STAFF REPORT FOR OCTOBER 3, 2023, COUNCIL MEETING
TO: Mayor and City Council
FROM: Mario Gouveia, City Engineer
SUBJECT: Adoption of Uncodified Ordinance Establishing Speed Limits for Certain Streets in the City of San Joaquin
RECOMMENDATION:

Staff recommends that the City Council adopt ordinance establishing speed limits for certain streets in the City of San Joaquin.

EXECUTIVE SUMMARY:

The California Vehicle Code (CVC) sets speed laws and prima facie speed limits for State highways and local roads. Prima facie limits are set with a maximum speed limit of 25 miles per hour (mph) on local roads, but a local agency may, on the basis of an Engineering and Traffic Survey (E&TS), establish higher speed limits for the purpose of facilitating the orderly movement of vehicular traffic, and enforce these higher limits where they are indicated by posted speed limit signs. Once these higher limits are established, they may not be revised except on the basis of an E&TS. The E&TS, or speed survey, as commonly called, is valid for a minimum of 7 years, or a maximum of up to 10 years if an evaluation of a registered engineer determines that no significant changes in roadway or traffic conditions have occurred. There are no available records that indicate a previous E&TS for San Joaquin has been performed over the last 10 years. Based on the California Manual of Uniform Traffic Control Devices (MUTCD), any previous speed surveys are now obsolete and must be updated.

The determination to establish speed limits is required to be done by ordinance. Most cities elect to do so by uncodified ordinance. The City Engineer and staff recommend that Council adopt the proposed ordinance which establishes the following speed limits:

Street From To Classification Posted Proposed
9th Street Pine Street Railroad Avenue Collector 25 25
9th Street Railroad Avenue California Avenue Collector NP 25 12th Street Colorado Avenue Arizona Avenue Collector NP 25 Colorado Avenue Manning Avenue 5th Street Arterial 35 35 Colorado Avenue 5th Street western City Limits Arterial 35 40 Main Street Placer Avenue Arizona Avenue Collector 35 45 Main Street Arizona Avenue Railroad Avenue Collector 35 25 Main Street Railroad Avenue Manning Avenue Collector 25 25 Manning Avenue Placer Avenue Colorado Avenue Arterial NP 55 Manning Avenue Colorado Avenue Pine Street Arterial NP 30 21 Manning Avenue Pine Street western City Limits Arterial NP 50 Sutter Avenue Manning Avenue Colorado Avenue Collector NP 55 BACKGROUND:

The City Engineer has prepared the 2023 Engineering and Traffic Survey Report (speed survey study) for the City of San Joaquin in order to maintain the law enforcement’s ability to properly enforce speeding in San Joaquin. This study has been prepared pursuant to both the CVC and MUTCD guidelines for specified time periods for eligible survey data.

National Data and Surveying Services (NDS) was contracted to conduct speed surveys in January 2023 and August 2023 on certain streets within the City limits. The speeds were manually measured using a Radar Speed Device. The measured speeds and other factors such as collision records, roadway characteristics, adjacent land uses, side street traffic, on-street parking, sight distances, pedestrian traffic along roadways without sidewalks were used to determine speed limits for the selected streets as tabulated above and as illustrated on the attached exhibit map.

The NDS traffic data as presented in the speed survey study was analyzed for the 85th percentile speeds which were rounded to the nearest 5MPH increment to establish the recommended speed limits. The 85th percentile values were adjusted up or down to account for other factors affecting vehicle speeds in accordance with the CVC and MUTCD guidelines. The recommended speed limits are based on both measured values and engineering judgement that justify appropriate speeds.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN

JOAQUIN ESTABLISHING SPEED LIMITS FOR CERTAIN

STREETS IN THE CITY OF SAN JOAQUIN
WHEREAS, California Vehicle Code Section 22352 establishes prima facie speed limits for streets; and
WHEREAS, California Vehicle Code Section 22357 provides that whenever a local authority determines upon the basis of an engineering and traffic survey that a speed greater than 25 miles per hour would facilitate the orderly movement of vehicular traffic and would be reasonable and safe upon any street other than a state highway otherwise subject to prima facie limit of 25 miles per hour, the local authority may by ordinance determine and declare a speed limit of 30, 35, 40, 45, 50, 55, or 60 miles per hour or a maximum speed limit of 65 miles per hour, whichever is found most appropriate to facilitate the orderly movement of traffic and is reasonable and safe; and
WHEREAS, according to California Vehicle Code (CVC) Section 40802, a “speed trap” is defined as a section of highway or street with a prima facie speed limit that is not justified by an engineering and traffic survey conducted within the time periods specified and the enforcement of the speed limit involves the use of radar or any other electronic device that measures the speed of moving objects; and
WHEREAS, the evidence of a speeding violation based on the maintenance or use of a speed trap is inadmissible in court per CVC Section 40803; and WHEREAS, in order to establish speed limits and ensure a speed trap is not created, engineering and traffic surveys must be conducted in accordance with California Vehicle Code Section 627 and the California Manual on Uniform Traffic Control Devices (MUTCD); and WHEREAS, the City prepared an engineering and traffic survey for designated City streets and has submitted the 2023 Engineering and Traffic Survey Report (Survey Report) to the City; and

Background
The California Vehicle Code (CVC) requires that all jurisdictions that enforce speed limit regulations with radar speed measuring devices perform studies to justify the posted limits. The code mandates jurisdictions who desire to enforce speed limits that the posted limits correspond to the 85 th percentile range of measured
(surveyed) speeds, unless there are present conditions that warrant restricting speeds lower than the 85th percentile.

The analysis of data is based on the premise that a reasonable speed limit is one that conforms to the behavior of the majority of the motorists, and that by measuring motorists' speeds, one will be able to select a speed limit that is both reasonable and effective. The application of designated vehicle speed limits on public streets is regulated by the CVC and the California Manual of Uniform Traffic Control Devices (CAMUTCD). Speed zoning helps contribute to the orderly movement of traffic by increasing driver awareness of a reasonable speed. The goal of speed zones is to prevent motorists from operating at a wide range of speeds along a roadway segment that could create vehicle conflicts. Speed zoning allows motorists to travel at or near the same speeds.

An Engineering and Traffic Survey Study must be conducted every 5 years per subdivision (c) of CVC 40802 and may be extended to seven years if certain criteria are met. If a registered engineer evaluates the sections of roadways and determines that no significant changes in roadway or traffic conditions have occurred, including but not limited to, changes in adjoining property or land use, roadway width or traffic volumes the study can extend up to a maximum of seven years.

Existing Conditions
National Data and Surveying Services (NDS) conducted speed surveys in January 2023 on 13 roadway segments and one additional roadway segment on August 2023 within the City (see Appendix A). The speeds of vehicles were measured using manual Radar Speed Surveys. The manual Radar Speed Surveys were conducted by NDS at the specified locations listed in Table 1 below and illustrated in Figure 1. Most of the surveys met the minimum vehicle count of 50 per the CAMUTCD guidelines. This data was considered along with other factors, including collision records, roadway characteristics, adjacent land uses, side street traffic, on-street parking, sight distances and pedestrian traffic along roadways without sidewalks. Typically, roadway speed limits are established based upon a combination of these factors along with the measured "critical vehicle speed" usually referred to as the 85th percentile. The measured speed results are tabulated on Table 1.

For the purpose of this evaluation, the measured 85
th percentile speed has been rounded to the nearest 5
MPH integer to determine the recommended speed limits compared to those presently posted. In some cases, a lower or higher speed limit than the measured 85th percentile may be warranted to mitigate present conditions in order to provide an efficient or safer roadway segment. In such cases, it is necessary to provide an engineering recommendation to justify the posted speed limits other than those measured.

Following are the evaluation results for each of the measured roadway segments with conclusions and recommendations.

Status Quo Speed Recommendations
The first category of recommendations shown on Table 2 below are those speed zones where the current posted speed limit and the 85
th percentile speed are consistent. These zones, therefore, are recommended to remain status quo.

Restricted Speed Recommendations
The following zones are recommended to be reduced or to remain at the current posted speed limits although the 85th percentile rule would require an increase of the posted zone of 5 mph or more at any one segment than the recommended zone limits herein. Segment speeds along the following roadways were restricted by a 5 mph increment or more from the 85th percentile based on engineering recommendations and in compliance with CVC Sections 627 and 22358.5. Some of the road segments share jurisdiction with the County of Fresno and it is recommended that City staff work with the County to provide uniform posted speed limits.

Refer to Figure 2 for the recommended modification to the existing posted speed limits and addition of recommended speed zones.

Engineering recommends restricting
the speed limit to the current posted
speed limit within this residential
and commercial zone area. There
are over 13 dwelling units and
business structures fronting the road
segment within a 1/4 mile. A portion
of the segment is within a school
zone area and therefore requires the
speed limit to be 25 mph when
children are present.
25 5 Manning Avenue, Colusa Avenue to Pine

Engineering recommends restricting
the speed limit within this
residential and industrial zone area
to less than the 85th percentile to
match the speed zone for the
adjacent road segment. There are
sidewalk gaps on both sides of the
road segment and Safe Routes to
School improvements have been
completed on a portion of the
segment thereby making the lower
speed desirable.
30 8-9 12th Street, Colorado Avenue to Arizona

Engineering recommends restricting
the speed limit within this primarily
residential zone area to less than the
85th percentile to match the prima
facie speed limit for residential
zones in California. There are over
13 dwelling units and institutional
buildings fronting the road segment
within a 1/4 mile.

12 Manning Avenue, Colorado Avenue to Placer

Engineering recommends restricting
the speed limit to less than the 85th
percentile within this commercial
and industrial zone area. This road
segment is the main thoroughfare
into the City and generates the most
traffic from other routes. Restricting
the speed limit would provide
consistency of driver expectation
approaching urban areas. High
speeds within this zone are a
concern thereby making the lower
speed desirable. This speed limit
would also match the prima facie
speed zone for the adjacent County
road segment.
55 Speed Adjustment Recommendations
The following zones are recommended for modification or implementation based on the results of the speed survey. The calculated 85th percentile speed for these sections resulted in either higher or lower speeds compared to the posted speed limits. Based on a review of the current speed patterns, location conditions, roadway geometry, existing and planned future development it is recommended to increase or reduce the current posted speed limits. Some of the road segments share jurisdiction with the County of Fresno and it is recommended that City staff work with the County to provide uniform posted speed limits.

Refer to Figure 2 for the recommended modification to the existing posted speed limits and addition of recommended speed zones.

MPH
2 Colorado Avenue, 5th Street to Elm Avenue Engineering recommends this adjustment to the current posted
speed limit based on the measured
prevalent speed for this road
segment. This road segment carries
traffic exiting the City and there are
no concerns with development
fronting this segment. Increasing the
existing posted 35 mph speed limit
is therefore warranted.
40 6 Manning Avenue, Pine Street to western city
limits
Engineering recommends the
addition of this speed zone based on
the measured prevalent speed for
this road segment. This road
segment carries traffic exiting the
City and there are no concerns with
development fronting this segment.

Implementing a speed zone of 50
mph is therefore warranted.
50 7 Main Street, Manning Avenue to Arizona
Avenue
Engineering recommends this
adjustment to the current posted
speed limit based on the measured
prevalent speed for this road
segment. This road segment
provides access to mostly residential
zones and the City's main
commercial drag. The new speed
limit would match the prima facie
speed for residential zones. Also,
there is a significant volume of cars
backing onto the street from onstreet angle parking and traffic calming features within this road
segment warranting low speeds.

Reducing the existing posted 35
mph speed limit is therefore
desirable.

Engineering recommends the
addition of this speed zone based on
the measured prevalent speed for
this road segment. This road
segment carries mostly transient
traffic and is fronted with mostly
industrial development on both
sides. This segment is followed by a
corridor that provides Class 2 bike
lanes and is proposed for 30 mph
posted speed limit. Implementing a
speed zone of 30 mph is therefore
warranted.
30 13 Main Street, Arizona Avenue to Placer
Avenue/eastern city limits
Engineering recommends this
adjustment to the current posted
speed limit based on the measured
prevalent speed for this road
segment. This road segment carries
traffic exiting the City and there is
currently no development on either
side of the segment. Increasing the
existing posted 35 mph limit is
therefore warranted.
45 14 Sutter Avenue, Manning Avenue to Colorado
Avenue
Engineering recommends the
addition of this speed zone based on
the measured prevalent speed for
this road segment. This road
segment carries traffic into the City
and there is currently no
development on either side of the
segment. This speed limit would
also match the prima facie speed
zone for County road conditions
based on the California Vehicle
Code Section 22349. Implementing
a speed zone of 50 mph is therefore
warranted

BACKGROUND:

The City of San Joaquin was awarded a Congestion Mitigation & Air Quality (CMAQ) grant complete paving improvements for Sutter Avenue from Railroad Avenue to Manning Avenue.

The City advertised the Sutter Ave Paving Improvements: Railroad to Manning on March 1, 2023, March 8, 2023, March 15, 2023 and received a total of eight (8) bids that were opened on March 30, 2023. Terra West Construction, Inc. submitted the lowest responsive and responsible bid and was awarded a contract for $1,089,595.00.

DISCUSSION:

The construction work started on June 5, 2023 and consisted of reconstructing and paving approximately 131,060 square feet of road, placing 13,660 tons of aggregate base, 3,870 tons of asphalt concrete, and constructing miscellaneous concrete improvements on Sutter Avenue in the City of San Joaquin.

The Contractor completed all work and a final inspection has been performed and the work was found to be in compliance with the plans and specifications. Therefore, the work should be accepted as complete and a Notice of Completion filed with Fresno County. If no claims are filed within 35 days after recordation, the retention in the amount of $54,735.38 should be paid to Terra West Construction, Inc.

ANALYSIS:

The final construction contract cost inclusive of all authorized work was $1,094,707.65.

Change Order No. 1 $ 6,345.98
94 Change Order No. 2 (Balancing Change Order) $ (1,233.33) Final Construction Cost $ 1,094,707.65

98 STAFF REPORT TO COUNCIL
October 3, 2023
TO: Mayor and City Council
FROM: Matt Flood, Assistant City Manager
SUBJECT: Approving Resolution No. 2023-43, modifying the salary schedule for the position of Recreation Supervisor.

Recommendation
Staff recommends Council adopt Resolution No. 2023-43 modifying the salary schedule for the position of Recreation Supervisor.

Executive Summary
The current Recreation Supervisor has accepted another position, which staff will need to fill. In discussions, staff has determined that the position is more demanding than initially anticipated, with the variety of community events, programs, and “open gym” hours that all need to be managed within a government setting.

In an effort to maintain a good-quality hiring pool and encourage future holders of this position to remain with the City, staff proposes a 10% increase to the hourly rate of this position, which would make it $20.80 per hour.
