
The City needs to be able to offer a reasonable stipend in order to attract individuals experienced in providing these services, which would normally necessitate the requirement of possessing a Business License from the City of San Joaquin.
Staff recognizes that the individuals that provide these services will do so on an irregular basis and possibly not very often, while receiving a small stipend in line with current industry rates.
Therefore, staff is requesting that the City Council waive the Business License requirements for those individuals or companies providing these specific recreation services; only requiring a W-9 form from them.
15 RESOLUTION NO. 2023-14
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SAN JOAQUIN EXEMPTING CONTRACT CITY RECREATION
PROVIDERS FROM PAYING BUSINESS LICENSE FEES PURSUANT TO SAN JOAQUIN MUNICIPAL CODE 110.03(C)(3)
WHEREAS, the City Council of the City of San Joaquin has the authority to impose a Business License fee and grant exemptions of such for the benefit of the City; and WHEREAS, the City Council is empowered pursuant to San Joaquin Municipal Code (SJMC) section 110.03 to grant exemptions to the requirements of the Business License regulations; and WHEREAS, the City Council has requested from and supported staff in procuring funding to provide numerous programs for the community’s youth and adults; and WHEREAS, the ratio of planned programs to City staff does not allow permanent employees to provide all of the varied technical program guidance that the City Council would like to see available; and
WHEREAS, staff has determined that the most efficient way to provide these programs is to adhere to one of the industry standard practices, which is the hiring of contractors that would receive a stipend on a per-class or per-event type of basis; and WHEREAS, the SJMC requires all entities doing business within the City of San Joaquin to procure a Business License, which would include the above referenced contractors; and WHEREAS, implementing the full force of law on these contractors would most assuredly render the provision of these services by them cost prohibitive, seriously limiting the City’s ability to provide the desired programming.
NOW THEREFORE, the City Council of the City of San Joaquin resolves as follows:
1. The foregoing recitals are incorporated by reference.
2. The Council makes the following to be statements of finding and fact:
A. The waiver of Business License requirements for Contract Recreation Activities Providers is a broad public benefit to the City of San Joaquin.
B. The City Council is authorized to waive the requirements pursuant to the San Joaquin Municipal Code.
16 3. The City Council does hereby order City Staff to allow the operation within the City of the aforementioned Contractors, for the sole purpose of providing service to the City Recreation Department and with the only requirement being that Contractors provide a valid and actionable W-9 to the appropriate staff.
4. This resolution is effective upon adoption and shall remain in effect until June 30, 2025.
The foregoing resolution was adopted at a regular meeting of the City Council of the City of San Joaquin the 10th day of April, 2023 and passed at said meeting with the following vote:

31 STAFF REPORT TO COUNCIL
April 10, 2023
TO: Mayor and Council
FROM: Matt Flood, Assistant City Manager
SUBJECT: Purchase order and payment for services provided by Rain For Rent to repair Well 5 Recommendation:
Council approve Resolution No. 2023-18, approving purchase order and payment for services provided by Rain For Rent to repair Well 5.
Executive Summary
In January, the City experienced a failure in the motor that runs Well 5. Due to the vital nature of Well 5 in providing water to the community, an executive decision was made to perform the costly repair in order to get it functional as soon as possible.
A local vendor, Rain For Rent, was able to provide a “loaner” motor that would keep the well running while they attempted to expedite the repair of the main motor. The work was completed and Rain For Rent sent an invoice that totals $15,027.31.
Usually these items would need to be brought to the Council for approval before the work was completed, but due to the emergency nature of the work, the decision was made to bring the item to Council as a post-work report and to approve the work on the well motor.
The process used is consistent with the San Joaquin Municipal Code which provides in follows under Section 35.06 except that as noted above staff is coming to Council after the award:
(C) Dollar amount of public project determines process to be used. The dollar amount thresholds provided in this section shall automatically adjust upon the effectiveness of any adjustment notification by the State Controller in accordance with Cal. Public Contract Code § 22020, without the necessity of amending this section or any subdivision herein to reflect any such adjustment.
(1) Public projects of $45,000 or less may be performed by city employees by force account, by negotiated contract, or by purchase order. The contract or purchase order for contracts over $5,000 shall be awarded by the City Council and signed by the Mayor. 32 RESOLUTION NO. 2023-18
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JOAQUIN
APPROVING PAYMENT OF SERVICES PROVIDED BY RAIN FOR RENT TO REPAIR WELL 5
WHEREAS, the City Council of the City of San Joaquin has the authority to authorize expenditures necessary to ensure the health and safety of the community; and WHEREAS, expenses for both planned and unexpected repairs are a normal and recurring element of the management of municipal infrastructure; and WHEREAS, in January, Well 5 had an unexpected failure in the motor, causing the well to cease operating correctly; and
WHEREAS, due to the essential nature of Well 5 to the function of the water distribution system, as well as the importance of providing potable water to protect the health and safety of the residents of San Joaquin, an executive decision was made to perform the repairs in the most expeditious manner available; and
WHEREAS, staff reached out to a local business, Rain For Rent, who was able to provide the needed repairs, as well as a substitute motor that could keep the well running while repairs on the motor were made; and
WHEREAS, the process for public works contracts has been utilized as required by San Joaquin Municipal Code Section 35.06 except that because of the emergency, Council approval is being sought after the work was authorized.
NOW THEREFORE, the City Council of the City of San Joaquin resolves as follows:
1. The foregoing recitals are true and correct and incorporated by reference.
2. The City Council approves the negotiated work and payment to Rain for Rent in the amount of $15,027.31 for the repair of the motor at Well 5.
3. The City Council authorizes the City Manager or designee to execute all documents necessary to ensure payment of the invoice.
