August 20, 2026
TO: Mayor and Council
FROM: Elizabeth Cabrera, City Manager
SUBJECT: Determination under Elections Code Section 10229 whether to appoint two nominated candidates to two Council Seats or hold the Election.

Recommendation
It is recommended that the City Council consider adoption of Resolution No. 2026-35 Appointing Nominees Adam Flores-Cornejo And Dora Martha Mejia to the two City Council seats and Cancelling the November 3, 2026 Election To Be Held For These Offices The resolution provides for the appointment of two members to the offices of the City Council that were to go through an election on Tuesday, November 3, 2026. The Resolution also cancels the election.

Executive Summary
After the close of the nomination period for City Council candidates, the Fresno County Elections Office notified the City that there was a total of two candidates for the two open seats on the November 3, 2026, election. Per California Elections Code Section 10229, when there is only one or no nominees for elective office, the governing board may appoint such nominee to office or hold the election as scheduled. Therefore, the Council may appoint the nominees which means the election would be cancelled or proceed with holding the election.

The period for nominating candidates closed on Friday, August 10, 2026, with only two candidates qualifying as nominees. The candidates are incumbents Adam Flores-Cornejo and Dora Martha Mejia.

Under these circumstances and in accordance with Elections Code 10229, the City Council may take one of the following courses of action:

1. Appoint to the office the person(s) who has/have been nominated

2. Hold the election if either no one or only one person has been nominated If Council chooses to appoint, the person(s) appointed shall qualify and take office and serve exactly as if elected. In addition, the City Clerk shall not accept for filing any statement of writein candidacy after the appointment is made. If the Council does not appoint the two nominees, by August 20, 2026, the election will be held.
1 Not holding the election will save the City the cost of the election.

The City Clerk has complied with the requirements of Elections Code 10229 by providing the City Council with the Notice and Certification as well as posting the Notice and Certification.

SUBJECT: Council approval of two agreements with Rural Development Centers for billboard leasing
Recommendation:

Council adopt Resolution No. 2026-36, approving two agreements with Rural Development Centers for the lease of a billboard to promote activities funded through the California Highway Patrol Cannabis Tax Fund Grant Program for Fiscal Years 2025-2026 and 2026-2027.

Executive Summary:

The City of San Joaquin was awarded funding through the CHP Cannabis Tax Fund Grant Program for Fiscal Years 2025-2026 and 2026-2027. The City has entered into agreements with Rural Development Centers (RDC) to assist with implementing educational and community outreach activities supported by the grant funds.

In partnership with the City, RDC organizes interactive and educational activities designed to increase awareness of the effects and dangers of substance use and impaired driving. These activities include the use of Fatal Vision Goggles and electric golf carts to provide participants with a hands-on demonstration of the effects of intoxication on motor coordination, decisionmaking, and reaction time.

RDC also organizes educational workshops and peer mentoring sessions for parents and adults.

These sessions focus on recognizing signs of substance abuse, promoting healthy communication, and establishing appropriate boundaries with children and youth.

As part of these outreach efforts, RDC has provided the City with access to a billboard to promote educational events, workshops, and other grant-funded activities. The agreements presented for Council consideration cover two consecutive grant-funded fiscal-year periods.

The first agreement covers December 1, 2025, through June 30, 2026, at a monthly rate of $1,500, for a total cost of $10,500. The second agreement covers July 1, 2026, through June 30, 2027, at a monthly rate of $1,500, for a total cost of $18,000.

The billboard lease expense is an eligible grant expenditure under the CHP Cannabis Tax Fund Grant Program and will be funded with the respective fiscal-year grant funds. 8 RESOLUTION NO. 2026-36

9. USE OF EQUIPMENT. Lessee shall only use the Equipment in a careful and proper manner and will comply with all laws, rules, ordinances, statutes and orders regarding the use, maintenance of storage of the Equipment.

10. DEFAULT. If Lessee fails to perform or fulfill any obligation under this Agreement, Lessee shall be in default of this Agreement. Subject to any statute, ordinance or law to the contrary, Lessee shall have seven (7) days from the date of notice of default by Lessor to cure the default. If Lessee shall become insolvent, cease to do business as a going concern or if a petition has been filed by or against Lessee under the Bankruptcy Act or similar federal or state statute, Lessor may immediately declare Lessee in default of this Agreement. In the event of default, Lessor may, as permitted by law, re-take possession of the Equipment. Lessor may, at its option, hold Lessee liable for any difference between the Rent that would have been payable under this Agreement during the balance of the unexpired term and any rent paid by any successive lessee if the Equipment is re-let minus the cost and expenses of such reletting. In the event Lessor is unable to re-let the Equipment during any remaining term of this Agreement, after default by Lessee, Lessor may at its option hold Lessee liable for the balance of the unpaid rent under this Agreement if this Agreement had continued in force.

13. MAINTENANCE, DAMAGE AND LOSS. Lessee will, at Lessee's sole expense, keep and maintain the Equipment clean and in good working order and repair during the Lease Term.

14. INSURANCE. Lessee shall be responsible to maintain insurance on the Equipment with losses payable to Lessor against fire, theft, collision, and other such risks as are appropriate and specified by Lessor. Upon request by Lessor, Lessee shall provide proof of such 17

insurance.

15. ENCUMBRANCES, TAXES AND OTHER LAWS. Lessee shall keep the Equipment free and clear of any liens or other encumbrances, and shall not permit any act where Lessor’s title or rights may be negatively affected. Lessee shall be responsible for complying with and conforming to all laws and regulations relating to the possession, use or maintenance of the Equipment. Furthermore, Lessee shall promptly pay all taxes, fees, licenses and governmental charges, together with any penalties or interest thereon, relating to the possession, use or maintenance of the Equipment.

16. LESSORS REPRESENTATIONS. Lessor represents and warrants that he/she has the right to lease the Equipment as provided in this Agreement and that Lessee shall be entitled to quietly hold and possess the Equipment, and Lessor will not interfere with that right as long as Lessee pays the Rent in a timely manner and performs all other obligations under this Agreement.

17. OWNERSHIP. The Equipment is and shall remain the exclusive property of Lessor.

18. SEVERABILITY. If any part or parts of this Agreement shall be held unenforceable for any reason, the remainder of this Agreement shall continue in full force and effect. If any provision of this Agreement is deemed invalid or unenforceable by any court of competent jurisdiction, and if limiting such provision would make the provision valid, then such provision shall be deemed to be construed as so limited.

19. ASSIGNMENT. Neither this Agreement nor Lessee’s rights hereunder are assignable except with Lessor’s prior, written consent.

20. BINDING EFFECT. The covenants and conditions contained in the Agreement shall apply to and bind the Parties and the heirs, legal representatives, successors and permitted assigns of the Parties.

There are no other promises, conditions, understandings or other agreements, whether oral or written, relating to the subject matter of this Agreement. This Agreement may be modified in writing and must be signed by both Lessor and Lessee.

22. CUMULATIVE RIGHTS. Lessor’s and Lessee’s rights under this Agreement are cumulative, and shall not be construed as exclusive of each other unless otherwise required by law.

23. WAIVER. The failure of either party to enforce any provisions of this Agreement shall not be deemed a waiver or limitation of that party's right to subsequently enforce and compel strict compliance with every provision of this Agreement. The acceptance of rent by Lessor does not waive Lessor’s right to enforce any provisions of this Agreement.

24. INDEMNIFICATION. Except for damages, claims or losses due to Lessor’s acts or negligence, Lessee, to the extent permitted by law, will indemnify and hold Lessor and Lessor’s property, free and harmless from any liability for losses, claims, injury to or death of any person, including Lessee, or for damage to property arising from Lessee using and possessing the Equipment or from the acts or omissions of any person or persons, including Lessee, using or possessing the Equipment with Lessee’s express or implied consent. 18
