What is Measure C?
Adopted in 1986 and renewed in 2006, Measure C’s ½ cent retail sales tax has transformed the transportation landscape in the Fresno-Clovis Metro area as well as Fresno County. Measure C has been widely successful due to its focus on transportation needs in Fresno County. ✓ Measure C has improved our freeway system, our local city streets and county roads, and our local and rural transit services. ✓ Fresno County was one of the first self-help counties in California. ✓ Over the past 37 years, Fresno County has been able to leverage over $8 billion for transportation because Measure C has been able to provide matching funds.
✓ Measure C has continued to provide safe, efficient and affordable transportation for Fresno County, by connecting us with health care, emergency services, education and jobs opportunities.
✓ Under the current measure, annually 35% of Measure C revenues goes directly to local agencies for road maintenance/street repair. 4 VOTERS APPROVE

5 Status of the Transportation Infrastructure
ASCE’s 2021 Report Card for America’s Infrastructure:

America’s roads are critical for moving an ever-increasing number of people and goods. However, these vital lifelines are frequently underfunded, and over 40% of the system is now in poor or mediocre condition. As the backlog of rehabilitation needs grows, motorists are forced to pay over $1,200 every year in wasted time and fuel. Additionally, while traffic fatalities have been on the decline, over 36,000 people are still dying on the nation’s roads every year, and the number of pedestrian fatalities is on the rise.

Our nation’s highways and roads move 72%, or
nearly $17 trillion, of the nation’s goods;
43% of our public roadways
are in poor or mediocre condition.
6 Status of US Transportation Infrastructure
Public investment in US infrastructure as a share of the Gross Domestic Product (GDP) has fallen more than 40 % since the 1960s. The World Economic Forum now ranks the United States 13th when it comes to the overall quality of infrastructure.

Examples of our nation’s fragile and aging infrastructure:
➢ More than 45,000 US Bridges and 1 in 5 miles of roads are in poor condition.
➢There is a water main break every two minutes, and an
estimated 6 billion gallons of treated water lost each day in the U.S.
➢There are 30,000 miles of inventoried levees across the U.S., and an additional 10,000 miles of levees whose location and condition are unknown.

What’s Next for Measure C?

MEASURE C
PROMISES MADE. PROMISES KEPT.

Update on Measure C. Where we are and what is ahead of us? ✓ Set to expire in 2027, FCTA and FCOG are beginning efforts to place a Measure C renewal on the ballot in November 2026.
✓ A second renewal of Measure C has the potential to raise from $2.8 billion to $5 billion, depending on duration and escalation rates. ✓ MC3 would continue the region’s commitment to improving air quality, delivering road and street repair and maintenance, controlling congestion, and providing mobility to all Fresno County residents through the programs it funds.
✓ In addition, MC3 needs to be forward-looking at how we do transit, what impacts high-speed rail will have on our local transportation, alternative transportation and commute options while still 9 ~ FCTA

30 STAFF REPORT TO CITY COUNCIL
October 1, 2024
TO: City Council
FROM: Matt Flood, Assistant City Manager
SUBJECT: Receiving Public Input on a USDA Disaster Relief Grant Funding Project Recommendation:

Council open the hearing to the public to receive comments on $925,000 in grant funds that have been applied for, with the intent of using them to purchase heavy machinery that will facilitate the repair of roads.

Executive Summary
USDA made funding available for areas affected by disasters, specifically as part of the severe winter storms that happened last season. Due to the impact that weather had on our roads, City staff applied for some of this funding to be able to make repairs.

As part of the process, USDA requires the City to solicit input on what staff is pursuing as part of the grant. Staff has put in a request for approximately $925,000, which would be allocated towards:
• Asphalt Zipper Machine
• Class C Dump Truck
• Backhoe
• Asphalt Rolling Machine
• Asphalt Paving Machine
31 STAFF REPORT TO COUNCIL
October 1, 2024
TO: Mayor and Council
FROM: Elizabeth Cabrera, City Manager
SUBJECT: Consideration of MOU with County of Fresno City Ordinance Relating to Infectious Materials.

Recommendation
That the Council take action as follows:
(1) Adopt Resolution Approving Memorandum of Understanding (MOU) with County of Fresno to Authorize County to enforce Fresno County Infectious Materials Ordinance in the City of San Joaquin; and
(2) Waive full reading and Introduce Ordinance Adding Chapter 102 to Title IX of the San Joaquin Municipal Code Relating to Infectious Materials.

Executive Summary
The County of Fresno in collaboration with the City of Reedley managed a significant public health response in addressing issues with an unlicensed laboratory operating within the city limits of Reedley. The County has had significant communication and specific recommendations to Federal and State legislators on how to prevent this from happening in the future while improving our national oversight and surveillance of privately funded laboratories. Unfortunately, there is no national or state solution at this time. The County Board of Supervisors adopted the Fresno County Infectious Materials Ordinance, a local ordinance that will provide some local oversight and authority to oversee privately funded laboratories that do not fall under the Clinical Laboratory Improvement Amendments (42 USC 263a).

The County ordinance applies only to the unincorporated area of Fresno County. The County has offered an MOU to incorporated cities that will allow the County to enforce the ordinance within cities if executed and if the City delegates authority to County to enforce. The MOU is drafted to reflect that cities maintain their local control, entities are only liable for costs they incur and thus the County would not charge their costs to a city, and County’ communication with the City will be key on a joint response.

Approval of the recommended action will approve an MOU with the County to enforce its Infectious Materials Ordinance and adopt an ordinance relating to Infectious Materials. The Ordinance, if adopted, will incorporate by reference the recent County’s ordinance which will provide the authority for the County to conduct onsite visits on private property and evaluate if laboratories that are not regulated by CLIA, 42 USC 263a and 42 CFR 493 are in compliance with Hazardous Materials laws and general applicable clinical laboratory safety requirements (e.g. medical waste, environmental controls, policy, and procedures). This Ordinance will not apply to 32 REPORT TO CITY COUNCIL

Page 2 ends

CLIA operated laboratories which include commercial laboratories (e.g. Quest, Lab Corp), doctors’ offices that obtain a CLIA license or waiver from CLIA, and/or clinics operating under a CLIA license or waiver from CLIA. The Department would operationalize a team from its Hazardous Materials program and its Public Health Laboratory. This team would conduct annual onsite visits to confirm compliance with hazardous materials and laboratory operations. 33 RESOLUTION NO. 2024-34

25 MEMORANDUM OF UNDERSTANDING BETWEEN

THE COUNTY OF FRESNO AND SAN JOAQUIN
This Memorandum of Understanding (“MOU”) is dated ___________________ and is between the City of San Joaquin, a municipal corporation of the State of California (“City”), and the County of Fresno, a political subdivision of the State of California (“County”). County and City are each a “Party” to this MOU and are collectively “the Parties.” Recitals
A. The Parties wish to establish a monitoring and inspection system to oversee privately funded laboratories that handle infectious agents without oversight from an existing permitting public agency.

B. The joint response between the County of Fresno and the City of Reedley in 2023, dealing with an unlicensed laboratory resulted in a successful management of a potential public health issue and provided both entities the ability to retain their local control while being able to consistently advocate for additional state and federal resources. This incident has led the County to pursue a negotiated agreement with municipalities based on the successful 2023 model.

C. The County adopted Section 1. Chapter 8.52 of the Ordinance Code of Fresno County, entitled “FRESNO COUNTY INFECTIOUS MATERIALS ORDINANCE,” that applies to all nonClinical Laboratory Improvement Amendments (CLIA) regulated laboratories and research and development businesses (as that term is defined in 42 USC §263a) located or operating within the geographic area in which the health department enforces state and local statutes, orders, quarantines, rules, regulations and ordinances relating to public health in the unincorporated area of Fresno County or within the incorporated area of any city within the county, to which cities have signed a memorandum of understanding that authorizes the County to conduct oversight of the laboratories.

The Parties therefore agree as follows:

1.2 The City will retain all jurisdictional authority not pertaining to items contained in the “FRESNO COUNTY INFECTIOUS MATERIALS ORDINANCE.”

1.3 The City will provide the County a list of non-CLIA sites in their jurisdiction that the County will need to follow up on.

1.4 The City will report suspected non-CLIA sites to assess applicability to “FRESNO COUNTY INFECTIOUS MATERIALS ORDINANCE.”
County’s Responsibilities

2.1 Under the provisions of the ordinance, the County will evaluate if appropriate certifications, permits, environmental controls, safety protocols and licenses are in place for the handling of infectious materials and hazardous materials located at the non-CLIA site.

2.2 Any concerns observed by County staff will be communicated to designated City staff and a joint response would be coordinated with the business owner and property owner.

Cost Reimbursement

3.1 The Parties will establish appropriate cost reimbursement methods to support activities in responding to the “FRESNO COUNTY INFECTIOUS MATERIALS ORDINANCE”.

City will be responsible to obtain reimbursement of all costs incurred by the City and not recouped by the fees developed by the City, other funding resources or other recovery actions.

County will be responsible to obtain reimbursement of all costs incurred by the County and not recouped by the fees developed by the County, other funding resources or other recovery actions.

47 Board Agenda Item 41
DATE: January 9, 2024
TO: Board of Supervisors
SUBMITTED BY: David Luchini, RN, PHN, Director, Department of Public Health SUBJECT: Conduct Second Hearing and Adoption of Amendment to the Ordinance Code of Fresno County, Adding 8.52, “Fresno County Infectious Materials Ordinance” to Title 8, “Health and Safety”
RECOMMENDED ACTION(S):

Conduct second hearing on and adopt an Ordinance related to infectious materials in Fresno County laboratories that do not fall under federal regulations 42 United States (USC) § 263a and 42 Code of Federal Regulations (CFR) § 493.

Approval of the recommended action will adopt the Ordinance which will enable the County to address the lack of federal regulation for laboratories that do not fall under current federal regulations. Should the recommended action be approved, the County would conduct onsite visits on private property to inspect and evaluate laboratories which are not regulated by Clinical Laboratory Improvement Amendments (CLIA). This item is countywide.

ALTERNATIVE ACTION(S):

Your Board could choose not to adopt this ordinance, which would continue the loophole that exists with non-CLIA regulated labs and another Reedley lab could emerge in another area of Fresno County.

FISCAL IMPACT:

There is no increase in Net County Cost associated with the recommended action. The cost of permitting and providing oversight of laboratories will be evaluated by the Department and a future Master Schedule of Fees update would be presented to your Board for consideration and to ensure that actual costs will be recovered for activities noted in the Ordinance.

DISCUSSION:

On December 12, 2023, your Board conducted the first hearing, waived the reading of the proposed Ordinance in its entirety, and set a second hearing for the recommended adoption of the proposed Ordinance for January 9, 2024.

The Ordinance, if adopted by your Board, will provide authority for the County to conduct onsite visits on private property and evaluate if laboratories that are not regulated by CLIA, 42 USC 263a and 42 CFR 493 are in compliance with Hazardous Materials laws and general applicable clinical laboratory safety requirements (e.g. medical waste, environmental controls, policy and procedures). This Ordinance will not apply to CLIA operated laboratories which include commercial laboratories (e.g. Quest, Lab Corp), doctors’ offices that obtain a CLIA license or waiver from CLIA, and/or clinics operating under a CLIA license or County of Fresno Page 1 File Number: 23-1234

waiver from CLIA. The Department would operationalize a team from its Hazardous Materials program and its Public Health Laboratory. This team would conduct annual onsite visits to confirm compliance with hazardous materials and laboratory operations.

With your Board’s approval, the recommended ordinance will take effect 30 days thereafter.

STAFF REPORT TO COUNCIL
October 1, 2024
TO: Mayor and Council
FROM: Elizabeth Cabrera, City Manager
SUBJECT: Staff request to share costs/revenues related to upcoming Fall Fest community event with the San Joaquin-Tranquillity Lions Club.

Recommendation:

Council adopt Resolution No. 2024-35, approving up to $4,000 from the General Fund to cover half of any remaining expenses from the Fall Fest community event.

Executive Summary:

The City is partnering with the San Joaquin-Tranquillity Lions Club and the Chamber of Commerce to bring the Fall Fest Trunk-or-Treat and Tractor Pull event back to the community.

The three groups send out sponsorship letters to offset the cost of the event, which is usually around $10,000, the majority of this being to cover the fee the Tractor-Pull club charges.

However, arrangements need to be made to cover the cost in case sponsorship opportunities do not come through as anticipated.

The Lions Club requested that the City cover 50% of any expenses that may occur, and has pledged, in case of a surplus of revenues, that the City will receive 50% of those.

Staff is anticipating that could be up to $4,000, although it anticipates that it will be much less, due to anticipated sponsorships, one of which has already provided $2,000. 59 RESOLUTION NO. 2024-35

60 STAFF REPORT TO COUNCIL
September 25, 2024
TO: Mayor and Council
FROM: Stan Bulla, Public Works Director
SUBJECT: Replacement of Ice Machine in VFW Building.

Recommendation:

Council adopt Resolution No. 2024-36, authorizing a Line-item Budget Amendment and approving the purchase of a new ice machine for up to $5,500.

Executive Summary:

The current ice machine located inside the Veteran’s Memorial Hall kitchen has gone out due to high use, wear, and tear. It has come to the point where the cost of maintaining it will exceed the cost of purchasing a new one.

Having a proper running ice machine limits the over-purchasing when needing to maintain water samples cold prior to delivering to laboratory, provides a cooling element for employees when temperatures reach high levels, and provides the Veteran’s Memorial Hall kitchen with ice needed for events/rentals.

Staff compiled specifications and solicited quotes from various ice maker machine companies, with the lowest being Cresco/Resco for approximately $5,500.

Sinc this was not an anticipated expense, staff needs to get approval from Council to modify the budget. The modification needed is an additional expense which will be charged 70% to the General Fund, then 15% each to the Water and Sewer funds. 61 62

WHEREAS, the City Council of the City of San Joaquin has the authority to authorize expenditures to ensure the adequate equipment deemed necessary; and WHEREAS, having an operating ice machine saves the City money on repairs, external purchasing of ice, and preservation of public safety when maintaining the appropriate temperature of water samples, helps keep employees safe and cool, and provides the Veteran’s Memorial Hall kitchen with operable equipment when rented by the community.

WHEREAS, City staff prepared specifications for the needed replacement of the referenced ice machine, and solicited quotes for the service consistent with the City of San Joaquin Procurement Policy; and

64 MEETING DATE: October 1, 2024
TO: City Council
FROM: Elizabeth Cabrera, City Manager
SUBJECT: Consideration of Increase in City Council Compensation RECOMMENDATION:

That City Council consider whether it wishes to increase the compensation for Council Members as authorized by Government Code Section 36516 with possible direction to staff to prepare an ordinance increasing the compensation within, or up to, allowable limits set forth by Government Code Section 36516.

BACKGROUND:

In June 2023 the state legislature passed Senate Bill 329, which becomes effective on January 1, 2024. Senate Bill 329 (SB 329) amended Section 36516 of the Government Code. Government Code Section 36516 of the current Government Code now allows for Council compensation for a city with a population under 35,000, such as Kerman, to be set in an amount up to $950 per month.

Prior law set the maximum council compensation for a city with a population under 35,000 at $300/month. The City’s current ordinance complied with the prior maximum of $300/month. It states:
§ 30.22 COMPENSATION.
(A) Salary. Commencing with and effective upon the commencement of the new Council term following the election to be held in November, 2018, each Council Member shall receive a salary of $50 per month for City Council service.

A change in City Council compensation requires amendment of San Joaquin Municipal Code Section 30.22 by Ordinance. If Council decides to provide direction to prepare an ordinance to increase Council compensation, it is recommended the direction be provided at this evening’s meeting to meet the statutory time requirements. Any direction should include (i) amount of increase and (ii) reasons for the increase so that we can transform same to findings as required by SB 329.

DISCUSSION:

It should be noted that the $950.00 amount is the maximum that can be set upon adoption of the ordinance, and that, as explained below, periodic increases beyond these base amounts are permitted. SB 329 states two reasons for the increase. First, “[t]he compensation schedule for general law cities has not been adjusted since 1984, meaning that city council compensation has not kept pace with inflation.” (SB 329 § 1(a).) Second, “[a]llowing cities to adjust their compensation for inflation since 1984 may help city councils become more diverse because 65 increased compensation can help individuals from across different income levels receive sufficient income from their service to help ensure that they can continue to serve the public and support their families.” (SB 329 § 1(b).)
Section 36516 also includes a formula for increasing councilmember compensation following the original adoption of an ordinance, which formula was amended by SB 329. The increases may not exceed the greater of the following:
• The increase cannot exceed 5% for each calendar year; • The increase cannot exceed the amount of inflation since January 1, 2024, based on the California Consumer Price Index. The inflation-based increase is capped at 10% for each calendar year. [This alternative was added by SB 329.]
This means the Council can increase compensation annually either a fixed CPI amount, not to exceed 5% per year; or, by up to 10%, depending on CPI. The advantage of the fixed amount is that the increase is not dependent on actual CPI for each year, so if the CPI is low or negative, the compensation would increase by the fixed percentage regardless. The advantage of the CPI-up-to 10% increase is that in times like the last couple of years where inflation is so high, Council compensation increases would more closely match cost of living increases.

If the Council were to adopt an increase in compensation, the entire Council would become eligible for the salary increase by virtue of one or more Council members beginning a new term of office, following the November 5, 2024 election, but no earlier per Gov’t Code § 36516.5. The increased compensation would not apply before then.

Other Considerations:
• An elected mayor may by Ordinance or ballot measure be provided with additional compensation. Gov’t Code § 36516.1.
• Council may increase compensation by amounts lower than those provided for in the statute.
• The enacting Ordinance cannot provide for automatic increases. • The increases are not compounded year-to-year but rather are based on the amount of compensation as adopted by the most recent ordinance.
• All increases must be adopted by Ordinance.
• Benefits are not included in the definition of compensation. • Any or all of the compensation may be waived by a council member at any time. • SB 329 adds the following requirements to the adoption of or amendment to an Ordinance. 66 o These would apply for any Ordinance adopted after January 1, 2024. o Any proposed Ordinance, including findings justifying the need for increased compensation, must be presented at the first meeting – typically, legislative actions do not require findings, so it is noteworthy that Council compensation increases do. o The adoption of the Ordinance can take place at the second meeting, which must be held at least seven days after the first meeting -- this differs from the typical fiveday waiting period between the introduction and adoption of an ordinance.

Timeline:

If Council is interested in amending the compensation, it needs to consider that at this meeting to allow for Introduction and First Reading of a proposed Ordinance at a Special Meeting at least 7 days before the regular meeting of November 5 2024. The Second Reading and possible adoption would be on November 5, 2024 with an Effective Date of December 5, 2024 (prior to the new terms of office following the November 5, 2024 election). We must note that depending on the canvass of election returns and installation of officers as required by the Elections Code, the timing may end up being such that the compensation will not take effect until after the November 2026 election.
