STAFF REPORT TO COUNCIL
September 5, 2023
TO: Mayor and Council
FROM: Matt Flood, Assistant City Manager
SUBJECT: Council waive the second reading and consider Ordinance No. 2023-04, amending Section 153.029 of Title XV, Chapter 153 of the San Joaquin Municipal Code relating to the extensions for Tentative Maps.
Recommendation:
Council waive the second reading and consider Ordinance No. 2023-04, amending Section 153.029 of Title XV, Chapter 153 of the San Joaquin Municipal Code relating to the extensions for Tentative Maps.
Executive Summary
A Tentative Map is the first major step an applicant needs to take in order to create an outline for a property they wish to further develop. It is a professionally made visual design that shows how they intend to orient their property. With the approval of a Tentative Map, they are given a time period in which they need to submit a Final Map (which must be substantially similar to the Tentative Map and is a representation of the final way the property will look, since it is recorded with the County).
Sometimes a developer may need additional time to get a Final Map completed and apply for an extension on the Tentative Map. Staff received a request for that recently, and in consulting the San Joaquin Municipal Code (SJMC), noticed that the current code may not conform with State law.
Therefore, staff is bringing forward an ordinance to change this part of the SJMC, which will make it so that applicants can get an extension up to 24 months after the Tentative Map was initially approved, instead of the 12 that is currently in the SJMC. This will also conform the City’s ordinance to the provisions of the Subdivision Map Act. 16 ORDINANCE NO. 2023-04
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
JOAQUIN AMENDING SECTION 153.029 OF TITLE XV, CHAPTER
153 OF THE SAN JOAQUIN MUNICIPAL CODE RELATING TO
EXTENSIONS FOR TENTATIVE MAPS
THE CITY COUNCIL OF THE CITY OF SAN JOAQUIN DOES ORDAIN AS FOLLOWS:
SECTION 1. Section 153.029 of Chapter 153 of Title XV of the San Joaquin Municipal Code is hereby amended to read as follows:
§ 153.029 TIME EXTENSIONS.
The approval or conditional approval of a tentative map shall expire 24 months from the date the map was approved or conditionally approved. The person filing the tentative map may request a two-year extension of the tentative map approval or conditional approval by written application to the Planning Commission, the application shall be filed at least 30 days before the approval or conditional approval is due to expire. The application shall state the reasons for requesting the extension. In granting an extension, new conditions may be imposed and existing conditions may be revised. Up to two additional two-year extensions may be filed. Extensions of tentative map approval or conditional approval shall not exceed an aggregate of six years or as allowed under California Government Code 66452.6. Modification of a tentative map after approval or conditional approval shall not extend the time limits imposed by this section.
SECTION 2. CEQA.
Pursuant to CEQA Guidelines Section 15061(b)(3), also known as the “common sense” exemption, CEQA exempts activities that can be seen with certainty to have no possibility for causing a significant effect on the environment. The Guidelines state in that section that “a project is exempt from CEQA if the activity is covered by the common sense exemption that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA.”
The project meets the above criteria based that the proposed project does not approve a project for construction and only changes the expiration period for tentative tract maps. No physical impacts will occur as the result of this project. Therefore, the project qualifies for the “common sense” exemption.
17 SECTION 3. Effective Date. This ordinance shall become effective thirty days after its adoption.
SECTION 4. Publication. The City Clerk shall certify to the adoption of this Ordinance and cause it to be published in accordance with Government Code Section 36933 or as otherwise required by law.
The foregoing ordinance was introduced at a regular meeting of the City Council of the City of San Joaquin held on August 1, 2023, and was passed and adopted at a regular meeting of the City Council held on September 5, 2023, by the following vote:
