STAFF REPORT
Date: May 7, 2024
TO: Mayor and Councilmember
FROM: Mario B. Gouveia, City Engineer
REVIEWED BY: Elizabeth Cabrera, City Manager
SUBJECT:
A Resolution of the City Council of the City of San Joaquin of Intent to Levy And Collect The Annual Assessments for Assessment District No. 92-3 and Setting a Public Hearing (Pursuant to the Landscaping and Lighting Act of 1972)
RECOMMENDATION:
Staff recommends that Council adopt Resolution No. 2024-15 and declare the City’s intention to levy and collect the Annual Assessment for Assessment District No. 92-3, and to hold a public hearing on June 4, 2024 to hear public testimony regarding the assessments.
BACKGROUND:
On April 2, 2024, City Council initiated proceedings for the annual levy and the City Engineer was directed to prepare the Engineer’s report for the annual levy.
Two meetings are required to complete the annual assessment process. At this regular meeting on May 7, 2024, the City Council will review the draft annual Engineer’s Report detailing the annual assessments and consider the attached Resolution No. 2024-15 declaring the City’s intention to levy and collect the annual assessments. Staff is not seeking adoption of the Engineer’s Report until the second required meeting. The attached resolution sets a public hearing on the proposed levy for June 4, 2024. The public hearing will serve as the second required meeting, and staff will seek Council’s formal adoption of the annual Engineer’s Report at that time.
The yearly assessments established for all properties within the District fund the City’s maintenance of streetlight, street, public landscape, and park facilities. The assessments for Areas 1-4 remain unchanged from last year. Assessments for lots in Areas 1 through 4 cannot be raised without a vote of the lot owners per the requirements of Proposition 218. The assessments for Areas 5 and 6 have been adjusted based upon the Consumer Price Index. The Consumer Price Index increased by 3.7% in 2023. The maximum annual CPI adjustment is not to exceed 3%. In accordance with the foregoing limitations, the assessments for fiscal year 2024-2025 will increase by 3.0%.
As required by the Landscaping and Lighting Act of 19723, the preliminary Engineer’s Report for Assessment District No. 92-3 is on file with the City Clerk. The preliminary Engineer’s Report has a full and detailed description of the improvements, the boundaries of the Assessment District and any zones therein, and the proposed assessments upon the assessable lots and parcels of land within the District.
Payment of the assessment will be collected with the property tax. Any excess funds over the actual cost of maintenance and administration at the end of the year will be credited to future assessments, and any deficits may be added to future assessments.
23 FISCAL IMPACT:
It is anticipated the City will collect approximately $29,938.35 from the City of San Joaquin Landscaping and Lighting Maintenance District No. 92-3 Assessments to cover estimated maintenance, utility and administration expenses for Fiscal Year 2024-2025.

REPORT TO COUNCIL
TO: City Council
FROM: Elizabeth Cabrera, City Manager
DATE: May 7, 2024
SUBJECT: Consideration of Amendment No. 2 to Agreement for Legal Services with Montoy Law Corporation
RECOMMENDATION:
Adopt Resolution No. 2024-16 approving Amendment No. 2 to agreement for legal services with Montoy Law Corporation adjusting rates and clarifying personnel provision.
EXECUTIVE SUMMARY:
The City of San Joaquin has contracted with the Montoy Law Corporation (“Firm”) since 2006 to provide the City with municipal legal services. Since that time, the Firm rates have been adjusted in 2019 and 2023.
Ms. Montoy has requested a new adjustment effective July 1, 2024. The resolution attached would approve Amendment No. 2 to the contract for services and increase rates and fees charged to the City of San Joaquin for legal services. The proposed new rates are competitive in our geographic region and reasonable to keep pace with rising costs experienced by firms who serve the City. See comparable rates under Discussion. At this Office’s request, Amendment No. 2 includes names of attorney who may be assigned to assist on San Joaquin matters.
DISCUSSION
The resolution attached, would approve Amendment No. 2 to the contract for services and increase rates charged to the City for legal services. Attorney rates for general services would be increased from $215/hour to $250/hour; paralegal rates would be increased from $90/hour to $100/hour.
Attorney rates for special services such as administrative hearings, claims and litigation will be adjusted from $260/hour to $295/hour; paralegal rates would be adjusted to $110/hr.
The proposed rates are competitive in our geographic region and reasonable to keep pace with rising costs as reflected in rates for surrounding cities as reflected below:
Entity Advisory Rate Litigation Rate Note:
Coalinga $265
Del Rey CSD $260/hour $285/hour
Firebaugh $6,500 monthly retainer
Fowler $235/hour
67 Madera $265/hour $290/hour
Mendota $255/hour
Reedley $225/hour
Selma $16,500 monthly retainer
Note: A similar rate adjustment is in progress with City of Kerman and City of Sanger.
Attachment:
1. Resolution w/ Exhibit (Amendment)
68 RESOLUTION NO. 2024-16
RESOLUTION APPROVING AMENDMENT NO. 2 TO AGREEMENT FOR
LEGAL SERVICES WITH MONTOY LAW CORPORATION
WHEREAS, the City of San Joaquin requires competent and professional municipal legal services and advice; and
WHEREAS, the Montoy Law Corporation (Firm) has served the City since 2006 as contract City Attorney and both parties wish to continue this relationship; and WHEREAS, Firm did not request a rate increase until 2021 and then in 2023 to account for their rising costs of doing business and in recognition of City’s financial situation in particular years; and
WHEREAS, a rate increase is warranted to keep pace with recent inflation and increased costs of doing business; and
WHEREAS, the City deems the proposed increases reasonable and appropriate in the marketplace and a continuance of good value for competent and professional legal services; and WHEREAS, the parties wish to clarify the Firm’s assignment of personnel to handle the City’s legal requirements; and
WHEREAS, Firm further represents that it is willing to accept responsibility for performing such services in accordance with the terms and conditions set forth in Amendment No. 2 to Agreement.
NOW, THEREFORE, the City Council of the City of San Joaquin resolves as follows:
