TO: City Council
FROM: Elizabeth Cabrera, City Manager
SUBJECT: Consideration of Ordinance Increasing City Council Compensation RECOMMENDATION:

That the City Council consider waiving the full second reading and consider adoption of Ordinance Amending Section 30.22 of the San Joaquin Municipal Code Regarding City Council Compensation.

EXECUTIVE SUMMARY:

The current compensation for Council Member is $300 per month. At its meeting of June 9, 2026, the Council considered whether to direct staff to prepare an ordinance increasing City Council compensation. After discussion on this matter, the Council directed that an ordinance be prepared setting compensation for Council Members be set at $950 per month.

On July 7, 2026, City Council waived the full reading and introduced the ordinance by title only..

The proposed ordinance compensation amount is within allowable limits set forth by Government Code Section 36516. The proposed ordinance amends current Section 30.22 of the San Joaquin Municipal Code.

DISCUSSION:

The discussion and ability of Council to make such changes is governed by Senate Bill 329, which became effective on January 1, 2024. SB 329 amended Section 36516 of the Government Code to now allow for Council compensation for a city with a population under 35,000, such as San Joaquin, to be set in an amount up to $950 per month.

A question was asked whether the $950 cap may be increased in the future. Yes, it may but not automatically. It must be done by an ordinance amendment.

Government Code Section 36516 (a) (5) states:

No ordinance shall be enacted or amended to provide automatic future increases in salary.

Government Code Section 36516 ((a) (4) states:

The salary of council members may be increased beyond the amount provided in this subdivision by an ordinance or by an amendment to an ordinance, but the amount of the increase shall not exceed the greater of either of the following:
16 (A) An amount equal to 5 percent for each calendar year from the operative date of the last adjustment of the salary in effect when the ordinance or amendment is enacted.
(B) An amount equal to inflation since January 1, 2024, based upon the California Consumer Price Index, which shall not exceed 10 percent for each calendar year.

Government Code Section 36516 (g)(1) states as follows:

For the purposes of this section, a city council shall consider the adoption of an ordinance to increase compensation in open session during at least two regular meetings of the city council.
(2) At the first meeting, the city council shall present the proposed ordinance, which shall include findings demonstrating the need for the increased compensation. The ordinance shall not be adopted at the first meeting.
(3) At least seven days after the first meeting, the city council shall hold a second meeting to consider whether to adopt the ordinance.

If the Council were to adopt the ordinance increasing compensation, the entire Council would become eligible for the salary increase by virtue of one or more Council members beginning a new term of office, following the November 3, 2026 election.

Financial Impact: Council Stipend budget will increase by $39,000 for total impact of $57,000 annually. This will be split 50% general fund, 25% water and 25% sewer. All budgets can absorb this financial impact.

JOAQUIN, CALIFORNIA AMENDING SECTION 30.22 OF TITLE III, CHAPTER 30 OF THE SAN JOAQUIN MUNICIPAL CODE

REGARDING CITY COUNCIL COMPENSATION
WHEREAS, Sections 36516 and 36516. 5 of the California Government Code authorizes the setting of salary for the Council Members and the Mayor based on population; and WHEREAS, Government Code Section 36516(a) (d) (C) provides that cities with a population of 35,000 or less may enact an ordinance that each member of the City Council shall receive compensation in the amount of $950 per month; and WHEREAS, Senate Bill 329 (“SB 329”) was adopted to “reset” City Council salaries to reflect the important work done by City Council Members, to take into account the impacts of inflation and economic realities on those who serve as City Council Members, and to encourage more persons to consider service as Council Members by making the compensation more reflective of the time and work being performed; and
WHEREAS, the City has a population of 3,701; and
WHEREAS, there has been a significant increase in the work of the City Council since Council compensation was last adjusted; and
WHEREAS, the Council has determined to adjust salary within the allowable amounts set forth in SB 329; and
WHEREAS, Government Code Section 36516.5 allows for an increase in compensation for the entirety of the City Council “whenever one or more members of the City Council becomes eligible for a salary increase by virtue of the council member beginning a new term of office.”

SECTION 2. This Ordinance is adopted in conformance with the authority granted under Government Code Section 36516 and 36516. 5.

SECTION 3. Section 30.22 of Title III, Chapter 30 of the San Joaquin Municipal Code is amended to read as follows:
18 § 30.22 COMPENSATION.

Gov’t Code §§ 53232.2 and 53232.3.

SECTION 4. CEQA. The City Council finds that adoption of this Ordinance is exempt from CEQA because: (i) it is not a project within the meaning of Public Resources Code, section 21065 because it has no potential to alter the physical environment; and (ii) pursuant to CEQA Guidelines section 15061(b)(3), the so-called “common sense” exemption, for this same reason.

SECTION 5. Severability. If any section, subsection, subdivision, sentence, clause or phrase in this Ordinance or any part thereof is for any reason held to be unconstitutional, invalid or ineffective by any court of competent jurisdiction, such decision shall not affect the validity or effectiveness of the remaining portions of this Ordinance or any part thereof. The City Council hereby declares that it would have adopted each section irrespective of the fact that any one or more subsections, subdivisions, sentences, clauses, or phrases are declared unconstitutional, invalid, or ineffective.

SECTION 6. Effective Date. This Ordinance shall become effective thirty (30) days from its adoption pursuant to Government Code section 36937.

20 STAFF REPORT TO COUNCIL
August 4, 2026
TO: Mayor and Council
FROM: Elizabeth Cabrera, City Manager
SUBJECT: Ordinance Updating References to California Construction Codes in the San Joaquin Municipal Code.

Recommendation
Staff recommend Council hold a public hearing, waive the full second reading, and adopt Ordinance No. 2026-03 updating references in the Municipal Code of the City of San Joaquin relating to California Construction Codes.

Executive Summary
The proposed ordinance updates the San Joaquin Municipal Code (SJMC) with the references to the latest editions of various construction codes (2025 Edition of California Standards Code).

The building department enforces these codes when approving construction and performing inspections.

Background
Beginning on January 1, 2026, the City of San Joaquin, like all other cities, is required by State law to enforce the 2025 Edition of Ca1ifornia Building Standards Code, also known as Title 24 of the California Codes of Regulations.

Every three years, the California Building Standards Commission adopts new model codes, known collectively as the California Building Standards Code, to establish uniform standards for the construction and maintenance of buildings, electrical systems, plumbing systems, mechanical systems, and fire and life safety systems. Sections 17922, 17958 and 18941.5 of the California Health and Safety Code require that the latest edition of the California Building Standards Code and Uniform Housing Code apply to local construction 180 days after publication. These are collectively called the California Building Standards Code and form the basis upon which new construction is approved and inspections for buildings and other structures are performed.

The attached ordinance updates the SJMC to adopt, by reference, the codes that will be effective 30 days after adoption.

Therefore, Chapter 151 of this code, and not the applicable sections of the Uniform Building Code, will govern the construction offences with the city.

SECTION 2. Effective Date. This ordinance shall become effective thirty days after its adoption.

SECTION 4. Publication. Upon passage, this ordinance or a summary of the same shall be published within fifteen (15) days of passage, pursuant to the laws of the State of California, in the San Joaquin news, a newspaper of general circulation published and circulated in said City of San Joaquin. TO: Honorable Mayor and City Council
FROM: Elizabeth Cabrera, City Manager
DATE: August 4, 2026
SUBJECT: HOME Program Income Commitment to the Cordillera Commons Project

RECOMMENDATION
It is recommended the City Council adopt the attached resolution to commit up to $1.25 million in HOME Program Income funds to the Cordillera Commons Project.

BACKGROUND
The State of California Department of Housing and Community Development (HCD) issued a Notice of Funding Availability (NOFA) for HOME Investment Partnerships Program (HOME) funds on January 19, 2024, with applications due no later than 5:00 p.m. on April 9, 2024. The Fresno County Housing Authority requested that the City apply for HOME grant through the January 19, 2024, NOFA and for the use of HOME Program Income funds to partially fund the construction of the Cordillera Commons Apartments containing 50 affordable units and one manager unit located at W. Colorado Avenue and 5th in the City.

The city was notified that this application has been awarded and has been working with the State to meet funding and environmental requirements so that they may begin utilizing these grant.

DISCUSSION:

As part of this successful application, the city committed HOME Program Income monies to the project to offset additional costs. Since the commitment in 2024, the City has received additional loan payoffs in the form of Program Income and expects to receive additional funds in the coming months/years. To best utilize these funds, the City is requesting Council to authorize an increase in the Program Income commitment from $750,0000 to $1,250,000.

The City currently has a cash on hand balance of approximately $875,000. The remaining funds are accounting for additional payoffs. The City is not responsible for providing all of the $1,250,000 should the City not receive that much during the construction of this contract – but it provides a safety net should they; and thus would not require staff to return to Council for those expected monies. On our most recent call with the State, this action was recommended by their staff.

FISCAL IMPACT
No impact to general fund.
