STAFF REPORT TO COUNCIL
March 5, 2024
TO: Mayor and Council
FROM: Matt Flood, Assistant City Manager
SUBJECT: Waiving of the full reading and adoption of Ordinance No. 2024-01 repealing and replacing Section 114.02 of the San Joaquin Municipal Code Related to Yard Sales.

Recommendation:

Council waive the full reading of and adopt Ordinance No. 2024-01, repealing and replacing Section 114.02 of the San Joaquin Municipal Code Related to Yard Sales.

Executive Summary
At the previous meeting, Council performed the first reading of the ordinance that will change the yard sale provisions to allow yard sales twice a month, on the first and third weekend of the month.

Attached for Council consideration is the proposed ordinance which sets that regulation. Of note is that the term “first weekend” has been set as the first weekend in which the Saturday is the 1st of the month or later. Therefore, the third weekend would be two weekends after that first one.

As requested at the previous meeting, staff will make a yearly calendar highlighting the weekends in which yard sales will be allowed, for the public’s education and for staff’s use.

Due to the content of this ordinance, no public hearing is required. If adopted, staff will print a summary of the ordinance in the local newspaper in conformance with the law. 11

ORDINANCE NO. 2024-01

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
JOAQUIN AMENDING SECTION 114.02 OF THE SAN JOAQUIN

MUNICIPAL CODE RELATING TO YARD SALE REGULATIONS
THE CITY COUNCIL OF THE CITY OF SAN JOAQUIN DOES ORDAIN AS FOLLOWS:

SECTION 1. Section 114.02 of the San Joaquin Municipal Code is hereby repealed.

SECTION 2. Section 114.02 is established and shall read as follows:
§114.02 Limitations on Number of Permits Per Year.
(A) Yard Sale permits will be issued solely to residents and only on the first and third weekends of each month.
(B) The term “Weekend” as used in this chapter means Friday, Saturday, and Sunday; and the “first weekend” is the first weekend in the month in which Saturday falls on the 1st day of that month or later.

SECTION 3. Effective Date. This ordinance shall become effective thirty days after its adoption.

SECTION 4. Publication. Upon passage, this ordinance or a summary of the same shall be published within fifteen (15) days of passage, pursuant to the laws of the State of California, in a newspaper of general circulation published and circulated in said City of San Joaquin. If a summary of the ordinance is published, the City Clerk shall cause a certified copy of the full text of the proposed ordinance to be posted at City Hall at least five days prior to the meeting at which the ordinance is adopted and again after the meeting at which it is adopted.

12 STAFF REPORT
Date: March 5, 2024
TO: Mayor and Councilmembers
FROM: Mario Gouveia, City Engineer
REVIEWED BY: Elizabeth Cabrera, City Manager
SUBJECT:

Resolution of the City Council of the City of San Joaquin Extending the Agreement with Gouveia Engineering, Inc. for City Engineer Consultant Services and Authorizing the City Manager to Execute the Amendment.

RECOMMENDATION:

1. Adopt Resolution No. 2024-06, extending the Agreement with Gouveia Engineering, Inc. for City Engineer Consultant Services.

2. Authorize the City Manager to execute Amendment No. 2 to the Agreement with Gouveia Engineering, Inc. for City Engineer Consultant Services.

BACKGROUND:

On February 15, 2019, the City of San Joaquin accepted proposals from various engineering firms to provide City Engineer Consultant Services. City staff evaluated the proposals and selected Gouveia Engineering, Inc. as the most qualified and responsive firm.

On July 1, 2019, the City of San Joaquin entered into a contract with Gouveia Engineering to provide Engineering services for an initial three (3) year term. The Agreement provides an option as follows: “This term may be extended on an annual basis for four additional years.” The parties entered Amendment No. 1 extending the Agreement to June 30, 2024, and amending Section 4 of the Agreement regarding compensation.

The City of San Joaquin does not employ a professionally registered Engineer and needs the City Engineer services provided by Gouveia Engineering, Inc.

DISCUSSION:

The Agreement for City Engineer Consultant Services with Gouveia Engineering, Inc. expires on June 30, 2024 after an initial 2-year extension per Amendment No. 1. In order for Gouveia Engineering, Inc. to continue to provide City Engineering services to the City of San Joaquin, the City of San Joaquin will need to extend the Agreement by Amendment. The Agreement allows for an extension of up to four additional years. Therefore, to provide continuity of services, it is recommended the City use their option to extend the Contract term for two additional years.

FISCAL IMPACT:

The original agreement provides City Engineer Consultant Services as needed by the City and has no specific contract sum.

Re: 2024 Charge Rates
Dear Mrs. Cabrera,
Flrst and foremost, we want to thank the City of San Joaquin for partnering with Gouveia Engineering through the years and allowing us to serve your engineering needs. As virtually all businesses, we have experienced moderate cost increases in the past year and need to increase our charge rates by approximately 5% to mitigate those increased costs.

The new charge rates will go into effect on March 1 , 2024.

As always, we will strive to continue providing superior engineering services to the City of San Joaquin in a professional, timely, and cost-effective manner.

Please contact our office should you have any questions. rio B. Gouveia

Resolution of the City Council of the City of San Joaquin Extending the Contract with Gouveia Engineering, Inc. for On-Call Engineering Services for Federally Funded Transportation Projects and Authorizing the City Manager to Execute the Amendment
RECOMMENDATION:

Adopt Resolution No. 2024-07, approving Amendment No. 2 with Gouveia Engineering, Inc. for On-Call Engineering Services for Federally Funded Transportation Projects and authorize the City Manager to execute Amendment No. 2.

BACKGROUND:

On February 15, 2019, the City of San Joaquin accepted proposals from various engineering firms to provide On-Call Engineering Services for Federally Funded Transportation Projects. City staff evaluated the proposals and selected Gouveia Engineering as the most qualified and responsive firm. Subsequently, Gouveia’s proposal was reviewed and approved by Caltrans based on the Architecture and Engineering (A&E) procurement process published by the Department of Federal Highways Administration (FHWA).

On June 5, 2019, the City of San Joaquin entered into a contract with Gouveia Engineering to provide OnCall Engineering Services for Federally Funded Transportation Projects for an initial three (3) year term, with the option to extend for two additional years. The initial contract was approved for a term of three years and was to be extended for two additional years pursuant to the City’s proposal requirements.

The City of San Joaquin does not employ a professionally registered Engineer and needs the On-Call Engineering Services for Federally Funded Transportation Projects services provided by Gouveia Engineering, Inc.

DISCUSSION:

The Contract for On-Call Engineering Services for Federally Funded Transportation Projects with Gouveia Engineering, Inc. was extended by Amendment No. 1 to June 4, 2023. As noted above, the Agreement provided for a second annual extension. The parties have continued to operate under the Agreement and Amendment No. 1 and now wish to memorialize the second extension in writing. Proposed Amendment No. 2 will extend the Agreement from June 5, 2023 to June 4, 2024. Therefore, to provide continuity of services, and to complete the ongoing and future transportation projects for the City of San Joaquin that are funded with both State and Federal grants, it is recommended the City Council adopt Amendment No. 2.. 21 FISCAL IMPACT:

The on-call contract fees would be funded from State and Federal grants awarded for City projects.

26 STAFF REPORT TO COUNCIL
March 5, 2024
TO: Mayor and Council
FROM: Matt Flood, Assistant City Manager
SUBJECT: Establishing the Administrative Fee Amounts for Reconnection of Water Services after Disconnection for Non-Payment and the Formulation of an Alternative Payment Plan.

Recommendation: Adopt Resolution No. 2024-08, Establishing the Administrative Fee Amounts for Reconnection of Water Services after Disconnection for Non-Payment and the Formulation of an Alternative Payment Plan.

Executive Summary
In 2023, the City Council adopted Ordinance No. 2023-03 and Resolution No. 2023-10 that established the City’s utilities shut-off policy. Part of that policy allows the establishment of fees for the following services:
• Formulation of an Alternative Payment Plan (staff recommended amount: $25.00) • Reconnection Fee during Business Hours (staff recommended amount: $50.00) • Reconnection Fee Outside of Business Hours (staff recommended fee: $150.00) While these fees will not cover the cost of staff performing the associated work, staff believes they come close to doing so, and future evaluations of these fees will continue to make sure the cost is reasonable for residents while not creating a burden on the financial status of the Water Fund.

Business Hours are defined as Monday through Friday, 8:30am to 4:30pm, excluding Holidays.

Staff practice will be that any portion of work to perform reconnection that goes over 5:00pm (for example, if someone comes into City Hall at 4:29pm and qualifies for a reconnection, turnaround time to get an employee out to turn on their water may occur after 5:00pm) will be charged the higher rate, but they will be given the option to have their water turned on the following day during Business Hours at the lower rate.
