SUBJECT:

Initiation of proceedings Regarding Road Vacation No. 26-03 to Abandon Colorado Court pursuant to Streets and Highways Code Section 8320 et seq. to vacate public utility and access easements within the Cordillera Commons project and approve new public utility easements and setting a public hearing.

RECOMMENDATION:

Staff recommends that the City Council adopt Resolution No. 2026-40 Initiating Vacation proceedings for Road Vacation No. 26-03 to Abandon Colorado Court Generally Located On Tract 4076 Recorded In Book 51 Of Maps at Page 92 of the Fresno County Records and Vacating Public Utility and Access Easements Within the Cordillera Commons Project and to Approve New Public Utility Easements and Setting a Public Hearing.

BACKGROUND:

An application for the road vacation (RV) was submitted in July of 2026 along with a Lot Line Adjustment (LLA) No. 26-03. This RV and LLA are essential for the development of the Cordillera Commons project being developed by the Fresno Housing Authority.

The City provided the applicant with written comments on the LLA and alley vacation. After the applicant received these comments and a meeting with City staff, a follow-up submittal with a lot line adjustment legal description and proposed map was submitted. The City has reviewed and accepted the LLA and RV on September 11, 2026. In addition, several existing public utility easements on the subject property are needing to be abandoned with new ones accepted that conform to the project design and City and project needs to provide utility access to the site.

This approval to initiate the RV is a necessary step in compliance with Streets & Highways Code section 8320 et seq. The map submitted depicting the RV and easement changes is on Exhibit 1.

The LLA is shown in Exhibit 2.
3 DISCUSSION:

This approval starts the process to allow the Planning Commission and City Council to review these requests at their October 6, 2026, hearing to consider approval of these items. The vacation of the existing right-of-way will facilitate construction of the Cordillera Commons entitled project.

The vacation proceeding is being conducted pursuant to Streets & Highways Code section 8320 et seq.

The public notice of the public hearing on the vacation, et. al., will be provided in accordance with Streets and Highways Code Section 8322 and other applicable provisions of the Streets and Highways Code and City of San Joaquin. See Exhibit 3.

CEQA DETERMINATION:

The action to initiate vacation proceedings is not a project under CEQA pursuant to CEQA Guidelines Section 15378 because it constitutes an organizational or administrative activity that will not result in a direct or indirect physical change in the environment.

GENERAL PLAN CONSISTENCY:

The consistency of the project with the San Joaquin General Plan will be assessed and provided on October 6, 2026, by the Planning Commission prior to the City Council hearing on the vacation proceedings. The site is designated Medium Density Residential in the General Plan.

ZONING ORDINANCE CONSISTENCY:

The consistency of the project with the San Joaquin zoning code will be assessed and provided on October 6, 2026, by the Planning Commission prior to the City Council hearing on the vacation proceedings. The site is zoned R-3, Multi-Family Residential.

FISCAL IMPACT:

The proposed Lot Line Adjustment and Alley Vacation will not have any fiscal impacts.
