*NEXT REGULAR COUNCIL MEETING WILL BE TUESDAY, MAY 7, 2024* A Concept for Rural Cities and Unincorporated Communities Working Together Community Energy Fresno
dba Comunidades de Energía, Fresno
Community Determined Community Benefits from Clean Energy Development A Possible Multi-Community Nonprofit with the Inclusive Representation, Standing, and Power to Secure Significant Community Benefit Agreements in Western Fresno County 1 • The Largest Power Plant in the World is in CHINA – Three Gorges Dam – 22.5 Giga Watts
• The Largest Cluster of Clean Energy Solar Planned in the World is in INDIA –
22.5 Giga Watts
Truly global scale clusters of solar, battery storage, and green hydrogen (30 Giga Watts proposed in Fresno County alone) and other types of clean energy production and transmission facilities are being planned for hundreds of thousands of acres in Fresno County, and the potentially one million acres of farmland likely to be retired across the eight counties of the San Joaquin Valley because of reduced future water availability. Significant direct benefits from new energy developments are clearly warranted for the rural communities in these areas that will be the direct impact areas for development. 2 3

HOW DO WE ELEVATE RURAL COMMUNITIES IN THE CLEAN ENERGY TRANSITION? To be successful in the Clean Energy Era, rural communities will have to organize together, and build their knowledge, capabilities, technical relationships, and collaborative leadership to factually and powerfully speak for themselves and negotiate their own community benefit agreements (CBAs) with energy developers and others. To do so will not only capture much greater direct benefits from clean energy, but position the organized rural communities to have voice and represent themselves in the never-ending competition for the adoption of policies, allocation of resources and securing of business commitments they need from county, state and federal governments, the nonprofit sector, and the market economy. We need transformative community organizing, not more token engagement. 7 We can ground our CBA work through the ‘Guiding Principles for Community Benefits Related to Clean Energy Projects in the San Joaquin Valley (SJV)’ developed by the Clean Air Task Force Team we worked with on the SJV Clean Energy Transition Vision:
• Rural cities and communities will likely bear the brunt of negative impacts of the transition to clean energy in the SJV, and therefore should receive the greatest share of direct community benefits.
8 ‘Guiding Principles for Community Benefits Related to Clean Energy Projects in the San Joaquin Valley (SJV)’
• California has a history of marginalizing SJV communities, relying on the Valley’s people and plentiful agricultural and energy resources to serve the “greater good.” These rural communities have not traditionally benefited from a hundred years of extractive industry (agricultural, solar, mining, oil, gas, etc.). Benefits and mitigations, exacted by government via CEQA or by other intermediary organizations, have not improved SJV communities’ socioeconomic status, health, and wellbeing. • The clean energy industrial transition can provide SJV residents with community benefits (direct and indirect) that have the potential to transform these impacted communities and address historic injustices. 9 ‘Guiding Principles for Community Benefits Related to Clean Energy Projects in the San Joaquin Valley (SJV)’
• Clarity and certainty around community benefits has potential to accelerate desired clean energy projects, which are those that are consistent with the SJV Clean Energy Deployment Vision and Objectives statement (see attached). Strong community benefits mechanisms can lower impacts, costs, and risks associated with industrial scale clean energy deployment; attract investment; and deliver feasible, real, and durable benefits to impacted communities. • Community benefits should be determined by the local impacted communities and should be the maximum feasible, so that desirable projects are still financially viable. While benefits from a single project cannot solve the challenges faced by communities, aggregated community benefits from multiple projects can have a substantial impact.
10 ‘Guiding Principles for Community Benefits Related to Clean Energy Projects in the San Joaquin Valley (SJV)’
• Rural community prosperity will not happen without respect for, deference to, and engagement and empowerment of residents and leaders in impacted rural communities. Communities must be able to articulate their vision and objectives, be part of the examination and determination of the full suite of project impacts, and author their own community-determined benefits packages including negotiated agreement(s).
11 ‘Guiding Principles for Community Benefits Related to Clean Energy Projects in the San Joaquin Valley (SJV)’
• Community Benefit Agreements (CBAs) will be required. To be meaningful and transformative, CBAs must ultimately be negotiated between energy developers and impacted rural community organizations that will determine, govern, and manage implementation of their community benefits. This CBA process can be assisted, streamlined, and made regionally consistent in various ways. However, the CBA process must emphasize building and sustaining rural community civic infrastructure with shared power and governance over high-capacity nonprofits intentionally established to hold and deploy their own hard earned rural community benefit resources. 12 Project Location

Possible Working Draft Purpose Statement to be Expanded in Community Energy Fresno Formation and Crafting of Nonprofit Corp. Bylaws: The purpose of Community Energy Fresno is to increase and sustain inclusive health, economic opportunity, civic engagement, social equity, community infrastructure and environmental quality for residents of the rural communities of western Fresno County. This purpose will be accomplished by a rural community nonprofit organization and representative board of directors that negotiate, receive, and accountably manage funds from Community Benefit Agreements based upon revenue sharing, direct payments and other forms of community benefits derived from clean energy and other types of related rural development incentivized by federal, state and local governments. Nonprofit organizational expenditures will be governed by Community Energy Fresno corporation bylaws that require focus on improving the Social Determinants of Health in all rural communities of western Fresno County.
13 ‘Social Determinants of Health’
14 Community Determined Community Benefits from Clean Energy Development based on The Social Determinants of Health
Community Benefits secured as Direct Payments and Revenue Sharing by the Comunidades de Energía, Fresno (Community Energy Fresno) 501c3 will be restricted via adopted bylaws to expenditures that focus on addressing the ‘Social Determinants of Health’ in member communities as determined by the Board of Directors. Other forms of Community Benefits may also be negotiated as part of specific agreements with clean energy developers. Regardless of form, when contextualizing the general topic of Community Benefits to be refined by Comunidades de Energía, Fresno (Community Energy Fresno), reference is made and will be incorporated into bylaws relating to the Federal Plan for Equitable Long-Term Recovery and Resilience (Federal Plan for ELTRR), which leverages the Vital Conditions for Health and Well-Being as the guiding framework related to The Social Determinants of Health.
The ELTRR vital conditions identify the factors that people depend on to reach their full potential, organized into 7 categories:
• Belonging + Civic Muscle
• Meaningful Work + Wealth
• Lifelong Learning
• Humane Housing
• Reliable Transportation
• Basic Needs for Health + Safety
• Thriving Natural World

SUBJECT:
Resolution of the City Council of the City of San Joaquin for the Initiation of Proceedings for the Annual Levy of Assessments for Assessment District No. 92-3, (Pursuant to the Landscaping and Lighting Act of 1972)
RECOMMENDATION:
Staff recommends that Council approve the attached Resolution Initiating Proceedings for the Annual Levy of Assessments for Assessment District No. 92-3 and to have the City Engineer prepare and file his annual report on the levy.
BACKGROUND:
Assessment District No. 92-3 (District) was formed on November 10, 1992 for the purpose of financing maintenance costs for street lighting, streets, public landscaping, and park improvements in the District.
The levy of assessments to property owners in the District occur on an annual basis.
In order to meet the timelines required by the Landscaping and Lighting Act of 1972 (herein the “Act”) and the Government Code, it is now necessary to initiate proceedings for the annual levy of assessments against all properties in the District. The City Engineer will need to prepare and file a report regarding the annual levy in accordance with Article 4 (commencing with Section 22565) of Chapter 1 of the Act.
No annexations of property have occurred to the District over the past year therefore there will be no new properties to levy.
FISCAL IMPACT:
No fiscal impact at this time.

STAFF REPORT
Date: April 2, 2024
TO: Mayor and Councilmember
FROM: Mario Gouveia, City Engineer
REVIEWED BY: Elizabeth Cabrera, City Manager
SUBJECT:
Resolution of the City Council of the City of San Joaquin Accepting Completion of the Council Chambers Remodel Project, Authorizing the City Clerk to file a Notice of Completion with Fresno County, and Authorizing the City Manager to Make Final Payment of Retention Monies to Don Fowler Construction.
RECOMMENDATION:
1. Accept the work as complete.
2. Authorize the City Clerk to record a Notice of Completion with Fresno County.
3. Authorize the City Manager to make payment of retention monies to Don Fowler Construction following the expiration of 35 days from the date of recordation of the Notice of Completion.
SUMMARY:
Staff recommends that the San Joaquin City Council adopt Resolution No. 2024-10 accepting completion of the Council Chambers Remodel Project, authorize the City Clerk to file a Notice of Completion with Fresno County, and authorize the City Manager to Make a Final Payment of Retention Monies to Don Fowler Construction.
DESCRIPTION:
The major work consisted of remodeling an existing room at the Senior Center to be utilized as the City Council Chambers in the City of San Joaquin.
BACKGROUND:
The City of San Joaquin advertised the Council Chambers Remodel project on June 14, 2023, and bids were opened at 2:00 p.m. on July 12, 2023, that being the advertised bid opening date and time. Don Fowler Construction submitted the lowest responsive and responsible bid and was awarded a contract for one hundred thirty-nine thousand eight hundred dollars and zero cents ($139,800.00).
DISCUSSION:
The project’s construction phase started September 18, 2023 and the major work consisted of remodeling an existing room at the Senior Center to be utilized as the City Council Chambers in the City of San Joaquin. The Contractor has completed all the work within the time required by the Contract Documents. A change order was made in the amount of an additional $4,750 to paint 35
the outside of the building, which staff did in order to reduce costs of such a job in the future since a painting contractor was already mobilized for the interior of the building.
A final inspection has been performed and the work has been found to be in compliance with the plans and specifications. Therefore, the work should be accepted as complete and a Notice of Completion filed. If no claims are filed within 35 days after recordation, retention in the amount of seven thousand two hundred twenty-seven dollars and zero cents ($7,227.50) should be paid to Don Fowler Construction.
FISCAL IMPACT:
The construction costs were paid using State and Local Fiscal Recovery Funds (SLFRF).

Contract Amount $ 139,800.00
Change Order 1 $ 4,750.00
Actual Construction Cost $ 144,550.00

TO: City Council
FROM: Elizabeth Cabrera, City Manager
SUBJECT: Fresno Multi-Jurisdictional 2023-2031 Housing Element Recommendation:
Staff recommends that the City Council first review and consider the analysis provided in the Addendum to the General Plan EIR (Exhibit B), finding that none of the conditions described in CEQA Section 15162 calling for the preparation of a subsequent EIR or negative declaration have occurred, and after receiving public comment and deliberations adopt Resolution Approving the Addendum to the City of San Joaquin General Plan EIR and the Revised Fresno Multijurisdictional 2023-2031 Housing Element (6th Cycle).
Executive Summary
This is a request for the City Council to adopt the revised Fresno Multi-Jurisdictional 2023-2031 Housing Element. The Fresno County Multi-Jurisdictional Housing Element consists of one of eight mandated elements of the General Plan. The Housing Element consists of a plan to accommodate the jurisdiction’s “fair share” of the Regional Housing Needs Assessment (RHNA) as provided by the state. The subject Housing Element will consist of the 6th Cycle Planning Period from December 31, 2023, to December 31, 2031. The Fresno County Multi-Jurisdictional Housing Element is attached as Exhibit A. The City received a preliminary compliance letter from the Department of Housing and Community Development (HCD) on March 19, 2024 approving the Housing Element subject to approval by the City and then submittal to HCD for adoption.
CEQA Determination
In accordance with the provisions of the California Environmental Quality Act (CEQA), an Addendum to the General Plan Environmental Impact Report (EIR) was prepared. Pursuant to the CEQA Guidelines and the Addendum, no major revisions to the EIR are required and no subsequent EIR, supplemental EIR, or Negative Declaration is required for the approval of the adoption of the Housing Element Update (See Exhibit B).
Background
The Housing Element identifies ways in which the housing needs of existing and future residents can be met. The Fresno County Multi-Jurisdictional Housing Element represents an innovative approach to meeting State Housing Element law and coordinating resources to address the region’s housing needs. The following jurisdictions are participating in the effort: Fresno County and the cities of Coalinga, Firebaugh, Fowler, Fresno, Huron, Kerman, Kingsburg, Mendota, Orange Cove, Parlier, Reedley, San Joaquin, Sanger, and Selma. 40 2
The Housing Element update was prepared in response to the requirements of state law and the goal of retaining conditions and policy directives unique to the City of San Joaquin. The current Housing Element update will cover the period of December 31, 2023, to December 31, 2031.
The proposed Housing Element Update has been an ongoing process. The regional efforts began July 2022 with community outreach. In March 2023 the Regional Housing Needs Assessment and Fair Housing Assessment was released. Following that, in April 2023 the Local Public Review Draft of the Housing Elements was released for a 30-day review period. During this time additional outreach was done. The San Joaquin Housing Element was then submitted to HCD for review during the Fall of 2023. Additional revisions were made based on comments received. A second draft was submitted to HCD in February 2024 for review. After coordination with HCD on file edits, a revised HCD Review Draft Housing Element was released online on March 1, 2024, for public review. HCD provided a preliminary compliance letter to the City on March 19, 2024, that states the housing element will substantially comply with State Housing Element Law (Gov. Code, § 65580 et seq) when it is adopted, submitted to, and approved by HCD, in accordance with Government Code section 65585 (see Exhibit C of the resolution).
RHNA
Regional Housing Needs Assessment (RHNA) is determined first by the State projecting future housing needs at various income levels and allocates units to Councils of Governments (COGs) Statewide. Each COG develops a methodology approved by HCD to evaluate factors for distribution of units to each jurisdiction. Cities and counties are allocated these estimated units and need to accommodate enough land at appropriate densities to achieve their RHNA goals.
The Fresno COG (FCOG) was required to allocate 58,298 units for the FCOG RHNA. The City of San Joaquin was allocated 200 of those units distributed between Very Low Income, Low Income, Moderate Income and Above Moderate Income units. The following exhibit depicts this distribution:
Housing Element Programs
The Housing Element includes six (6) goals, 36 policies, and 23 programs. Public Outreach and Engagement
Housing Element Outreach meetings were held to allow the City of San Joaquin residents an opportunity to provide their input on their Housing Element and RHNA distribution. Countywide meetings were held in the City of Fresno and virtually on October 25 2022, November 15, 2022, and April 25th 2023. Outreach meetings were also held in the City of San Joaquin on August 10, 2022 and October 4, 2022.
Engagement efforts also included a regional project website and a community survey. The draft Housing Element was made available for public review and comment for 30 days from June 30, 2023, through July 30, 2023. During this comment period the city did not receive public comments.
Additionally, residents and housing advocacy groups were sent notices that the draft was made available on the regional project website.
HCD Revisions and Comments
On November 2, 2023, the Department of Housing and Community Development (HCD) provided comments and revisions needed for the draft Housing Element submitted on August 7, 2023. After receiving HCD’s comments the city’s consultants worked to revise and update the Housing Element. On February 2, 2024, a second draft was sent to HCD to review the draft submitted on December 4, 2023. HCD provided additional comments on the draft required to comply with State Housing Element Law. The city reviewed the comment letter, made revisions, and prepared the Revised draft Housing Element for HCD. In compliance with public participation requirements pursuant to AB 215, the Revised HCD Review Draft Housing Element was released online on March 1, 2024, and was made available for public review for seven days. Interested individuals and organizations were notified via email on March 1, 2024. The City did not receive any comment letters during the public review period, which ended on March 8, 2024. 42 RESOLUTION NO. 2024-11

Dear Matt Flood:
RE: City of San Joaquin’s 6th Cycle (2023-2031) Revised Housing Element Thank you for submitting the City of San Joaquin’s (City) revised draft housing element update received for review on March 11, 2024. Pursuant to Government Code section 65585, HCD is reporting the results of its review.
The revised draft element meets the statutory requirements described in HCD’s February 2, 2024 review. The housing element will substantially comply with State Housing Element Law (Gov. Code, § 65580 et seq) when it is adopted, submitted to, and approved by HCD, in accordance with Government Code section 65585.
Public participation in the development, adoption, and implementation of the housing element is essential to effective housing planning. Throughout the housing element process, the City must continue to engage the community, including organizations that represent lower-income and special needs households, by making information regularly available while considering and incorporating comments where appropriate. Please be aware, any revisions to the element must be posted on the local government’s website and to email a link to all individuals and organizations that have previously requested notices relating to the local government’s housing element at least seven days before submitting to HCD.
For your information, pursuant to Government Code section 65583.3, the City must submit an electronic sites inventory with its adopted housing element. The City must utilize standards, forms, and definitions adopted by HCD. Please see HCD’s housing element webpage at https://www.hcd.ca.gov/planning-and-communitydevelopment/housing-elements for a copy of the form and instructions. The City can reach out to HCD at [email protected] for technical assistance.
Several federal, state, and regional funding programs consider housing element compliance as an eligibility or ranking criteria. For example, the CalTrans Senate Bill (SB) 1 Sustainable Communities grant, the Affordable Housing and Sustainable 45 Matt Flood, Assistant City Manager
Communities programs, and HCD’s Permanent Local Housing Allocation consider housing element compliance and/or annual reporting requirements pursuant to Government Code section 65400. With a compliant housing element, the City will meet housing element requirements for these and other funding sources.
For your information, some general plan element updates are triggered by housing element adoption. HCD reminds the City to consider timing provisions and welcomes the opportunity to provide assistance. For information, please see the Technical Advisories issued by the Governor’s Office of Planning and Research at:
https://www.opr.ca.gov/planning/general-plan/guidelines.html.
HCD appreciates the hard work and dedication of the City’s housing element team in preparation of the housing element and looks forward to receiving the City’s adopted housing element. If you have any questions or need additional technical assistance, please contact Melissa Vasquez, of our staff, at [email protected].
Sincerely,

46 STAFF REPORT TO COUNCIL
April 2, 2024
TO: Mayor and Council
FROM: Matt Flood, Assistant City Manager
SUBJECT: Submission of HOME Program funding application through the 2022-2023 HOME NOFA and a HOME Program Income Application for partial funding to construct the 51-Unit Cordillera Commons affordable housing project.
Recommendation:
Council adopt Resolution No. 2024-12 and Resolution No. 2024-13, Authorizing submittal of an Application to the California Department of Housing and Community Development for Funding under the HOME Investment Partnerships Program and Application of Program Income, authorizing the City Manager or Designee to execute a Standard Agreement and any amendments or other related documentation necessary to participate in the HOME Investment Partnerships Programs.
Executive Summary
The State of California Department of Housing and Community Development (HCD) issued a Notice of Funding Availability (NOFA) for HOME Investment Partnerships Program (HOME) funds on January 19, 2024, with applications due no later than 5:00 p.m. on April 9, 2024.
Additionally, the City has approximately $750,000 in HOME Program Income in its HOME Program Income account that must be used to fund affordable housing within a set time period or must be returned to HCD.
The Fresno County Housing Authority has requested that the City apply for HOME grant through the January 19, 2024, NOFA and for the use of HOME Program Income funds to partially fund the construction of the Cordillera Commons Apartments containing 50 affordable units and one manager unit located at W. Colorado Avenue and 5th in the City. If received, the City will loan the funds to the Housing Authority on a loan with a 55-year term at 3% simple interest to be repaid on a cash flow basis (funds available for distribution after all allowable expenses are paid). The project will be required to be affordable for the 55-year term and will be governed by a Regulatory Agreement.
The City’s consultant, Adams Ashby Group, has engaged R.L. Hastings & Associates to assist in preparing and submitting a HOME application to HCD.
Fiscal Impact: As part of the HOME application, the City will be requesting $125,000 in administrative funds to offset costs incurred by the City in implementing the project. The City will also be requesting up to $75,000 for Project-related soft costs, some of which will be used by the City to cover allowable City soft costs and some of which may be used to cover allowable developer soft costs. Costs are reimbursed on an incurred basis. 47 REPORT TO CITY COUNCIL
If the project receives HOME funding, the project developer will pay the City an annual monitoring fee to cover the cost the City will incur annually for Long-term monitoring.
The City will also receive 50% of any Residual Receipts, if available, over the life of the loan The City anticipates that there will be minimal fiscal impact over the life of the project due to the funds requested in the application and the annual fee to the City for monitoring costs. 48 RESOLUTION NO. 2024-12
