**NEXT REGULAR COUNCIL MEETING WILL BE HELD SEPTEMBER 2, 2025**
STAFF REPORT TO COUNCIL
August 15, 2025
TO: Mayor and Council
FROM: Elizabeth Cabrera, City Manager
SUBJECT: Solid Waste Rate Study 2025 Final Report and Initiation of Proposition 218 Process Recommendation: That the Council review the Solid Waste Rate Study 2025 Final Report and Adopt Resolution Accepting the Final Report, Authorizing Required Actions under Proposition 218 and setting a Proposition 218 Public Hearing Date to Consider Rate Increases.
Executive Summary
At this meeting, the Council will receive the Solid Waste Rate Study Final Report from IGService, the consultant retained to conduct the sturdy. The Council will receive public input and deliberate on proceeding with the proposed rate increases. In order to do that the City must follow the Proposition 218 process.
The proposed resolution provides that the Council accepts the Final Report and authorizes initiation of the Proposition 218 process. Proposition 218 requires that all property owners and customers of record be notified of the proposed rates and the Public Hearing date. Staff has worked with will work with the Consultant and City Attorney to prepare the Draft 45-Day Proposition 218 notice required by law. Subject to Council approval of the resolution, the Notices are scheduled to be mailed out on before August 29, 2025, to meet the 45-day Public Hearing Notice timeline.
Staff would like to set the Public Hearing date for October 20, 2025, which is the date included in the resolution. If there is no majority protest at the public hearing, the Council may adopt rates at that time. The Council may ultimately set rates that are lower than those recommended in the Study but not higher.
FISCAL IMPACT: If adopted after the public hearing, the proposed fees would generate an increase to the Solid Waste enterprise fund to help to meet administrative and operational costs, increased costs with Mid Valley Disposal, and increased costs associated with compliance under state legislation (SB 1383).

Solid Waste Rate Study for City of San Joaquin
Purpose
The purpose of this cost-of-service solid waste rate study is to review, modify and expand the existing rate structure such that customer rates are proportional to the cost of providing specific services and such that new services required have a rate assigned to them. As a part of this study, overall operating costs and revenue have been analyzed to evaluate reasonableness of costs and the need to increase overall revenue. These steps are conducted to comply with the requirements of California’s Proposition 218.
Executive Summary
San Joaquin’s existing refuse-related rates have been in place for up to 15 years. This cost-ofservice rate study is necessary due to fee increases from Mid-Valley Disposal, the city’s contracted supplier, and to update cost allocation of the city’s overhead costs. City Council has previously approved a new agreement with Mid-Valley, necessary for Mid-Valley to align its service fees with its own current costs and to cover anticipated compliance costs associated with SB1383 related to reduction of greenhouse gas emissions. Effective November 1, 2025, Mid-Valley’s fees increase overall an average of 113 percent. The result of the rate study is that single-family rates are proposed to increase an average of 96 percent, and commercial rates to increase an average of 148 percent. After the initial rate increases, all rates are proposed to increase 4.7 percent per year for the next four years beginning July 1, 2026, as Mid-Valley fees also increase over the same period.
Contracted Refuse Service with Mid-Valley Disposal, Inc.
Solid waste disposal services in San Joaquin have been provided by Mid-Valley Disposal, Inc. since 2008. After many years, Mid-Valley has requested and received fee increases for its services and has established new fees for additional services required by Senate Bill 1383 related to greenhouse gas reduction from the waste stream. In conjunction, Mid-Valley has requested and received a new, updated form of agreement with the city of San Joaquin. 1 The new agreement
with Mid-Valley includes more recent legal and waste hauling requirements, associated with Senate Bill 1383. Following execution of the new agreement, an amendment was added that revised Mid-Valley’s fee structure and removed the specified Franchise Fee. Beyond MidValley’s increases associated with the additional costs of SB 1383, the new agreement allows for an annual cost increase each year on July 1st, following the fee schedule in the amended agreement.
The term of the agreement is 10 years. Though the new agreement is now effective, the new fees to Mid-Valley will not be implemented until November 1, 2025. After the initial new fee schedule starting November 1, the agreement specifies increasing fees based on annual fee schedules for four years beginning July 1, 2026.
1 Resolution 2025-18, approved March 27, 2025.
6 2
San Joaquin’s role for the Disposal Enterprise is billing, payment collection, and customer services. San Joaquin’s personnel coordinate closely with Mid-Valley regarding new services and changes in services. Mid-Valley is paid once per month by San Joaquin based on the number of services in place the previous month and the fee schedule in the agreement, which is different than the rates charged to customers by San Joaquin. The differences between San Joaquin’s rates and fees paid to Mid-Valley cover a portion of San Joaquin’s billing, customer services, and general overhead.
Existing Rate Structure
Existing and proposed rates can be seen in Attachment 1.
The existing commercial and industrial rates have been in place for at least 10 years, some up to 15 years. Single-family residential customers are billed $10.00 per month plus a recycling lineitem charge of $3.45, for a total of $13.45. Commercial rates are in place for various bin sizes and pick-up frequencies, including some commercial recycling rates. No commercial organics rates are currently in place. To accommodate the City’s billing system, some commercial rate combinations have been bundled into a lump sum amount (such as the schools). Accordingly, as new rates and additional services are added following city council approval, an audit of rates and services on record in the billing system must be conducted and compared to actual services provided to customers.
Historical and Projected Revenue, Expense and Fund Balance Historic and projected revenues, expenses and fund balances can be seen in Attachment 2.
Overall revenue into the disposal enterprise fund has been relatively constant over many years because rates have been constant. The largest expense for the Disposal Enterprise is Mid-Valley Disposal. The remaining expenses are the cost of general government and salaries.
Historically, San Joaquin has used franchise fees to cover the City’s operating costs and has not transferred franchise fees to the general fund as compensation to the City for Mid-Valley’s exclusive right to operate in the City of San Joaquin. The current methodology is for the city to deduct the franchise fee component from payments each month to Mid-Valley. Specifically, 15 percent is deducted from each payment to Mid-Valley for commercial services, and 10 percent or exactly one dollar per customer is deducted from single-family services. The current amount of franchise fee withheld each month is approximately $2,200 for a total of approximately $26,400 per year. This amount has approximated the city’s operating costs assigned to the Disposal Enterprise such that revenue over expense each year has been roughly breakeven.
Most significantly, projected expenses incorporate a 113 percent increase in fees paid to MidValley effective November 1, 2025. For the first month of the Mid-Valley increase, November 2025, the payment to Mid-Valley will increase from approximately $18,000 to $38,000, a monthly increase of $20,000. This is a very significant increase, but is a result of Mid-Valley not increasing its fees to the city for many years.
7 3
Projected salaries and city overhead costs for the Disposal Enterprise have been provided by the city finance department based on fiscal year 2025/26. They are shown in the table below, along with a contribution to the general fund and to the disposal fund balance such that the franchise fee component is six percent of fees paid to Mid-Valley. The table below is expanded showing subtotals to support cost-of-service calculations.
The amount for salaries and city overhead has been increased from the historical amount of approximately $26,400 per year to $54,632 per year. The contribution to the fund balance is to recover the present negative balance such that the fund balance is moving toward being positive over the planning period. In this case, the fund balance is still negative in the fifth year, but because of the positive net income in the fifth year of approximately $10,000, the fund balance is set to become positive in the sixth year. The contribution to the general fund is based on six percent of fee payments to Mid-Valley, or approximately $2,300 per month beginning November 1, 2025.
Beyond the base planning year of fiscal year 2025/26, expenses associated with personnel are escalated at five percent per year, and other expenses are escalated at three percent per year2 .
Rate Design
The rate setting table is shown in Attachment 3 for the initial reset, and Attachment 4 shows rate setting for July 1, 2026, through July 1, 2030.
The proposed customer rates are based on the increased fees charged by Mid-Valley that are then increased by the amount of the City’s costs for general and administrative services, a franchise contribution of six percent to the general fund, and a buffer to recover the Disposal Fund balance to positive over the planning period. On a percentage basis, the average margin above Mid-Valley 2 The reason the revenue and expense table (Attachment 2) shows revenue increases of 84 percent in the first year and 29 percent the second year is because increased rates in the first year apply to only eight months of Fiscal Year 2025/26, whereas the increases will apply to all months in the following years.

to cover City costs is 19 percent, however, the margin above the single-family, three-cart fee is slightly higher than the amount above commercial fees. This is because of the added customer service effort necessary for single-family compared to commercial customers. Proper cost-ofservice rate setting suggests account-related costs, such as billing and customer service, to be based on the cost of that service by account rather than a simple percentage margin above Mid-Valley’s fees. Consequently, more customer-services costs are allocated to single-family customers on a per-account basis. Specifically, $18,376 of billing and customer service costs is allocated based on number of accounts rather than a percentage above Mid-Valley. The calculation table is shown below.
Accordingly, $829 per month of billing and customer service cost is shifted from commercial bin customers to single-family, three-cart customers. The rate setting table increases single-family rates to 26 percent above Mid-Valley’s fees then lowers commercial rates to an average of 16 percent above Mid-Valley’s fees. The calculation is done as an exception to the 19 percent default calculation based on straight percentage above the Mid-Valley fee structure.
For single-family, three-cart service specifically, the bar chart below shows the present and proposed allocation of costs adding to the total monthly rate over the planning period. For example, the proposed rate of $26.37 beginning November 1, 2025, illustrates both the increase in Mid-Valley’s fees and the increased allocations of city costs that make up the overall rate. % of

The existing single-family and commercial cart rates include a recycling rate of $3.45 per service per month. This shows as a line item on existing customer bills. In the proposed rate structure, this line-item billing amount is removed and the associated costs incorporated in the new proposed rates.
A similar bar chart is shown below for a commercial 3-yard bin picked up one time per week. As with the three-cart service, the initial increase is substantial, in this case from $64.50 to $142.14 beginning November 1, 2025. Note that the Salaries/Billing cost component illustrates a slightly higher cost than for three-cart service but is a much lower percentage of the total bill. This is consistent with cost-of-service rate setting, to charge commercial customers fairly based on cost per bill issued, rather than the same percentage of the bill as residential customers. 10 6
Rate Comparisons to Surrounding Communities
Rate comparisons are shown below for single-family three-cart service and for a commercial threeyard bin picked up one time per week. For both services, the present rates charged by San Joaquin are dramatically lower than surrounding communities.
The initial increase to $26.37 per month for three-cart service places San Joaquin on the lower side of the comparison to other communities. This is because, as a courtesy to the city of San Joaquin to soften the initial rate increase impact, Mid-Valley Disposal has staged increases over the planning period as shown in the rate illustrations above. However, even the rate of $31.69 proposed for July 1, 2029, would still be within reason when compared to today’s rates, and this is before likely rate increases to be made by other communities over the next five years. The same is true in the commercial comparison.
11 7
12 8
Conclusion
The work of this rate study results in major changes to San Joaquin’s solid waste disposal rates.
Proposed rates are provided that are proportional to the new fees provided by Mid-Valley, including rates for recycling and organics. The resultant rates are compliant with the requirements of Proposition 218 regarding cost-of-service rate setting methodology. 13 9

CITY OF SAN JOAQUIN NOTICE OF PUBLIC HEARING
Regarding Proposed Solid Waste Rate Increases
The City Council of the City of San Joaquin will conduct a public hearing to consider proposed Solid Waste rate increases. The date, time, and place of the public hearing is as follows:
Date: October 20, 2025
Time: 6:00 pm
Location: City of San Joaquin Council Chambers
21991 Colorado Avenue, Suite A, San Joaquin, CA
This Notice is being furnished to you by the City pursuant to California Constitution Article XIIID (also known as “Proposition 218”). Proposition 218 requires that the City notify the property owners of record of proposed increases to property-related fees, such as fees for water, sewer service, solid waste, and storm drainage. This serves as notice that the City Council will conduct a public hearing, at the time, date, and location specified above, to consider recommended increases in the amounts set forth below and in the attachments to its Solid Waste rates. At the hearing the City Council will hear and consider objections and protests to the proposed increases described in this Notice.
Rate Study Report: A Rate Study Report by IGService, dated August 8, 2025, describing details of the Solid Waste rate changes and the method used to calculate the rate changes has been prepared, and the contents submitted to the City Council (Report). The Report includes the research, reasoning, and analysis behind the proposed adjustments. The Report is incorporated into this Notice by reference and will be addressed at the Public Hearing. The Report is available at City Hall and can also be found on the City website at www.cityofsanjoaquin.org.
Amount of Proposed Modified Rates: For a single-family home receiving standard 3- cart service, the proposed rate effective November 1, 2025, will be $26.37 per month, which is an increase 96 percent or $12.92 per month above the current rate of $13.45.
Subsequent single-family increases are proposed to follow over four years: Effective July 1, 2026, the rate will be $27.61. Effective July 1, 2027, the rate will be $28.91. Effective July 1, 2028, the rate will be $30.27. Effective July 1, 2029, the rate will be $31.69. The rates for Seniors with smaller cart service are proposed to be reduced below the rates for standard single-family service, as they are presently reduced.
Commercial solid waste rates increase by an average of 148 percent overall in the first year. Specific commercial rates are initially adjusted to achieve cost-of-service equity effective November 1, 2025, then increase by 4.7 percent per year as shown in detail in the attached rate table. New proposed rates are introduced for commercial recycling, commercial organics, and miscellaneous services.
All rates are set to achieve cost-of-service equity for services provided. See the attached rate table for details of the existing and proposed rates. 18 2
Reasons for the Needed Increases: The primary reason for increased rates is for the City to cover administrative and operational costs, Mid-Valley Disposal costs for waste hauling, and increasing costs of compliance associated with Senate Bill 1383 related to greenhouse gas reduction. Rates have not increased for over 10 years. Cost-of-service adjustments have also been made such that customers pay their fair share of administrative and overhead costs. Details of the proposed rate changes can be found in the Report. Revenue from the modified rates and charges will not be more than the funds required for the City to provide adequate service. Specifically, the proposed rates do not exceed the proportional cost of providing each service.
Procedure for Hearing and Determining Majority Protest: Members of the public are welcome to attend the public hearing in person regarding rate changes and will have an opportunity to speak and give testimony; however, only written protests as described below count toward a majority protest.
At the public hearing, the Council will hear and consider all objections and protests, if any, to the proposed increases and other matters described in the Report. The Council may continue the hearing from time to time. At the close of the hearing, if written protests against the proposed increases are presented and not withdrawn by a majority of the record owners (or customers-of-record) of the parcels which would be subject to the increases, the City may not impose the increased rates; instead, rates would continue at their existing levels. If, at the close of the protest hearing, there is no majority protest as described above, the Council may approve the increases, as proposed, or as modified by the Council, to be effective November 1, 2025.
How to Submit a Protest. Protests may be submitted by the record owner or tenant who is a customer-of-record of the parcel and subject to the proposed rates, but only one protest per parcel will be counted. Written protests must contain a clear statement that it is a protest against the proposed Solid Waste increases and must include the name of the owner or customer of record, a description of the parcel or parcels (Assessor’s Parcel Number or street address) and an original signature of the owner or customer of record. Written protests regarding the proposed rate changes may be mailed or personally delivered to: City of San Joaquin, City Clerk, 21900 Colorado Avenue, San Joaquin, CA 93660.
To be valid, a protest must be in writing and received by the City Clerk at City Hall no later than 4 P.M. on the date of the hearing or, if presented at the hearing itself, before the close of the public hearing on October 20, 2025. Fax, e-mail, or copies of protests are not acceptable and will not be counted.
Additional Information: For more information visit the City’s website as provided above. Please direct questions about the proposed rate proceeding to Alondra Bautista, Executive Assistant/City Clerk, at (559) 693-4311, or by email to [email protected].
