STAFF REPORT TO COUNCIL
June 27, 2024
TO: Mayor and City Council
FROM: Elizabeth Cabrera, City Manager
SUBJECT: Revision to the Service Agreement for overtime law enforcement services with Fresno County Sheriff’s Office for FY 2024-27
Recommendation
Ratify the correction to the Service Agreement with Fresno County Sheriff’s Office for law enforcement services.
Executive Summary
June 4, 2024 City Council approved a Service Agreement with the Fresno County Sheriff's Office for law enforcement services to go into effect July 1, 2024. The Maximum Compensation listed on the agreement was $729,347. This was a carryover figure from the previous agreement. The amount should have been updated to $765,817. The $765,817 aligns with the current MSF and anticipated increase of rates over the next five years that was outlined in the agreement and approved by City Council on June 4, 2024. This was a simple clerical error. Staff went ahead and made the correction and executed the Agreement. Staff is seeking that Council ratify that action.
Background
The current contract with the Fresno County Sheriff’s Office for overtime law enforcement services is due to expire on June 30, 2024. The parties wish to extend the Agreement. The term of this new Agreement is for a period of three (3) years, commencing on July 1, 2024 through and including June 30, 2027. This Agreement may be extended for two (2) additional consecutive twelve (12) month periods upon written approval of both parties no later than thirty (30) days prior to the first day of the next twelve (12) month extension period.
County agrees that its Sheriff’s Office shall provide law enforcement services consisting of one Deputy Sheriff to exercise law enforcement functions within City for up to thirty (30) hours per week for fifty-two (52) weeks during each Fiscal Year of the term This contract is for total hours of 1,560, these hours are scheduled Friday-Sunday nights 4 PM-2 AM. The law enforcement services provided to the City shall be services of the type customarily provided by Sheriff within the unincorporated territories of the County.
The overtime hourly rate for the new agreement for consideration will remain the same at $76.58 until a new Master Schedule of Fees (MSF) rates is adopted by the Fresno County Board of Supervisors. The last MSF was approved 11/28/23 to take effect on 12/28/23. It is anticipated a new MSF will be presented to the Board of Supervisor for adoption by December 2024. The 18
anticipated increase in rate could be up to 10%. At the time the new rates are adopted they will have an effective date later than the adopted date. The new rate will not be retroactive to July 1, 2024.
As indicated in Exhibit B, the hourly rates to be charged by County, and subsequently paid by City, are the rates set forth in the County’s Master Schedule of Fees, Charges, and Recovered Costs, Section 2609, subdivision (a), for Overtime (i.e., General Law Enforcement Services and Special Events Services) rate, in place at the time the services are provided. The parties agree that if and when the Master of Schedule of Fees, Charges, and Recovered Costs, Section 2609, subdivision (a), is amended, changed, or revised, in any way that changes the rates being charged for the services identified in this Agreement, that the new rate will be charged by County, and paid by City, for any services provided pursuant to this Agreement and Exhibit A, from the date of the amendment, change, or revision, going forward.

RECOMMENDATION:
Council Adopt Resolution No. 2024-27, observing July 5, 2024 as a paid Holiday in the City of San Joaquin.
DISCUSSION
Fourth of July falls on a Thursday this year, with many organizations also providing time off to their employees on July 5th, due to it being a Friday and the magnitude of the Independence Holiday and the festivities that accompany it.
This is good for morale, shows appreciation to employees, and would not be an ongoing Holiday, only applying to July 5, 2024.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN JOAQUIN hereby resolves as follows:
Section 1. The foregoing recitals are true and correct and incorporated by reference.
Section 2. The City Council of the City of San Joaquin declares July 5, 2024 as a Holiday in the City of San Joaquin.
