STAFF REPORT
Date: May 2, 2023
To: Honorable Mayor and Members of the San Joaquin City Council From: Mario Gouveia, City Engineer
Reviewed By: Elizabeth Nunez, City Manager
SUBJECT:

Resolution of Intention to Levy and Collect the Annual Assessments for Assessment District No. 92-3 and Set a Time and Place for a Public Hearing (Pursuant to the Landscaping and Lighting Act of 1972),
RECOMMENDATION:

Staff recommends that Council adopt Resolution No. 2023-19 and declare the City’s intention to levy and collect the Annual Assessment for Assessment District No. 92-3, and to hold a public hearing on June 6, 2023 to hear public testimony regarding the assessments.

BACKGROUND:

On November 10, 1992, the San Joaquin City Council adopted Resolution No. 92-31 Initiating Proceedings for the purpose of collecting assessments to defray the cost of maintaining the street lighting, streets, public landscaping, and parks within designated areas in the City of San Joaquin. Each year, the City of San Joaquin (City) levies annual assessments within its Landscaping, Lighting, and Maintenance District (LLMD). The District now encompasses six areas. There have been no annexations this year.

The Engineer’s Report, Resolution of Intention, and public hearing are requirements set forth in Division 15, part 2, of the Streets and Highways Code of the State of California.

DISCUSSION:

On April 4, 2023, City Council initiated proceedings for the annual levy and the City Engineer was directed to prepare the Engineer’s report for the annual levy.

Two meetings are required to complete the annual assessment process. At this regular meeting on May 2, 2023, the City Council will review the draft annual Engineer’s Report detailing the annual assessments and consider the attached Resolution No. 2023-19 declaring the City’s intention to levy and collect the annual assessments. Staff is not seeking adoption of the Engineer’s Report until the second required meeting. The attached resolution sets a public hearing on the proposed levy for June 6, 2023. The public hearing will serve as the second required meeting, and staff will seek Council’s formal adoption of the annual Engineer’s Report at that time.
30 390.02 LLMD 2023-2024
The yearly assessments established for all properties within the District fund the City’s maintenance of streetlight, street, public landscape, and park facilities. The assessments for Areas 1-4 remain unchanged from last year. Assessments for lots in Areas 1 through 4 cannot be raised without a vote of the lot owners per the requirements of Proposition 218. The assessments for Areas 5 and 6 have been adjusted based upon the Consumer Price Index. The Consumer Price Index increased by 5.6% in 2022. The maximum annual CPI adjustment is not to exceed 3%. In accordance with the foregoing limitations, the assessments for fiscal year 2023-2024 will increase by 3.0%.

As required by the Landscaping and Lighting Act of 19723, the preliminary Engineer’s Report for Assessment District No. 92-3 is on file with the City Clerk. The preliminary Engineer’s Report has a full and detailed description of the improvements, the boundaries of the Assessment District and any zones therein, and the proposed assessments upon the assessable lots and parcels of land within the District.

Payment of the assessment will be collected with the property tax. Any excess funds over the actual cost of maintenance and administration at the end of the year will be credited to future assessments, and any deficits may be added to future assessments.

FISCAL IMPACT:

It is anticipated the City will collect approximately $29,626.16 from the City of San Joaquin Landscaping and Lighting Maintenance District No. 92-3 Assessments to cover estimated maintenance, utility and administration expenses for Fiscal Year 2023-2024.

ENGINEER’S REPORT
WHEREAS, on November 10, 1992, the City Council of the City of San Joaquin, California, pursuant to the provisions of the Landscaping and Lighting Act of 1972, California Streets and Highways Code Section 22500 et seq., adopted its Resolution No. 92-31, Resolution Initiating Proceedings for the purpose of collecting assessments to defray the cost of maintaining the street lighting, streets, public landscaping, and parks within designated areas in the City of San Joaquin, more particularly therein described;
WHEREAS, said Resolution Initiating Proceedings directed the Engineer of Work to prepare and file a report in accordance with Article 4 Chapter 1 of the Streets and Highways Code of the State of California, pursuant to Section 22585, including the estimate of costs of improvements and of the incidental expenses in connection therewith, a diagram of the assessment district, and a proposed assessment of the costs of the improvements to which Resolution Initiating Proceedings reference is hereby made for further particulars. The improvements shall consist of the maintenance of all of the street lighting facilities, streets, public landscaping, and parks located in designated areas of the City of San Joaquin.

NOW, THEREFORE, I, Mario B. Gouveia, Engineer of Work of said Assessment District No. 92- 3 by virtue of the power vested in me under said Act and the order of the City Council of the City of San Joaquin, hereby make the following annual levy of assessment in accordance with Article 4, Chapter 3 of the Streets & Highways Code of the State of California to cover the portion of the estimated cost of said work and improvements pursuant to the plans and specifications presently on file with the Clerk of the City of San Joaquin and in the Department of Public Works of the City of San Joaquin and incorporated herein by reference and the costs and expenses incidental thereto to be paid by the assessment district set forth in this Report.

As required by said Act, Assessment Diagram of City of San Joaquin Assessment District No. 92- 3 shows the assessment district and the boundaries of land within said district as they existed at the time of the passage of the Resolution Initiating Proceedings, each subdivision of land having been given a separate number by reference to County of Fresno Tax Assessor's Parcel Number.

I do hereby assess and apportion said total amount of the cost and expenses of the proposed improvement upon the several subdivisions of land liable therefore and benefited thereby all as is more particularly set forth in the assessment roll attached hereto and incorporated herein; and that the numbers of said assessment roll correspond with the numbers upon the referenced County of Fresno Assessor's Parcel Maps. Said assessment is made upon the several subdivisions of land in the district in proportion to the estimated benefits to be received by each subdivision respectively from the improvement. For a more particular description of said property, 34 35
reference is made to the assessment roll and the deeds and maps on file and of record in the office of the County Recorder of Fresno County and to the notes of said Boundary Description as set forth in the map of Proposed Boundaries of City of San Joaquin Assessment District No. 92- 3, contained in this assessment report.

66 STAFF REPORT TO COUNCIL
May 3, 2023
TO: City of San Joaquin Planning Commission
FROM: Elizabeth Nunez, City Manager
SUBJECT: Consideration of Conditional Use Permit No. CUP 23-02 to allow for the establishment of a restaurant including adopting a finding of Categorical Exemption per Section 15332 of the CEQA Guidelines for Ayala.

RECOMMENDATION: Staff recommends that the Planning Commission conduct a public hearing, deliberate, and by motion adopt a Resolution Approving a Conditional Use Permit for Tacos Ayala 1 Inc. for a restaurant located at 21651 W. Manning Avenue.

Executive Summary
Mr. Andres Ayala Higuera (“Applicant”) filed an application for a Conditional Use Permit (“CUP”) to operate a restaurant and serve beer and wine in an existing building on a property located at 21651 W. Manning Avenue. The property has a land use designation of Community Commercial and is zoned Commercial (C). Therefore, it is consistent with the General Plan and Zoning Ordinance. However, the sale of beer and wine requires a CUP. The property is situated in a strip mall northwest of the intersection of W Colorado Avenue and Manning Avenue. Four buildings exist on the site: the proposed project site, a retail store, a restaurant, and a bank. The restaurant would occupy a 2,184 square-foot building.

CEQA Determination
This project is exempt from the California Environmental Quality Act (CEQA) per Article 19.

Categorical Exemptions, Section 15301 Existing Facilities. A Notice of Exemption will be filed per Section 15062.

Background
An application for a Conditional Use Permit was submitted by Applicant on March 20, 2023. The application was determined to be complete on March 21, 2023. The Applicant would be required to agree to the additional conditions of project approval listed below as part of obtaining a Conditional Use Permit. All other City and CEQA requirements for the proposed project have been met.

General Plan Consistency
The San Joaquin General Plan Land Use Element guides the city’s long-range growth and development policy; it establishes citywide standards, goals, and policies, implemented through the City’s zoning ordinances and other pertinent programs. The project site is designated as Community Commercial (CC) by the San Joaquin General Plan. This category includes a broad 67 2
set of commercial uses such as motels, service stations, other auto related sales and services, restaurants and other shops.

The project is consistent with the General Plan because the addition of a commercial restaurant in a currently existing commercial strip mall would be compatible with other commercial businesses within the vicinity and the designation of Community Commercial.

Zoning Ordinance Consistency (SJMC Chapter 154)
The project site is zoned Commercial (C). Pursuant to SJMC Section 154.111 Permitted Uses, the C Zone District permits eating and drinking establishments by right. The C Zone is designed to provide sites for a full range of convenient retail and service uses needed to accommodate San Joaquin residents and visitors. As a commercial restaurant, the proposed project would be consistent with the general intent of the zone district. However, the sale of beer and wine requires a CUP per Section 154.111 of the SJMC.

Required Determinations:

Due to operational characteristics, CUPs are required for certain uses within each zone district in order to minimize impacts upon surrounding uses. In consideration of a CUP, the Planning Commission must make certain findings required by SJMC section 154.022. Following is the required finding language and the proposed Commission Findings that will be part of the proposed resolution:

1. Required Finding. The proposed use will not be contrary to the objectives of the General Plan and any applicable specific plan;
Commission Finding. The proposed project is located within a Community Commercial district which allows a broad set of commercial uses. As a commercial restaurant including the sale of beer and wine, the proposed project would be consistent with the General Plan.

2. The proposed use is allowed within the applicable zoning district and complies with all other applicable provisions of the zoning ordinance and all other chapters of the Municipal Code;
Commission Finding. The project is located within the Commercial District and is a smallscale commercial restaurant. Therefore, it is consistent with the zone district in which it is located as a conditional use per SJMC 154.111 so long as conditions of approval are met.

3. Required Finding. The proposed establishment, maintenance, and operation of the use will not be detrimental to the public health, safety, and welfare of the persons residing or working in the neighborhood of such proposed use, nor will it be detrimental to property and improvements in the neighborhood or city;
68 3
Commission Finding. The project will not be detrimental to public health, safety, or welfare. It is located within an existing commercial strip mall, and other commercial uses are located to the west and east of the project with the north and south of the project being vacant. Hours of operation and conditions of approval limit the types of uses that may be objectionable or detrimental to other permitted uses. The Sheriff’s Department has determined that the proposed use (i) would not be detrimental to the public health, safety, comfort, or welfare and (ii) would not significantly increase the severity of existing law enforcement or public nuisance problems in the area such as an increase in service calls related to public intoxication, vagrancy, or loitering.

4. Required Finding. The CUP has been assessed as required by CEQA; and Commission Finding. This project is exempt from the California Environmental Quality Act (CEQA) per Article 19. Categorical Exemptions, Section 15301 Existing Facilities. A Notice of Exemption will be filed per Section 15062.

5. Required Finding. The site for the proposed use is adequate in size, shape, and location to accommodate the use as it relates to the zoning district for which the use is proposed.

Commission Finding. The project is located within an existing building in a small commercial strip mall, which contains a retail store, a restaurant, and bank; it is also located within a Commercial Zoning District. As proposed, the site plan submitted by the applicant demonstrates the adequacy of the structure in relation to the proposed operation. Staff finds the restaurant use to be compatible with the other surrounding land uses, compatibility with the zone district, and the structure suitable for the proposed project.

Project Conditions of Approval:

The proposed resolution includes the following Conditions of Approval in Exhibit A to the resolution.

1. The building shall not be opened to clients until the premises has been inspected and deemed safe to occupy, as well as all applicable regulations met, as directed by the City Building Inspector and Fire Department, including those related to the placing of signs found in SJMC Chapter 154.022. All other requirements from previous entitlements affecting the site remain enforced, when applicable;

2. Before commencing operations, any regulatory license or permit required by Federal, State, or County government and the City of San Joaquin, including a Business License, must be acquired;

4. Business, including the displaying of products, shall be wholly conducted within the building, with the exception of outdoor dining within owner-permitted and authorized sections of the property and its contiguous places, and ensuring that foot, car, and other legal and allowable traffic is allowed to move freely. Requests for adjustments of these may be made in writing and approval is at the discretion of the Planning Designee;

5. Windows shall remain clean and transparent, with any signs or other promotional image taking up no more than 50% of window space, or less when superseded by a more restrictive regulation, and zero average eye-level viewing space;

7. The business and/or property owner shall keep the property clear of all trash, rubbish, and debris at all times. Dumping of refuse shall be restricted to the refuse containers scheduled to service the site;

8. The business owner or operator shall be responsible for the removal of deterrent behavior including loitering and/or vagrancy in or upon the business site or properties adjacent to the licensed premises. The business owner shall install “No Trespassing” and “No Loitering” signs on the premise to the specifications of the Sheriff’s Department;

9. Landscaping for the business shall be provided by the strip mall operator similar to other properties adjacent to the business;

10. The maximum hours of operation shall not exceed Monday thru Sunday from 8 AM to 9 PM.

11. Failure to comply with the conditions of approval shall be cause for review and possibly modification or revocation to CUP 23-02.

75 REPORT TO COUNCIL
TO: City Council
FROM: Elizabeth Nunez, City Manager
DATE: April 27, 2023
SUBJECT: Consideration of Amendment to Agreement for Legal Services with Montoy Law Corporation
_______________________________________________________________________ RECOMMENDATION:

Adopt resolution approving Amendment No. 1 to agreement for legal services with Montoy Law Corporation adjusting rates.

EXECUTIVE SUMMARY:

The City of San Joaquin has contracted with the Montoy Law Corporation (“Firm”) since 2006 to provide the City with municipal legal services. Since that time, the Firm rates have been adjusted once in 2019.

Ms. Montoy has requested a new adjustment effective July 1, 2023. The resolution attached would approve Amendment No. 1 to the contract for services and increase rates and fees charged to the City of San Joaquin for legal services.

The proposed new rates are competitive in our geographic region and reasonable to keep pace with rising costs experienced by firms who serve the City. See comparable rates under Discussion.

DISCUSSION
The City of San Joaquin has contracted with the Montoy Law Corporation (“Montoy”) since 2006 to provide the City with municipal legal services. Since that time, the firm’s rates have been adjusted once in 2021. The resolution attached, would approve Amendment No. 1 to the contract for services and increase rates charged to the City for legal services. Rates for general services would be increased from $195 to $215 and rates for litigation would be increased from $235 to $260.00.

The proposed rates are competitive in our geographic region and reasonable to keep pace with rising costs. For example, the proposed $215 rate for general services is still less than the rates for general legal services for surrounding cities as reflected below:
• Avenal: $225.00
• Clovis: $235.00
• Chowchilla $240.00
• Coalinga $265.00
76 • Corcoran $245.00
• Del Rey CSD $250.00
• Kerman $215.00
• Madera $235.00

FISCAL IMPACT
As stated, the Firm has not increased rates since 2021 to account for the rising costs of doing business and in recognition of the City’s limited resources available for legal services. The primary hourly fee charged to the City for general legal services will increase from $195/hr. to $215/hr. and litigation would be increase from $235 to $260. The proposed amendment, Exhibit A to the Resolution, details the increased rates which average approximately 10% above the 2021 rates currently in effect.
